Justice S.S.SATHEESACHANDRAN\n\n Dated :29\/11\/2010\n\n O R D E R\n                 S.S.SATHEESACHANDRAN, J\n                 --------------------------------------\n                   R.P No.1053 OF 2010 IN\n                     C.R.P No.889 OF 2007\n                    --------------------------------\n          Dated this the 30th day of November 2010\n\n                               ORDER\n<\/pre>\n<p id=\"p_1\">      Review petition has been filed by the State\/revision<\/p>\n<p>petitioner urging that a clarification is necessary in the order<\/p>\n<p>passed by this court disposing the revision.            The learned<\/p>\n<p>Government Pleader inviting my attention to paragraph 51 of<\/p>\n<p><a href=\"\/doc\/1736128\/\" id=\"a_1\">Gurpreet Singh v. Union of India<\/a> (2008(1) KLJ SC 463),<\/p>\n<p>which has been referred to in the order disposing the revision with<\/p>\n<p>direction to the execution court to follow the principles laid<\/p>\n<p>thereunder in fixing the amount due to the decree holder, has<\/p>\n<p>urged that when a part deposit is made towards the decree debt<\/p>\n<p>by the judgment debtor State and that amount had been received<\/p>\n<p>without objection by the decree holder, it cannot be reopened<\/p>\n<p>subsequently raising objections to the mode of appropriation.<\/p>\n<p id=\"p_1\">      2. I heard the Government Pleader and also the learned<\/p>\n<p>counsel for the respondent\/decree holder. After going through<\/p>\n<p>para 51 of the judgment in Gurpreet Singh&#8217;s case, it is seen that it<\/p>\n<p>is not the deposit of the amount, but, depositing of the sum<\/p>\n<p>specifying the appropriation under various heads and its<\/p>\n<p>acceptance by the other side without objection, that would<\/p>\n<p>R.P No.1053 OF 2010 IN<br \/>\n<span class=\"hidden_text\" id=\"span_1\">C.R.P No.889 OF 2007            &#8211; 2 &#8211;<\/span><\/p>\n<p>preclude a further enquiry over the matter. Be that as it may a<\/p>\n<p>specific direction has been given while disposing the revision that<\/p>\n<p>the principles laid down in Gurpreet Singh&#8217;s case have to be<\/p>\n<p>followed in calculating and fixing what is the amount due under<\/p>\n<p>the decree from the judgment debtor to the decree holder. That<\/p>\n<p>being so, I find, whatever grounds available to the State with<\/p>\n<p>respect to the deposits already made can be canvassed by them<\/p>\n<p>with reference to the above decision, and its sustainability, no<\/p>\n<p>doubt, has to be examined by the execution court. No further<\/p>\n<p>clarification is warranted.
