K. Puram, New Delhi<br \/>\napplied to the Rajya Sabha Sectt. seeking the following information:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>         &#8220;1.   List of finally selected candidates with marks obtained by<br \/>\n               them separately in written exam Physical Test and Interview.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>         2.    List of unqualified\/ failed candidates after Interview with<br \/>\n               marks obtained by them in written Exam, Physical and<br \/>\n               Interview.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>         3.    Photocopy of list of marks given by the panel, which<br \/>\n               conducted the field test having signature of panel members.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>         4.    Photocopy of list of marks given by the interview panel that<br \/>\n               conducted the interview having signature of panel members.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>         5.    Were the vacancies of General Category in Lok Sabha was<br \/>\n               published in news paper if so please provide the information<br \/>\n               related to it.&#8221;<\/p><\/blockquote>\n<p id=\"p_2\">     CPIO, Sh. Deepak Goyal, Director, Rajya Sabha Sectt transferred this<br \/>\napplication. to the Lok Sabha Sectt. on 16.10.07, informing the appellant Smt.<br \/>\nAsha Rani accordingly. Shri Harish Chander, Dy. Secretary (II) Information Cell,<br \/>\nLok Sabha Sectt. replied to the application on 8.11.07 as follows:\n<\/p>\n<blockquote id=\"blockquote_5\"><p>         &#8220;As regards the information sought in point Nos. 1 to 4, these<br \/>\n         cannot be given to the applicant, as larger public interest does not<br \/>\n         warrant the disclosure of the requisite information. Moreover, the<br \/>\n         applicant by demanding so seeks to enter into the process of<br \/>\n         evaluation. If such requests are acceded to, it could lead to gross<br \/>\n         and indefinite uncertainty in the system, besides resulting in utter<br \/>\n         confusion on account of enormity of labour and the time involved in<br \/>\n         the process. The identity of the panel members cannot be<br \/>\n         disclosed under <a href=\"\/doc\/1525538\/\" id=\"a_1\">section 8<\/a> (1) (e) of the Right to <a href=\"\/doc\/1965344\/\" id=\"a_2\">Information Act<\/a>,<br \/>\n         2005.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_6\"><p>         Regarding point no.5<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                               1<\/span><br \/>\n        The vacancies in General Category for Security Assistant, Grade-II<br \/>\n       in Lok Sabha Secretariat were not published in the newspapers.<br \/>\n       However, the vacancy position was later revised to include General<br \/>\n       category as well.     In the advertisement published in the<br \/>\n       newspapers there was a clarification\/ note that &#8216;Where specific<br \/>\n       category has been prescribed for vacancies in any post, there are<br \/>\n       chances of vacancies occurring in other categories in future.<br \/>\n       Candidates belonging to other categories are also advised to<br \/>\n       apply.&#8221; This makes it clear that vacancies once published are<br \/>\n       subject to change.&#8221;<\/p><\/blockquote>\n<p id=\"p_3\">     Aggrieved Ms. Asha Rani moved a first appeal before Shri S. K. Sharma,<br \/>\nAddl. Secretary, Lok Sabha Sectt. pleading that, &#8220;The applicant felt that<br \/>\ninformation provided to me is false, concealing factual position and arbitrary and<br \/>\ndoes not reflect the correct information sought by me.          The undersigned<br \/>\npreferred an appeal to the First Appellate Authority under <a href=\"\/doc\/593162\/\" id=\"a_3\">Section 19<\/a> of the RTI<br \/>\nAct, 2005.&#8221; Upon this Shri S. K. Sharma in his order dated 5.12.07 dismissed the<br \/>\nappeal as follows:\n<\/p>\n<blockquote id=\"blockquote_7\"><p>       &#8220;I find that the information that is permissible under the provisions<br \/>\n       of the <a href=\"\/doc\/671631\/\" id=\"a_4\">RTI Act<\/a>, 2005 and held by the Secretariat has already been<br \/>\n       conveyed to you vide this Secretariat&#8217;s letter of even number dated<br \/>\n       8th Nov, 2007. I find no merit as such in your appeal.&#8221;<\/p><\/blockquote>\n<p id=\"p_4\">     This has brought Ms. Asha Rani to her second appeal before us pleading<br \/>\nas follows:\n<\/p>\n<blockquote id=\"blockquote_8\"><p>       &#8220;To direct the CPIO to provide copies of documents mentioned in<br \/>\n       my application dated 15.10.07 and to pass any order as may be<br \/>\n       deemed fit by the Hon&#8217;ble Commission.&#8221;\n<\/p><\/blockquote>\n<p id=\"p_5\">The appeal was heard on 21.4.2009. The following are present:\n<\/p>\n<blockquote id=\"blockquote_9\"><p>       Appellant<br \/>\n       Ms. Asha Rani.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_10\"><p>       Shri Ramniwas.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_11\"><p>       Respondents<br \/>\n            Shri Pawan Kumar, Deputy Secretary.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_12\"><p>            Shri Y. M. Kandpal, Deputy Secretary.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_13\"><p>            Shri Harish Chander, Deputy Secretary-II.<\/p><\/blockquote>\n<p><span class=\"hidden_text\" id=\"span_1\">                                        2<\/span><\/p>\n<p id=\"p_6\">      Shri Pawan Kumar, Dy. Secretary submitted that on receiving the hearing<br \/>\nnotice the Lok Sabha Secretariat reconsidered their earlier decision and have<br \/>\nprovided the information sought to Ms. Asha Rani. Ms. Asha Rani on the other<br \/>\nhand submitted that she has not received a copy, which was then handed over to<br \/>\nher in the hearing. Shri Pawan Kumar also submitted that the disclosure of the<br \/>\nnames of members of the Panel, which are held in confidence by the Lok Sabha<br \/>\nSecretariat, will amount to breach of the fiduciary relationship, hence the plea of<br \/>\nexemption under sec. 8(1) sub sec. (e).\n<\/p>\n<p id=\"p_7\">                                DECISION NOTICE<\/p>\n<p>     No grounds for exemption have been cited in refusing information on points<br \/>\n1 to 4 to appellant Ms. Asha Rani. Admittedly, the Lok Sabha Sectt. have had<br \/>\nsecond thoughts on this issue and have now provided information sought in point<br \/>\nNo. 1. However, no such response has been made with regard to questions 2, 3<br \/>\n&amp; 4 except the citation of sec. 8(1)(e) which has only limited application, since the<br \/>\nquestion asked goes beyond seeking only the identity of panel members.<br \/>\nAppellant also agreed that she was not insistent on knowing the names of the<br \/>\nPanel Members but wished to be satisfied that the mark-sheet was authentic by<br \/>\nperusing the photocopies sought.\n<\/p>\n<p id=\"p_8\">     Under sec. 2(j) the &#8216;Right to Information&#8217; gives every citizen the right to<br \/>\naccess all information &#8220;which is held by or under the control of any public<br \/>\nauthority&#8221;. Under the circumstances, CPIO Lok Sabha Sectt will provide all such<br \/>\ninformation that has been sought by appellant Ms. Asha Rani to her. within ten<br \/>\nworking days of the date of receipt of this Decision Notice, except such<br \/>\ninformation which will disclose the identities of the Members of the Panel. This<br \/>\nwill be done with application of the severability clause, as mandated in sec. 10<br \/>\nsub-sec. (1), excluding the names from the photocopy provided. The appeal is<br \/>\nthus allowed. There will be no costs.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">                                          3<\/span><\/p>\n<p id=\"p_9\">       Announced in the hearing.
