Heard by consent.\n<\/p>\n<p id=\"p_1\">    2]    The petitioner has challenged the order dated 7.1.2010 passed<\/p>\n<p>    by the Education Officer, requiring the management to fill in the<\/p>\n<p>    post of Head Master on the basis of reservation.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                                  ::: Downloaded on &#8211; 09\/06\/2013 15:39:46 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                     2<\/span><\/p>\n<p id=\"p_2\">    3]    The respondent no.2 is running two schools namely Jeevan<\/p>\n<p>    Shikshan Vidyalaya, Unt Khana, Nagpur and Jeevan Shikshan<\/p>\n<p>    Vidyalaya, Parwati Nagar, Nagpur. Said schools are admitted to<\/p>\n<p>    100% grants from the state government. Each school has one<\/p>\n<p>    Headmaster. Thus the cadre of Headmaster bears only two posts.\n<\/p>\n<p id=\"p_3\">    4]    By the impugned order on 7.1.2010 the Education Officer<\/p>\n<p>    issued a letter to the management &#8211; respondent no.2 stating that the<\/p>\n<p>    petitioner is granted administrative and financial powers temporary<\/p>\n<p>    so that the management of the school is saved from financial and<\/p>\n<p>    administrative difficulties. The Education Officer has however,<\/p>\n<p>    asked the respondent no.2 to fill up the post as per reservation.\n<\/p>\n<p id=\"p_4\">    Powers of the petitioner have been restricted only for the period<\/p>\n<p>    from 1.11.2009 to 31.1.2010. Petitioner has thus challenged the<\/p>\n<p>    directions of the Education Officer.\n<\/p>\n<p id=\"p_5\">    5]    Shri Shelat, learned counsel for the petitioner has relied on<\/p>\n<p>    the judgment delivered by the Full Bench of this Court, reported in<\/p>\n<p>    2006(6) Mh.L.J. 882 [<a href=\"\/doc\/1521097\/\" id=\"a_1\">New English High School               Association,<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">                                                  ::: Downloaded on &#8211; 09\/06\/2013 15:39:46 :::<\/span><br \/>\n<span class=\"hidden_text\" id=\"span_3\">                                     3<\/span><\/p>\n<p>    Nagpur &amp; another ..vs.. Baldev<\/a> s\/o Fakira Ade], wherein this court<\/p>\n<p>    has held as under:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>             &#8220;28- The fall out of the above discussion is that in<\/p>\n<p>             case the cadre consists of three or less number of<br \/>\n             posts and the total percentage of reservation is 24%,<br \/>\n             there cannot be any reservation in such a case and it<br \/>\n             would be only in case of four posts that one of those<\/p>\n<p>             will have to be filled in by the reserved category<br \/>\n             candidate. The applicability of the reservation policy<br \/>\n             would depend upon the number of posts in a cadre<br \/>\n             and the percentage of reservation. The 50 point roster<\/p>\n<p>             can be made applicable only when the applicability<br \/>\n             thereof would not result in implementation of<\/p>\n<p>             reservation policy in excess of the percentage<br \/>\n             statutorily prescribed for the reserved category<\/p>\n<p>             candidates. &#8221;\n<\/p><\/blockquote>\n<p id=\"p_6\">    Thus the impugned letter of the Education Officer is contrary to law<\/p>\n<p>    since it calls upon the respondent &#8211; management to apply principle<\/p>\n<p>    of reservation even though the number of posts are only 2 and the<\/p>\n<p>    permissible percentage for reservation is 33%. Hence the petition<\/p>\n<p>    is allowed.
