Justice K.T.SANKARAN\n\n Dated :06\/12\/2006\n\n O R D E R\n<\/pre>\n<p id=\"p_1\">                             K.T.SANKARAN, J<\/p>\n<p id=\"p_1\">                      &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;<\/p>\n<p>                        Crl.R.P.No. 4211 of 2006<\/p>\n<p id=\"p_2\">                      &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;<\/p>\n<p>             Dated this the  6th day of December, 2006<\/p>\n<p>                                       O<br \/>\n                                          RDER<\/p>\n<p>      The   petitioner   was   found   guilty   for   the   offence   under<\/p>\n<p><a href=\"\/doc\/1823824\/\" id=\"a_1\">Section   138<\/a>   of   the   Negotiable   Instruments   Act   and   he   was<\/p>\n<p>sentenced to undergo simple imprisonment for  a period of  four<\/p>\n<p>months and was directed to pay a compensation of Rs.60,000\/- to<\/p>\n<p>the   complainant   and   in   default   of   payment   of   compensation   to<\/p>\n<p>undergo   simple   imprisonment   for   one   month.     The   petitioner<\/p>\n<p>challenged the conviction and sentence in appeal.  The appellate<\/p>\n<p>court   confirmed   the   conviction,   but   modified   and   reduced   the<\/p>\n<p>sentence   to   imprisonment   till   the   rising   of   the   court.     The<\/p>\n<p>direction   to   pay   compensation   was   confirmed.     However,   the<\/p>\n<p>default sentence was enhanced to three months.<\/p>\n<p id=\"p_3\">      2.     The   case   of   the   complainant   is   that   the   accused<\/p>\n<p>borrowed Rs.60,000\/- from him and Ext. P1 cheque was issued in<\/p>\n<p>discharge   of   that   debt.     On   presentation   of   the   cheque,   it   was<\/p>\n<p>dishonoured   on   the   ground   of   &#8216;insufficiency   of   funds&#8217;   in   the<\/p>\n<p>account   of   the   accused.     The   accused   conceded   that   Ext.P1<\/p>\n<p>cheque   was   written   on   a   cheque   leaf   in   respect   of   the   account<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">CRRP 4211\/2006                          2<\/span><\/p>\n<p>maintained   by   him.         The   signature   in   Ext.P1   cheque   is   also<\/p>\n<p>admitted.     A   suggestion   was  made   to   PW1   that   a   blank   signed<\/p>\n<p>cheque   was   issued   to   the   complainant,   when   the   accused<\/p>\n<p>received   some   amount   from   him.       Ext.P4   notice   was   issued   to<\/p>\n<p>the   accused.     He   received   the   notice   but   he   did   not   send   any<\/p>\n<p>reply.     No   defence   evidence   was   also   adduced   by   the   accused.<\/p>\n<p>The  trial  court  held   that the   presumption  under  <a href=\"\/doc\/268919\/\" id=\"a_1\">Section  139<\/a>  of<\/p>\n<p>the   Negotiable   Instruments   Act   is   available   in   favour   of   the<\/p>\n<p>complainant and that the accused\/petitioner has not rebutted the<\/p>\n<p>presumption.     The   appellate   court   considered   the   evidence   in<\/p>\n<p>detail and concurred with the view taken by the trial court.  The<\/p>\n<p>appellate   court,   however,   reduced   the   sentence   following   the<\/p>\n<p>decision in  Anilkumar Vs. Shammy (2002 (3) KLT 852).<\/p>\n<p id=\"p_4\">      3.     No grounds are made out for interference in revision<\/p>\n<p>under <a href=\"\/doc\/1457888\/\" id=\"a_2\">Section 397<\/a> of the Code of Criminal Procedure and there<\/p>\n<p>is   no   illegality,   irregularity   or   impropriety   in   the   judgments<\/p>\n<p>impugned.\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">      4.     The learned counsel for the petitioner submitted that<\/p>\n<p>a   reasonable   time   may   be   granted   to   the   petitioner   to   pay   the<\/p>\n<p>compensation   amount.   Taking   into   account   the   facts   and<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">CRRP 4211\/2006                           3<\/span><\/p>\n<p>circumstances of the case, I am inclined to grant three months&#8217;<\/p>\n<p>time to the petitioner to pay the compensation amount.<\/p>\n<p id=\"p_7\">       In   the   result,   this   Crl.R.P.   is   dismissed   and   the   conviction<\/p>\n<p>and   sentence   are   confirmed.     However,   three   months&#8217;   time   is<\/p>\n<p>granted   to   the   petitioner   to   pay   the   compensation   amount   of<\/p>\n<p>Rs.60,000\/-.
