Justice K.T.SANKARAN\n\n Dated :07\/07\/2009\n\n O R D E R\n                             K.T.SANKARAN, J.\n                ------------------------------------------------------\n                         B.A. NO. 2801 OF 2009 E\n                ------------------------------------------------------\n                       Dated this the 7th July, 2009\n\n\n                                  O R D E R\n<\/pre>\n<p id=\"p_1\">       This is an application for anticipatory bail under <a href=\"\/doc\/1783708\/\" id=\"a_1\">Section 438<\/a> of the<\/p>\n<p>Code of Criminal Procedure. The petitioners are accused Nos.3, 8 and<\/p>\n<p>12 in Crime No.1245 of 2008 of Kundara Police Station.<\/p>\n<p id=\"p_1\">       2. The offences alleged against the petitioners are under <a href=\"\/doc\/872363\/\" id=\"a_1\">Sections<\/p>\n<p>143<\/a>, <a href=\"\/doc\/1154131\/\" id=\"a_2\">147<\/a>, <a href=\"\/doc\/791362\/\" id=\"a_3\">148<\/a>, <a href=\"\/doc\/661069\/\" id=\"a_4\">341<\/a>, <a href=\"\/doc\/1086076\/\" id=\"a_5\">294<\/a> (b), 332, 353 and 308 read with <a href=\"\/doc\/999134\/\" id=\"a_6\">Section 149<\/a> of<\/p>\n<p>the Indian Penal Code and <a href=\"\/doc\/132214932\/\" id=\"a_7\">Section 3(1)<\/a> of the Prevention of Damage to<\/p>\n<p>Public Property Act, 1984.\n<\/p>\n<p id=\"p_2\">\n<p id=\"p_3\">       3. Accused No.7 was granted anticipatory bail by this court as per<\/p>\n<p>the order in B.A.No.706 of 2009. Accused Nos.1 and 2 were granted<\/p>\n<p>anticipatory bail by the learned Sessions Judge, Kollam in Crl.M.P.No.568<\/p>\n<p>of 2009.\n<\/p>\n<p id=\"p_4\">\n<p id=\"p_5\">       4. Taking into account the facts and circumstances of the case,<\/p>\n<p>the nature of the offence, the injury sustained and other circumstances, I<\/p>\n<p>am of the view that anticipatory bail can be granted to the petitioners.<\/p>\n<p>There will be a direction that in the event of the arrest of the petitioners,<\/p>\n<p>B.A. NO. 2801 OF 2009<\/p>\n<p>                                          :: 2 ::\n<\/p>\n<p id=\"p_6\">the officer in charge of the police station shall release them on bail for a<\/p>\n<p>period of one month on their executing bond for Rs.25,000\/- each with<\/p>\n<p>two solvent sureties for the like amount to the satisfaction of the officer<\/p>\n<p>concerned, subject to the following conditions:<\/p>\n<blockquote id=\"blockquote_1\"><p>       a)     The petitioners shall report before the investigating officer<br \/>\n              between 9 A.M. and 11 A.M. on all Mondays, till the final<br \/>\n              report is filed or until further orders;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>       b)     The petitioners shall appear before the investigating officer<br \/>\n              for interrogation as and when required;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>       c)     The petitioners shall not try to influence the prosecution<br \/>\n              witnesses or tamper with the evidence;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>       d)     The petitioners shall not commit any offence or indulge in<br \/>\n              any prejudicial activity while on bail;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>       e)     On the expiry of the period mentioned above or even before<br \/>\n              that period, the petitioners shall surrender before the<br \/>\n              Magistrate concerned and seek regular bail;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_5\"><p>       f)     In case of breach of any of the conditions mentioned above,<br \/>\n              the bail shall be liable to be cancelled.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_6\"><p>       The Bail Application is allowed to the extent indicated above.<\/p><\/blockquote>\n<p id=\"p_7\">\n<p id=\"p_8\">                                                        (K.T.SANKARAN)<br \/>\n                                                               Judge<\/p>\n<p>ahz\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Sajkumar vs State Of Kerala Rep.
