WRIT PETITION NO.2577 OF 2010\n\nBoochi Singh @ Bachchu Singh .......Petitioner\n\n                             Versus\n\nState of U.P. &amp; others. .........Respondents.\n\n                         ------------------\n\nHon'ble Bharati Sapru, J.\n<\/pre>\n<p id=\"p_1\">Heard learned counsel for the petitioner and learned<\/p>\n<p>Standing Counsel for the State.\n<\/p>\n<p id=\"p_1\">Pleadings have been exchanged in this matter. The<\/p>\n<p>matter has been disposed of at this stage itself.<\/p>\n<p>The facts of the case are that one Shri Sher Pal Singh<\/p>\n<p>executed a Power of Attorney dated 1.8.2001 in favour<\/p>\n<p>of his elder brother, who is the petitioner in this case, of<\/p>\n<p>his \u00bcth share in the family. The Power of Attorney is on<\/p>\n<p>record. It is Annexure-1 to the writ petition.<\/p>\n<p>On a plain perusal of the Power of Attorney, it appears<br \/>\n that it is an irrecoverable Power of Attorney.<\/p>\n<p>In proceedings initiated against the petitioner, Stamp<\/p>\n<p>Deficiency was adjudged, treating the Power of Attorney<\/p>\n<p>to be an instrument under item 48 EE of Schedule-1 to<\/p>\n<p>the <a href=\"\/doc\/74910796\/\" id=\"a_1\">Stamp Act<\/a>. An ex-parte order was passed against<\/p>\n<p>the petitioner on 30.5.02 and, thereafter, the petitioner<\/p>\n<p>filed a revision, which has been dismissed.<\/p>\n<p>However, upon a plain perusal of the order dated<\/p>\n<p>23.11.09, it is clear that an obvious mistake has been<\/p>\n<p>made in calculating the stamp deficiency, which has<\/p>\n<p>been calculated for the entire holding of the four<\/p>\n<p>brothers, whereas it should have been confined to 1\/4th<\/p>\n<p>share of Sri Sher Pal Singh. This is obvious mistake in<\/p>\n<p>the order passed in the revision.\n<\/p>\n<p id=\"p_2\">The matter is, therefore, remanded to the revisional<\/p>\n<p>authority to rectify this error. He may give to the<\/p>\n<p>petitioner an opportunity of hearing before passing fresh<\/p>\n<p>orders.\n<\/p>\n<p id=\"p_3\">The matter on remand will be decided within a period of<\/p>\n<p>three months from the date a certified copy of this order<\/p>\n<p>is being placed before the authority concerned. A copy<br \/>\n of this order may be placed before the authority<\/p>\n<p>concerned within a period of three weeks from today.<\/p>\n<p>The orders dated 23.11.2009 and 30.5.2002, are,<\/p>\n<p>therefore, set aside.\n<\/p>\n<p id=\"p_4\">In case the petitioner has made any deposit of money in<\/p>\n<p>pursuance of the impugned order or in pursuance of<\/p>\n<p>any interim order of this Court, the same shall remain in<\/p>\n<p>deposit and shall be subject to fresh order being passed<\/p>\n<p>by the authority.\n<\/p>\n<p id=\"p_5\">This writ petition stands disposed of.<\/p>\n<p>Dated :11.8.10<\/p>\n<p>L.F.\/2577\/10\/30\n       <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Boochi Singh @ Bachchu Singh vs State Of U.P.
