Respondents\n\n\n\n\n                          JUDGMENT\n<\/pre>\n<p id=\"p_1\">Dalveer Bhandari, J.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">1.   Leave granted.\n<\/p>\n<p id=\"p_3\">\n<p id=\"p_4\">2.   This appeal arises from the judgment dated September<\/p>\n<p>16, 2002 delivered by the High Court of Punjab and Haryana<\/p>\n<p>at Chandigarh in RSA No.556\/2001.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                                             2<\/span><\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">3.   Brief facts which are necessary to dispose of this appeal<\/p>\n<p>are recapitulated as under:-\n<\/p>\n<p id=\"p_7\">\n<p id=\"p_8\">4.   The respondent was appointed on probation for a period<\/p>\n<p>of three years in the Punjab Police in 1989. In July, 1992, he<\/p>\n<p>was sent to Barnala, Punjab to attend a departmental enquiry.<\/p>\n<p>The Deputy Superintendent of Police, Barnala relieved the<\/p>\n<p>respondent on 1.8.1992 with the direction to report at his<\/p>\n<p>place of posting, but the respondent did not report at his place<\/p>\n<p>of posting, therefore, he was marked absent from 1.8.1992 to<\/p>\n<p>19.9.1992. The respondent joined the duty on 20.9.1992 after<\/p>\n<p>one month and two days and again remained absent from<\/p>\n<p>7.10.1992. The respondent remained absent for a long period<\/p>\n<p>without any permission from the senior officers which is a<\/p>\n<p>serious act of misconduct according to the police discipline<\/p>\n<p>rules. In these circumstances, the respondent was dismissed<\/p>\n<p>from service w.e.f. 1.11.1992 under rule 12.21 of the Punjab<\/p>\n<p>Police Rules, 1934.\n<\/p>\n<p id=\"p_9\">\n<p id=\"p_10\">5.   Rule 12.21 reads as under:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>     &#8220;A Constable who is found unlikely to prove an<br \/>\n     efficient police officer may be discharged by the<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                                             3<\/span><\/p>\n<p>     Superintendent at any time within three years of<br \/>\n     enrolment. There shall be no appeal against an<br \/>\n     order of discharge under this Rule.&#8221;\n<\/p><\/blockquote>\n<p id=\"p_11\">6.   The said order of dismissal was challenged by the<\/p>\n<p>respondent by filing a civil suit for declaration that the order<\/p>\n<p>of dismissal is illegal, ultra vires, unconstitutional, null and<\/p>\n<p>void and against the principle of natural justice. The suit of<\/p>\n<p>the plaintiff \/respondent was decreed.\n<\/p>\n<p id=\"p_12\">\n<p id=\"p_13\">7.   The State of Punjab aggrieved by the said judgment and<\/p>\n<p>decree preferred an appeal.       The said appeal was also<\/p>\n<p>dismissed.    According to the appellants, the appeal was<\/p>\n<p>dismissed without considering the Punjab Police Rule 12.21.<\/p>\n<p>Under the said rule, an employee of disciplined forces can be<\/p>\n<p>removed from services any time within three years of the<\/p>\n<p>enrolment. The Appellate Court held that an opportunity has<\/p>\n<p>to be afforded to the delinquent official because the dismissal<\/p>\n<p>from the service carries a serious stigma.<\/p>\n<p id=\"p_14\">8.   The State of Punjab preferred a regular second appeal<\/p>\n<p>contending that the question of absence from duty without<\/p>\n<p>prior permission of the Senior Officer is an act of grave<\/p>\n<p>misconduct.   The Punjab Police Rules, 1934 permit that an<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                                                             4<\/span><\/p>\n<p>inefficient constable may be discharged by the Superintendent<\/p>\n<p>of Police at any time within three years of the enrolment. The<\/p>\n<p>High Court of Punjab and Haryana dismissed the regular<\/p>\n<p>second appeal on the ground that the impugned order of<\/p>\n<p>discharge was stigmatic and respondent was not given a fair<\/p>\n<p>opportunity and secondly absence from duty could not be<\/p>\n<p>viewed as culpable as in the same order the Senior<\/p>\n<p>Superintendent of Police, (for short `SSP&#8217;), Barnala has<\/p>\n<p>condoned respondent&#8217;s absence from the duty. The State of<\/p>\n<p>Punjab aggrieved by the judgment of the High Court has<\/p>\n<p>preferred the present appeal by special leave under <a href=\"\/doc\/427855\/\" id=\"a_1\">Article 136<\/a><\/p>\n<p>of the Constitution.\n<\/p>\n<p id=\"p_15\">\n<p id=\"p_16\">9.   The learned counsel appearing for the State of Punjab<\/p>\n<p>submitted that the controversy involved in this case is no<\/p>\n<p>longer res integra. He placed reliance on a three-Judge bench<\/p>\n<p>decision of this court in <a href=\"\/doc\/876874\/\" id=\"a_1\">State of Punjab &amp; Others v.<\/p>\n<p>Sukhwinder Singh<\/a> (2005) 5 SCC 569.        The facts of this case<\/p>\n<p>are almost similar to the facts of the case in hand. In the said<\/p>\n<p>case, the respondent was appointed as a police constable.<\/p>\n<p>Before completion of the probation period of three years, he<br \/>\n<span class=\"hidden_text\" id=\"span_3\">                                                            5<\/span><\/p>\n<p>absented from duty without seeking permission for 22 days.<\/p>\n<p>The SSP discharged him from service with immediate effect by<\/p>\n<p>invoking rule 12.21 of the Punjab Police Rules, 1934.      The<\/p>\n<p>respondent challenged the order of discharge before the civil<\/p>\n<p>court. The civil court held that order is null and void and the<\/p>\n<p>appellate court also upheld that decision.    The High Court<\/p>\n<p>dismissed the second appeal and held that absence from duty<\/p>\n<p>was a misconduct and imposition of the punishment of<\/p>\n<p>discharge on the respondent without holding a formal inquiry<\/p>\n<p>as envisaged under Rule 16.24 (ix) of the Rules vitiated the<\/p>\n<p>order of discharge. The State of Punjab aggrieved by the order<\/p>\n<p>of the High Court filed an appeal by special leave before this<\/p>\n<p>court.\n<\/p>\n<p id=\"p_17\">\n<p id=\"p_18\">10.   The State of Punjab contended before this court that the<\/p>\n<p>respondent was only a probationer in terms of the Rules. That<\/p>\n<p>the impugned order of discharge was neither stigmatic nor did<\/p>\n<p>it affect him with any evil consequences. The impugned order<\/p>\n<p>was passed in exercise of the power conferred by the Rules.<\/p>\n<p>That since no disciplinary action had been taken against the<br \/>\n<span class=\"hidden_text\" id=\"span_4\">                                                             6<\/span><\/p>\n<p>respondent there was no necessity of holding any formal<\/p>\n<p>enquiry.\n<\/p>\n<p id=\"p_19\">\n<p id=\"p_20\">11.   On the other hand, the respondent submitted that the<\/p>\n<p>impugned order of discharge, although apparently innocuous,<\/p>\n<p>had in fact been passed on the ground of misconduct viz. the<\/p>\n<p>continued absence from duty and therefore amounted to an<\/p>\n<p>order of dismissal. That, therefore, it was obligatory upon the<\/p>\n<p>appointing authority to have held a formal departmental<\/p>\n<p>enquiry. This court held as under:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>      &#8220;20. In the present case neither any formal<br \/>\n      departmental inquiry nor any preliminary fact-<br \/>\n      finding inquiry had been held and a simple order of<br \/>\n      discharge had been passed. The High Court has<br \/>\n      built an edifice on the basis of a statement made in<br \/>\n      the written statement that the respondent was a<br \/>\n      habitual absentee during his short period of service<br \/>\n      and has concluded therefrom that it was his<br \/>\n      absence from duty that weighed in the mind of the<br \/>\n      Senior Superintendent of Police as absence from<br \/>\n      duty is a misconduct. The High Court has further<br \/>\n      gone on to hold that there is direct nexus between<br \/>\n      the order of discharge of the respondent from<br \/>\n      service and his absence from duty and, therefore,<br \/>\n      the order discharging him from service will be<br \/>\n      viewed as punitive in nature calling for a regular<br \/>\n      inquiry under Rule 16.24 of the Rules. We are of the<br \/>\n      opinion that the High Court has gone completely<br \/>\n      wrong in drawing the inference that the order of<br \/>\n      discharge dated 16-3-1990 was, in fact, based upon<br \/>\n      misconduct and was, therefore, punitive in nature,<br \/>\n      which should have been preceded by a regular<br \/>\n      departmental inquiry. There cannot be any doubt<br \/>\n      that the respondent was on probation having been<br \/>\n      appointed about eight months back. As observed in<br \/>\n      <a href=\"\/doc\/879806\/\" id=\"a_2\">Ajit Singh v. State of Punjab<\/a> (1983) 2 SCC 217 the<br \/>\n      period of probation gives time and opportunity to<br \/>\n<span class=\"hidden_text\" id=\"span_5\">                                                              7<\/span><\/p>\n<p>      the employer to watch the work, ability, efficiency,<br \/>\n      sincerity and competence of the servant and if he is<br \/>\n      found not suitable for the post, the master reserves<br \/>\n      a right to dispense with his service without<br \/>\n      anything more during or at the end of the<br \/>\n      prescribed period, which is styled as period of<br \/>\n      probation. The mere holding of preliminary inquiry<br \/>\n      where explanation is called from an employee would<br \/>\n      not make an otherwise innocuous order of<br \/>\n      discharge or termination of service punitive in<br \/>\n      nature. Therefore, the High Court was clearly in<br \/>\n      error in holding that the respondent&#8217;s absence from<br \/>\n      duty was the foundation of the order, which<br \/>\n      necessitated an inquiry as envisaged under Rule<br \/>\n      16.24(ix) of the Rules.&#8221;\n<\/p><\/blockquote>\n<p id=\"p_21\">This court set aside the impugned judgment of the High<\/p>\n<p>Court. The ratio of this case is fully applicable to the facts of<\/p>\n<p>the case in hand. In the aforesaid case, the court dealt with<\/p>\n<p>the case of police constable who was dismissed from the<\/p>\n<p>service without holding the enquiry and by invoking Rule<\/p>\n<p>12.21 of the Punjab Police Rules, 1934 and the charge was<\/p>\n<p>absence of 22 days from the duty.\n<\/p>\n<p id=\"p_22\">\n<p id=\"p_23\">12.   In this case, the respondent was also a probationer<\/p>\n<p>police constable.   He was also discharged from the service<\/p>\n<p>because he remained absent from 1.8.1992 to 19.9.1992. He<\/p>\n<p>joined duty on 20.9.1992 after total absence of a period of one<\/p>\n<p>month and two days and again he remained absence since<\/p>\n<p>7.10.1992.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_6\">                                                             8<\/span><\/p>\n<p id=\"p_24\">\n<p id=\"p_25\">13.   We have heard learned counsel for the parties. We are in<\/p>\n<p>total agreement with the submission of the learned counsel for<\/p>\n<p>the State of Punjab that the controversy involved in this case<\/p>\n<p>is no longer res integra.   Learned counsel appearing for the<\/p>\n<p>respondent had drawn our attention to a two-Judge bench<\/p>\n<p>decision of this court in <a href=\"\/doc\/1444221\/\" id=\"a_3\">Prithipal Singh v. State of Punjab<\/p>\n<p>&amp; Others<\/a> (2002) 10 SCC 133. The court held that once there<\/p>\n<p>is stigma, the principle is well settled, an opportunity has to<\/p>\n<p>be given before passing any order.    Even where an order of<\/p>\n<p>discharge looks innocuous, but on a close scrutiny, by looking<\/p>\n<p>behind the curtain if any material exists of misconduct and<\/p>\n<p>which is the foundation of passing of the order of discharge, or<\/p>\n<p>such could be reasonably inferred, then it leaves no room for<\/p>\n<p>doubt that any consequential order, even of discharge, would<\/p>\n<p>be construed as stigmatic.      The decision in Sukhwinder<\/p>\n<p>Singh (supra) was given by a three-Judge bench and in view<\/p>\n<p>of that decision in 2005, there is no scope for this court to<\/p>\n<p>take a different view.   We are squarely bound by the said<\/p>\n<p>decision.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_7\">                                                                      9<\/span><\/p>\n<p id=\"p_26\">\n<p id=\"p_27\">14.
