Justice S.S.SATHEESACHANDRAN\n\n Dated :25\/08\/2009\n\n O R D E R\n            S.S.SATHEESACHANDRAN, J.\n          -----------------------------\n            W.P.(C).No.28112 OF 2008\n           --------------------------\n     Dated this the 25th day of August 2009\n     -------------------------------------\n\n\n                     JUDGMENT\n<\/pre>\n<p id=\"p_1\">        The writ petition is filed seeking the<\/p>\n<p>following reliefs.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">        i)   Issue a writ of certiorari or other<\/p>\n<p>appropriate writ, order or direction calling for<\/p>\n<p>the records leading to Ext.P3 and quash the same as<\/p>\n<p>illegal.\n<\/p>\n<p id=\"p_3\">\n<p id=\"p_4\">        ii)   Grant such other reliefs which this<\/p>\n<p>Hon&#8217;ble Court deems fit and necessary in the facts<\/p>\n<p>and circumstances of the case.\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">        2.  Petitioner is the defendant in O.S No.<\/p>\n<p>25 of 2007 on the file of the Munsiff Court,<\/p>\n<p>Kanjirappally.   Suit is one for declaration of<\/p>\n<p>W.P.(C).No.28112 OF 2008     Page numbers<\/p>\n<p>plaintiff&#8217;s title over plaint schedule property<\/p>\n<p>item No.2 and also the timber items scheduled as<\/p>\n<p>item No.3 in the plaint.        Plaintiff claimed title<\/p>\n<p>over item No.2 property as having perfected title<\/p>\n<p>by adverse possession.       Some of the trees situate<\/p>\n<p>in that property were cut down by the plaintiff,<\/p>\n<p>and first defendant, the local authority resisted<\/p>\n<p>it contending that the land and timber belong to<\/p>\n<p>the panchayat.      Suit claim was resisted by filing a<\/p>\n<p>written statement.        The first defendant, local<\/p>\n<p>authority, moved two applications, one challenging<\/p>\n<p>the maintainability of the suit on the ground that<\/p>\n<p>it is not properly valued and court fee paid<\/p>\n<p>insufficient, and the other, to remove the case<\/p>\n<p>from the list.      Both applications were dismissed by<\/p>\n<p>the court below vide Ext.P3 order.        Propriety and<\/p>\n<p>correctness of Ext.P3 order is challenged in the<\/p>\n<p>writ petition invoking the supervisory jurisdiction<\/p>\n<p>vested with this court under <a href=\"\/doc\/1331149\/\" id=\"a_1\">Article 227<\/a> of the<\/p>\n<p>Constitution of India.\n<\/p>\n<p id=\"p_7\">W.P.(C).No.28112 OF 2008    Page numbers<\/p>\n<p id=\"p_8\">          3.     I heard the counsel on both sides.<\/p>\n<p>Having regard to the submissions made and taking<\/p>\n<p>note of the facts and circumstances presented, I<\/p>\n<p>find no interference with Ext.P3 order is called<\/p>\n<p>for.     Maintainability of the suit is challenged<\/p>\n<p>only on the ground that valuation made in the<\/p>\n<p>plaint    is    incorrect  and   the   court fee  paid<\/p>\n<p>inadequate.      The timber items which are scheduled<\/p>\n<p>as item No.3 in the plaint, during the pendency of<\/p>\n<p>the suit were sold in court auction and admittedly<\/p>\n<p>it fetched a higher price than the value for those<\/p>\n<p>items shown in the plaint.      That appears to be the<\/p>\n<p>reason why the petition was filed by the first<\/p>\n<p>defendant contending the suit is not maintainable<\/p>\n<p>for the reason aforesaid.     It is submitted that the<\/p>\n<p>first defendant in his written statement has not<\/p>\n<p>raised any challenge that the valuation made in the<\/p>\n<p>plaint    is    incorrect  and   the   court fee  paid<\/p>\n<p>inadequate.       Any question as to valuation and<\/p>\n<p>sufficiency of court fee has to be raised in the<\/p>\n<p>written statement.      If no such challenge is raised<\/p>\n<p>in the written statement, it is not open to the<\/p>\n<p>W.P.(C).No.28112 OF 2008     Page numbers<\/p>\n<p>defendants to canvass such a challenge at a later<\/p>\n<p>stage.    Further more, even if the timber items have<\/p>\n<p>been sold for a higher price in public auction, it<\/p>\n<p>does not postulate the valuation made in the plaint<\/p>\n<p>is not correct.        A willing purchaser may pay more<\/p>\n<p>price for the timber items          depending up on his<\/p>\n<p>need   for    those    items.   It   is  seen  that  the<\/p>\n<p>application challenging the maintainability of the<\/p>\n<p>suit on the ground that valuation made in the<\/p>\n<p>plaint as not correct and court fee paid inadequate<\/p>\n<p>was raised only after the case came up in the list<\/p>\n<p>for trial.       Dismissal of the petition so moved<\/p>\n<p>challenging the maintainability, by the learned<\/p>\n<p>Munsiff, is only proper and correct.
