Justice M.SASIDHARAN NAMBIAR\n\n Dated :25\/08\/2009\n\n O R D E R\n               M.Sasidharan Nambiar, J.\n              --------------------------\n                Crl.M.C.No.2584 of 2009\n              --------------------------\n\n                         ORDER\n<\/pre>\n<p id=\"p_1\">    Petitioners are the accused and second respondent<\/p>\n<p>the  defacto  complainant   in  Crime  No.584\/2009   of<\/p>\n<p>Cherthala Police Station, registered for the offences<\/p>\n<p>under Sections 283, 294(b), 308 and 323 read with<\/p>\n<p><a href=\"\/doc\/37788\/\" id=\"a_1\">Section 34<\/a> of Indian Penal Code. This petition is field<\/p>\n<p>under <a href=\"\/doc\/1679850\/\" id=\"a_1\">Section 482<\/a> of Code of Criminal Procedure to<\/p>\n<p>quash  Annexure-A  FIR  and  the   further  proceedings<\/p>\n<p>contending  that   the   disputes   with   the   second<\/p>\n<p>respondent\/defacto complainant and the injured were<\/p>\n<p>amicably settled and in such circumstances, it is not<\/p>\n<p>in the interest of justice to continue the prosecution.<\/p>\n<p id=\"p_1\">    2. Second respondent appeared through a counsel<\/p>\n<p>and  filed  an  affidavit  stating  that  there  was  a<\/p>\n<p>complete  settlement  of  all  the  disputes  with  the<\/p>\n<p>petitioners and he does not intend to proceed with the<\/p>\n<p>case further and in such circumstances, he has no<\/p>\n<p>objection for quashing the case.\n<\/p>\n<p id=\"p_2\"><span class=\"hidden_text\" id=\"span_1\">CRMC 2584\/09               2<\/span><\/p>\n<p id=\"p_3\">     3. Learned counsel appearing for the petitioners,<\/p>\n<p>second respondent and learned Public prosecutor were<\/p>\n<p>heard.\n<\/p>\n<p id=\"p_4\">     4. Though offence under <a href=\"\/doc\/4266\/\" id=\"a_2\">Section 308<\/a> of Indian<\/p>\n<p>Penal Code is also alleged in Annexure-A FIR as in the<\/p>\n<p>First Information Statement and the body note prepared<\/p>\n<p>by the Sub Inspector, which form part of Annexure-A<\/p>\n<p>FIR, would reveal that there was only simple hurt on<\/p>\n<p>the upper lip apart from contusion on the side of the<\/p>\n<p>left eye. Learned Public prosecutor also submitted that<\/p>\n<p>no grievous hurt was caused to the second respondent.<\/p>\n<p>In such circumstances, when the disputes between the<\/p>\n<p>petitioners   and  second   respondent  were   amicably<\/p>\n<p>settled, it is not in the interest of justice to<\/p>\n<p>proceed with the case further.\n<\/p>\n<p id=\"p_5\">     Petition is allowed.
