2 ,. ‘fb._isV appeal is \ufb01led by the State challenging the order<\/p>\n
 o:f’taequV1″tta1 dated 4.3.2004 passed by the Addl. Sessions<\/p>\n
‘   Fast Court Track-II, Davanagere, in S.C.No.46\/2003<\/p>\n
acquitting Respondent Nos.1 to 5 of the offence punishable<\/p>\n
U\/s.498\u00ab~A, 302 and 201 IPC<\/a> and Sec.3 and 4 of the  Act.<\/p>\n
2. It is the case of the prosecutio11—-.’1;’nat’V.l’ {the<\/p>\n
deceased Susheelamma was married to Basavara_j’* 5 \ufb01rst._ <\/p>\n
respondent on 22.05.1998 in  apt}:-e  <\/p>\n
complainant in Kurudi Village andv\u00e9atlthe tirne’.tAof”n1arriageV,”g<\/p>\n
the respondents demandedajVd”and it  of
\nRs.25,ooo\/- and we tholas\/ouft   item CW1,
\nthereby they are alleged to  .coz__r1mitted offence
\nU\/s.8 ofthe o.p;g3\u00a2t.  it it V’ V V’<\/p>\n
  ”  against the respondent that
\nthe the husband and the respondent<\/p>\n
Nos.2_v to   t1;1eV””n1other–in\u00ab~1aW, father\u00ab~in-law and<\/p>\n
 ‘  _ brotherftin-law oitthedeceased, after the marriage they used<\/p>\n
  tofurther dowry of Rs.50,000\/– on the pretext<\/p>\n
of pgettingigowternment job to the first respondent, thereby<\/p>\n
 they arealleged to have committed offence U\/s.4 of D.P. Act.<\/p>\n
 4. It is further alleged that the respondents being<\/p>\n
it   …_the husband and relatives of the deceased subjected the<\/p>\n
\/X<\/p>\n
deceased to cruelty for bringing additional dowry of
\nRs.50,000\/~\u00bb~, thereby they are alleged to be gu:1:”y.l:’elf”a;e<\/p>\n
offence U\/s.498-A of IPC<\/a>.\n<\/p>\n
5. It is further alleged against’ <\/p>\n
that on 18.12.2002 in the night  the residjence <\/p>\n
No.562, Suez plot, Davanagere-e\ufb01lity, the’RespcondenvtV No.1 is V<\/p>\n
alleged to have squeezed  the ‘d’eoe”ased and
\ncaused her death and   ‘offence U\/s.302
\nof IPC<\/a>. It is futrttlerealleged:  No.1 that in
\norder to scree13.<__ Q\ufb01  murder, after the
\ndeath of the"'d.e'ce:a:s;ed  hanged her body to
\nthe anglerof  house with a lungi to make it
\nappear as  has committed suicide, thereby<\/p>\n
he isegjalleged toV'beHlgnilt3} of the offense punishable U\/s.201 of<\/p>\n
 l  the respondents were secured before the<\/p>\n
 Court, ..charge was framed against them. The prosecution in<\/p>\n
A ..fordei*–.lto prove its case, has examined in all 24 witnesses and<\/p>\n
  Inarked Exs.P.1 to \u00a37.15 and produced M.O.l and M02.<\/p>\n
The defence has got marked l3x.D.I being the portion.__of the<\/p>\n
statement of PW2. However, after hearing the pifoseeution<\/p>\n
and the defence, the learned Sessions Judge   <\/p>\n
acquit the respondent of all the_offencesVcharged"again-stu<\/p>\n
them. Hence. the State has come, upbefore' this <\/p>\n
appeal.\n<\/p>\n
7. PWI–Basavaraj  lofvvthevvgdeceased
\nand the complainant. has the time of
\nmarriage, the 4fi;rst_ u to get dowry.
\nUl\ufb01mately,\u20ac.tliey_ga–gfeed  ~ and 11\/2 tholas of
\ngold at thetime   said amount was given
\nprior  the  and the gold chain was
\ngiven to ‘the”_4deceas_e’d’at ‘:1:L;:}”‘;:\u00bb:vt=44;lnari’iage. It is in the evidence of<\/p>\n
PWg1_\u00a7.that after marriage his sister was not looked after<\/p>\n
 byE”th_e.r’e–spondents and all the respondents were living<\/p>\n
At”‘fog-etherv  house. Thereafter, the Respondent No.1<\/p>\n
was”-.dema1iding Rs.50,000\/– as additional dowry for the<\/p>\n
 Tp.ugrposeV\u00ab*of securing job for him and in this connection he<\/p>\n
 _ ‘was giving il1–treatment and harassment to his sister. His<\/p>\n
it   …sister lived with her husband for one year and during the<\/p>\n
said period, Respondent No.1 was not having’ any<\/p>\n
ernpioyment. His father and his family members advisediirst<\/p>\n
respondent and his family members to treat__A*’Lhe  <\/p>\n
well. There was a complaint given _tQ,.the ruralu<\/p>\n
and the inspector of the rural police station’iihas_surriifrio\ufb017ed<\/p>\n
the respondent and warned to them…  staked’  the!’<\/p>\n
deceased properly. ‘Ihereafter,___the”i}i-treatrnent was
\nnot stopped they  ‘house, so that his
\nsister and first respondentiycfotiidxliyetseparately and advance
\nfor the said  members of PW}.\n<\/p>\n
‘I’hereafter,\u20ac.they\ufb02hjaye — for the purpose of
\n Scheme to his sister<\/p>\n
and brother in law.’ :Vyhich_0Ais.riumbered as Door No.562.<\/p>\n
 PW1V._.has ‘further stated that even though the<\/p>\n
Vitdeceased:Was~..1iv”ing with Respondent No.1, the iii-treatment<\/p>\n
 He has further stated that there. is a<\/p>\n
chiid aged “about 3 years born to his sister and respondent<\/p>\n
 yVj’D~.Eoy. Itis in the evidence of PW1 that on 09.12.2002 in the<\/p>\n
 . 0′ morning at 6.00 a.rn., they came to know that his sister has<\/p>\n
  …committed suicide and thereafter, they went into the house<\/p>\n

Respondent No.1. Hence, a’:<':o_n1p1aint' was"v:'gis;'en,.VVtoi there'<\/p>\n
police. He has further stated that"'in_c;uest v.{ras.tcor1d_i?1cted and<\/p>\n
he has signed the  _  ,  V  "<\/p>\n

\nhas    PW1 in so far as
\npayment of   of-i?s.,?:5000\/– given at the time
\nof maniage  of; Rs.50000 for the purpose of
\nsecuring to R1 and also various iii-\n<\/p>\n
treatrinent and vnhiarassrnient meted out to the deceased while<\/p>\n
 living with the R1 in a separate house.<\/p>\n
 is the mother of the deceased as well as<\/p>\n
‘v._gPW1  wife of PW10. She has also corroborated the<\/p>\n
it Qfexttridierxce in so far as payment of dowry and demand of<\/p>\n
  additional dowry of Rs.50000\/– after the marriage for the<\/p>\n
purpose of securing Government job. The other witnesses<\/p>\n
examined in this case are all circumstantial in nature.<\/p>\n
11. PW4 — Dr. C.M.Pushpa has.V’_eXa.m’ined’ <\/p>\n
deceased and has issued PM repertdddabs ‘<\/p>\n
stated that the death is due to asphyicia <\/p>\n
hanging. She has further stateclythat the’re_Vis. Iigaturemmarks<\/p>\n
measuring 7″ X I1\/2″ inches on”‘the”ne’e-1: of the”d’eceased in
\nthe front side covering 3’\/V949″ oi’~–the’ nec’x*;vd’an’dw__death is due to<\/p>\n
hanging.\n<\/p>\n
12. putfsaxia’  two villagers who have
\nstated  of — dowry by A1 and aiso
\nharassrnent. 1′}:V1\u20ac’tF:_(.1A deceased by the Respondent<\/p>\n
No.1 in resfiectvvof the job and demand of dowry for<\/p>\n
 ”   ‘ ….. .. v<\/p>\n
  “is the signatory to the inquest mahazar at<\/p>\n
 ..i5W’-9;’— Siddamma has also corroborated the evidence<\/p>\n
Vdregardingdd the harassment by respondent No.1 to the<\/p>\n
 ndeecased. PW11 is a hearsay witness. PW13\u00ab~Rathnarnma is<\/p>\n
VA   atneighbour of the respondents. She has turned hostile to<\/p>\n
the prosecution case. PW14-Ambujamma has also stated<\/p>\n
that the respondent No.1 and the deceased were residing in<\/p>\n
House No.562, Suez plot, Davanagere. PWI5’jV”is”p”~Vgthe<\/p>\n
neighbour of the respondents. She has stated  ”<\/p>\n
death of the deceased in the house; of   <\/p>\n
is a Witness to Ex.P.2 and seizure\u00bbpofinhangldepiecesl <\/p>\n
has also corroborates the evidence of PW1, PW},  * it<\/p>\n
PWI8 is the Photographer who\ufb02has’=produced_”E:;s.P.11 to
\nP.14-photos of the sc\u00a2m%’or  has turned<\/p>\n
hostile to the case of the~’p1*osecution. .’<\/p>\n
the  and  to the scene of occurrence to ‘<\/p>\n

of\ufb01ci;als.eA.PW23’  CPI who has conducted part of the<\/p>\n
 this case. PW24 is another 1.0. who has<\/p>\n
subinitted’~theV.”charge sheet against the respondents.<\/p>\n
  ”  is from the evidence of these witnesses that<\/p>\n
 thc\ufb02earned Sessions Judge has found that the respondents<\/p>\n
 not guilty of the offences alleged against them.<\/p>\n

17. It is submitted by the Add}.   bthe: _& it <\/p>\n
evidence of Pwlwbrother and PW10and’P’.V1\u00ab2.–p’are’nts.Vof’Vthe7<\/p>\n
deceased would clinchingly gVestab1’i.sh”.V_that .bRAespt;~No;.”.1″~,-V’–<\/p>\n
husband of the deceased mete(‘i\u00bb.ou–ty cruveityhVand’_:i}i5treatment V<\/p>\n
to the deceased and  has”‘ta1_\u00a7en”‘p}ace’yiritliin\u00e9 7 years
\nfrom the date of the  submits that the
\nRespondent Np_.1:: is   U\/S.304—B IPC<\/a>.<\/p>\n
There is e\\r;dc’i1ce*–V.th_Vat  gWas’\u00abV_’demand for dowry soon<\/p>\n
before  Hence, he submits that
\nRespondent\u00abNo. 3. convicted for the offence as alleged
\nby the prosecution, <\/p>\n
 The u1Vea;rn–ed counsel for the respondent submits<\/p>\n
 ‘VVth’e4]pros:ecution has not proved beyond reasonable<\/p>\n
doubt  the offences charged against the<\/p>\n
 respondent.’ There is no charge U\/s.304-B of IPC<\/a> framed<\/p>\n

‘  resbondents may not be convicted for the said offence. He<\/p>\n

also submits that the doctor has opined that the death is<\/p>\n
due to asphyxia due to hanging. Therefore, the qnestion”.of<\/p>\n

submits that the order of acquittal vn71ay;’_be’tVconfinned\u00a3l’   ‘<\/p>\n
19. After giving care\ufb01,ll”‘~i,thought_  Wentire<\/p>\n
material on record, doo’u.1j.nent:s”‘anfdj4the.._evidence,”we are of
\nthe opinion that the cVlldence”o.fit1rle  parents of
\nthe deceased andgalso    deceased clearly
\nestablish   It is clearly brought
\nout frornuv   “-thesive Witnesses that the
\nand ilbtreating the deceased
\nfor ~ for securing a job. Under<\/p>\n
theseiclrcumstalices,  hold that the offence U\/s.498–A IPC<\/a><\/p>\n
    made out against the Respondent No.1 only,<\/p>\n
 No.1 was living with the deceased at the<\/p>\n
timeiof Eier-death. In so far as Sec.3 and 4 of D.P. Act is<\/p>\n
 Jconcerned; the learned Sessions Judge has found that the<\/p>\n
  is not sufficient to bring home the guilt of the<\/p>\n
it  respondent for the said offences. We do not find any<\/p>\n

compelling reasons to interfere with the order of acquittal<\/p>\n
recorded by the learned Sessions Judge for the said’ <\/p>\n
There is no charge framed for the offence U\/ <\/p>\n
this length of time, we would not like   ”<\/p>\n
evidence adduced by the prosecution  lpurp:o:s&e’eA::VoAt’<\/p>\n
finding out Whether there is an-y__ material for  o_f:7fenlce_:l: F<\/p>\n
in the interest of justice. Therefore, we  the order of
\nacquittal passed by   :Sessions Judge for the
\noffence U\/s.Sec.AV2’01 and    4 of the DP
\nAct. But we  offence U\/s498-A<\/p>\n
of IPC<\/a>.\n<\/p>\n

Respondent  lie submits that Respondent No.1 was in<\/p>\n
 Tfor\u00e9xmore than 4 years during trial and that he has<\/p>\n
 to look after. However in View of the fact<\/p>\n
that th._e’cf:l”ence U\/s.498–A live is punishable with three<\/p>\n
  years imprisonment only. We are of the opinion that<\/p>\n
it ‘Aesentence for the period already undergone by Respondent<\/p>\n
\u00ab-\n<\/p>\n

No.1 as under trial prisoner would be a sufficient sentence<\/p>\n
for the offence 15\/ s.498–A IPC<\/a>. Hence. the following
