Justice V.GIRI\n\n Dated :10\/02\/2009\n\n O R D E R\n                       V.GIRI, J\n                     -------------------\n                   Crl.R.P.502\/2001\n                     --------------------\n      Dated this the 10th day of February, 2009\n\n                        ORDER\n<\/pre>\n<p id=\"p_1\">      The accused in C.C.No.176\/90 on the files of the<\/p>\n<p>Chief Judicial Magistrate Court, Ernakulam, who was<\/p>\n<p>prosecuted for an offence punishable under <a href=\"\/doc\/1823824\/\" id=\"a_1\">Section<\/p>\n<p>138<\/a> of the Negotiable Instruments Act,             is the<\/p>\n<p>petitioner in this Revision petition. The accused had a<\/p>\n<p>credit card facility in the       Vijaya Bank, M.G.Road,<\/p>\n<p>Ernakulam,      and he was running a proprietary<\/p>\n<p>concern under the name `Lords&#8217;. As per the credit<\/p>\n<p>card scheme, the accused purchased materials         and<\/p>\n<p>obtained service from establishments.           Thus, by<\/p>\n<p>19.10.1989,       Rs.3,64,453.87         was due  to  the<\/p>\n<p>complainant. When the amount was demanded, the<\/p>\n<p>accused issued Ext.P2 cheque dated 28.2.1990 for an<\/p>\n<p>amount of Rs.20,000\/-          towards      part payment.<\/p>\n<p>Cheque was dishonoured, on presentation. A notice<\/p>\n<p>demanding re-payment was issued. There was no re-<\/p>\n<p>payment and hence the complaint.\n<\/p>\n<p id=\"p_1\">Crl.R.P.502\/2001<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                              2<\/span><\/p>\n<p id=\"p_2\">2.    That the cheque, on presentation, was dishonoured<\/p>\n<p>due to insufficiency of funds in the account, was proved<\/p>\n<p>by the testimony of PWs1 and 2 as also the documentary<\/p>\n<p>evidence adduced on behalf of the complainant by<\/p>\n<p>Exts.P1 to P6.\n<\/p>\n<p id=\"p_3\">\n<p id=\"p_4\">3.    Curious contention was taken up on behalf of the<\/p>\n<p>accused that the cheque was           not presented for<\/p>\n<p>collection before the Bank and therefore, the offence,<\/p>\n<p>has not been made out. This was rejected by the trial<\/p>\n<p>Court, accepting the case of the complainant that the<\/p>\n<p>account in question maintained by the accused under<\/p>\n<p>the name of `Lords&#8217; was a current account and the<\/p>\n<p>endorsement normally found on the reverse of the<\/p>\n<p>cheque when it is negotiated through an SB account,<\/p>\n<p>would not be found in the cheque in question. But it was<\/p>\n<p>clearly proved that the cheque       was presented   for<\/p>\n<p>collection      and that the account did not have funds.<\/p>\n<p>Therefore, the cheque could not be negotiated. No<\/p>\n<p>reply was also given by the accused to the statutory<\/p>\n<p>Crl.R.P.502\/2001<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                             3<\/span><\/p>\n<p>notice sent to him. The ingredients for completion of<\/p>\n<p>the offence under <a href=\"\/doc\/1823824\/\" id=\"a_1\">Section 138<\/a> of the Act were therefore,<\/p>\n<p>completely proved by the complainant.<\/p>\n<p id=\"p_5\">4.    It has come out that there were three other cases,<\/p>\n<p>for which the accused was prosecuted for an offence<\/p>\n<p>under <a href=\"\/doc\/1823824\/\" id=\"a_2\">Section 138<\/a> of the Act and the conviction and<\/p>\n<p>sentence in all those cases have been affirmed by the<\/p>\n<p>appellate Court and by this Court.     The judgment in<\/p>\n<p>Crl.R.P.503\/2001 dated 9.12.2008 was made available<\/p>\n<p>before me        for perusal by the counsel for the<\/p>\n<p>complainant.     He further submits that the accused<\/p>\n<p>seems to be absconding. This seems to be plausible<\/p>\n<p>because a reading of the order dated 9.12.2008         in<\/p>\n<p>Cr.R.P.No.503\/2001 shows       that the counsel      was<\/p>\n<p>constrained to note my instructions when the case was<\/p>\n<p>called.\n<\/p>\n<p id=\"p_6\">\n<p id=\"p_7\">5.    I have gone through the evidence adduced in the<\/p>\n<p>case and the records as well. Ingredients for the offence<\/p>\n<p>Crl.R.P.502\/2001<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                              4<\/span><\/p>\n<p>punishable under <a href=\"\/doc\/1823824\/\" id=\"a_3\">Section 138<\/a> of the Act have been<\/p>\n<p>completely proved.       In these circumstances,      the<\/p>\n<p>conviction and sentence of the accused does not suffer<\/p>\n<p>from any infirmity.     I do not    find any grounds to<\/p>\n<p>interfere with the conviction.\n<\/p>\n<p id=\"p_8\">\n<p id=\"p_9\">6.    But as regards the sentence, I prefer to follow the<\/p>\n<p>modification effected by this Court in Crl.R.P.503\/2001<\/p>\n<p>whereby the substantive sentence of imprisonment for a<\/p>\n<p>period of three months was modified as till the rising of<\/p>\n<p>the Court with a further direction to pay a compensation<\/p>\n<p>to the tune of Rs.25,000\/-.     I find  that the cheque<\/p>\n<p>amount involved in the said case is also Rs.25,000\/-.<\/p>\n<p id=\"p_10\">7.    Accordingly, Criminal Revision Petition is allowed<\/p>\n<p>in part. The conviction of the accused under <a href=\"\/doc\/1823824\/\" id=\"a_4\">Section<\/p>\n<p>138<\/a> of      the Negotiable Instruments Act is affirmed.<\/p>\n<p>Substantive sentence awarded to the petitioner          is<\/p>\n<p>modified to simple imprisonment till the rising of the<\/p>\n<p>Court.     Accused is directed to deposit before the trial<\/p>\n<p>Crl.R.P.502\/2001<br \/>\n<span class=\"hidden_text\" id=\"span_3\">                          5<\/span><\/p>\n<p>Court an amount of Rs.25,000\/- as compensation within<\/p>\n<p>two months from today.
