No.3183 of 2011\n                                        SONU KUMAR\n                                             Versus\n                                   THE STATE OF BIHAR\n                                           -----------\n<\/pre>\n<p id=\"p_1\">02\/   25.01.2011          Heard learned counsel for the petitioner as well as learned<\/p>\n<p>                   P.P. for the State.\n<\/p>\n<p id=\"p_1\">                              Office has reported that bail rejection order on merit is<\/p>\n<p>                   wanting.\n<\/p>\n<p id=\"p_2\">                              It would appear from perusal of the record that petitioner<\/p>\n<p>                   has been made accused in Lakhisarai P.S. Case no.298\/2009\/ GR no.<\/p>\n<p>                   655\/2009 for the offences under <a href=\"\/doc\/329571\/\" id=\"a_1\">sections 392<\/a> and <a href=\"\/doc\/812083\/\" id=\"a_1\">411<\/a> of the IPC. It<\/p>\n<p>                   would further appear that the petitioner claimed himself juvenile<\/p>\n<p>                   before the learned CJM, Lakhisarai who sent the case record of the<\/p>\n<p>                   petitioner to the court of Juvenile Justice Board, Lakhisarai where an<\/p>\n<p>                   enquiry in respect of juvenility of the petitioner is still pending. In the<\/p>\n<p>                   meantime, petitioner filed a bail petition before the Juvenile Justice<\/p>\n<p>                   court, Lakhisarai who rejected prayer for bail of the petitioner on<\/p>\n<p>                   merit. Subsequently, petitioner filed bail petition no. 682 L\/2010<\/p>\n<p>                   which was dismissed by the learned Addl. Sessions Judge, Lakhisarai<\/p>\n<p>                   holding that above stated bail application is not maintainable and<\/p>\n<p>                   petitioner ought to have filed appeal under the provision of Juvenile<\/p>\n<p>                   Justice Act and after the aforesaid order, petitioner has filed this<\/p>\n<p>                   criminal miscellaneous case before this court.<\/p>\n<p id=\"p_3\">                              In my view, bail prayer of the petitioner has not been<\/p>\n<p>                   considered as yet on merit by a competent court and the petitioner<\/p>\n<p>                   ought to have filed bail petition before the learned CJM, Lakhisarai<\/p>\n<p>                   and the learned CJM, Lakhisarai has got jurisdiction to dispose of the<br \/>\n          bail petition of the petitioner till his declaration of juvenile.<\/p>\n<p>         Accordingly, this criminal miscellaneous case stands dismissed being<\/p>\n<p>         not maintainable.\n<\/p>\n<p id=\"p_4\">                   However, the petitioner may file his bail petition before the<\/p>\n<p>         learned CJM, Lakhisarai who shall consider and dispose of regular<\/p>\n<p>         bail petition of the petitioner on its own merit after calling for the<\/p>\n<p>         record from the concerned court, if petitioner has not been declared<\/p>\n<p>         juvenile as yet by the competent court.\n<\/p>\n<pre id=\"pre_1\">shahid                                             (Hemant Kumar Srivastava,J)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Sonu Kumar vs The State Of Bihar on 25 January, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
