Application No. 1044 OF 2004\n               - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n                  Dated this the 17th day of November 2008\n\n                                    JUDGMENT\n<\/pre>\n<p id=\"p_1\">H.L.DATTU, C.J.\n<\/p>\n<p id=\"p_1\">       Memo filed by the learned counsel for the appellant to delete the<\/p>\n<p>4th respondent from the array of parties is taken on record. In view of the<\/p>\n<p>memo, the appellant is permitted to delete the 4th respondent from the<\/p>\n<p>array of parties, at his own risk.\n<\/p>\n<p id=\"p_2\">       2. Delay in filing the writ appeal is condoned, since the issue<\/p>\n<p>raised is covered by a decision of a Division Bench of this Court.<\/p>\n<p id=\"p_3\">       3. This appeal is directed against the orders passed by a learned<\/p>\n<p>Single Judge in WP(C) No. 24931 of 2003 dated 18.12.2003. By the<\/p>\n<p>impugned order the learned Single Judge has sustained the vires of<\/p>\n<p>Sub-section (1) (a) of Section 4 of the Kerala Chitties Act as introduced<\/p>\n<p>by <a href=\"\/doc\/104566\/\" id=\"a_1\">Finance Act<\/a> 7 of 2002.\n<\/p>\n<p id=\"p_4\">       4.   The common order passed by the learned Single Judge was<\/p>\n<p>called in question before the Division Bench of this Court. The Division<\/p>\n<p>Bench has allowed the writ appeals and has declared that sub-section<\/p>\n<p>(1) (a) of Section 4 of the Kerala Chitties Act, as introduced by <a href=\"\/doc\/104566\/\" id=\"a_1\">Finance<\/p>\n<p>Act<\/a> 7 of 2002, as discriminatory and violative of <a href=\"\/doc\/935769\/\" id=\"a_2\">Article 19(1)(g)<\/a> of the<\/p>\n<p>WA No.1064 of 2004<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                       -:2:-<\/span><\/p>\n<p>Constitution of India and beyond the legislative competence of the State<\/p>\n<p>Legislature and would not bind the chitties started and conducted outside the State<\/p>\n<p>of Kerala and, therefore, void and unconstitutional.<\/p>\n<p id=\"p_5\">       5.
