OPPOSITE PARTIES\n                                                -----------\n<\/pre>\n<p id=\"p_1\">7.      20.6.2011                The petitioner seeks quashing of the order dated<\/p>\n<p>                        22.2.2008 passed in Complaint case No.123(C) of 2008,<\/p>\n<p>                        by which cognizance has been taken by the Presiding<\/p>\n<p>                        Officer, Special Court of Economic Offences, Patna<\/p>\n<p>                        u\/s.220(3) of the <a href=\"\/doc\/1353758\/\" id=\"a_1\">Companies Act<\/a>, 1956.<\/p>\n<p id=\"p_1\">                                 The petitioner asserts that he had sent his<\/p>\n<p>                        resignation much before the present occurrence and,<\/p>\n<p>                        therefore, he should not be prosecuted.<\/p>\n<p id=\"p_2\">                                 On the other hand, a counter affidavit has been<\/p>\n<p>                        filed disputing this contention.\n<\/p>\n<p id=\"p_3\">                                 Thus, the fact on which the argument is based is<\/p>\n<p>                        disputed and it cannot be put to strict proof in this forum.<\/p>\n<p>                        Hence I am not inclined to interfere in the matter.
