Dabhi, learned Additional Public Prosecutor waives service<br \/>\nof notice of Rule on behalf of the respondent-State of Gujarat.\n<\/p>\n<p id=\"p_2\">2.\t\tThis<br \/>\napplication has been filed under <a href=\"\/doc\/1290514\/\" id=\"a_1\">Section 439<\/a> of the Code of Criminal<br \/>\nProcedure, 1973, for grant of bail in connection with FIR, being<br \/>\nI-C.R. No. 92 of 2008, registered at Radhanpur Police Station, for<br \/>\noffences punishable under <a href=\"\/doc\/962373\/\" id=\"a_1\">Sections 363<\/a>, <a href=\"\/doc\/1146308\/\" id=\"a_2\">366<\/a>, <a href=\"\/doc\/482448\/\" id=\"a_3\">376<\/a> and <a href=\"\/doc\/445276\/\" id=\"a_4\">506(1)<\/a>,<a href=\"\/doc\/1569253\/\" id=\"a_5\"> of the<br \/>\nIndian Penal Code<\/a>.\n<\/p>\n<p id=\"p_3\">3.\t\tThe<br \/>\nallegation contained in the FIR is that the applicant is involved in<br \/>\nthe commission of the above-mentioned offences.\n<\/p>\n<p id=\"p_4\">4.\t\tMr.\n<\/p>\n<p id=\"p_5\">P.B. Barot, learned Advocate for the applicant has submitted that the<br \/>\napplicant is innocent and he has been falsely implicated in the<br \/>\ncommission of the alleged offence. That, the contents of the FIR, on<br \/>\nthe face of it, do not reveal that the applicant is involved in the<br \/>\ncommission of the offence, as alleged, as the prosecutrix-herself,<br \/>\ninsisted upon accompanying the applicant, as the boy, to whom she was<br \/>\ngoing to be engaged, was not liked by her. That, the prosecutrix had<br \/>\nvoluntarily gone with the applicant. That, the prosecutrix is about<br \/>\n19 years of age and not 16 years of age, as is being alleged, which<br \/>\nis evident from the document produced at Page-25 of the application.<br \/>\nThat, the prosecutrix herself, has addressed a communication dated<br \/>\n31.05.2008, to the Investigating Officer, and has stated that she had<br \/>\nvoluntarily left her house and wants to marry the applicant. That,<br \/>\nthe prosecutrix has remained in the company of the applicant for a<br \/>\nconsiderable period of time and, therefore, it cannot be said that<br \/>\nthe applicant is involved in the commission of the offences mentioned<br \/>\nabove and, therefore, the application for bail may be favorably<br \/>\nconsidered.\n<\/p>\n<p id=\"p_6\">5.\t\tMr.\n<\/p>\n<p id=\"p_7\">L.B. Dabhi, learned APP on behalf of the respondent-State has<br \/>\nstrongly opposed the grant of bail to the applicant.\n<\/p>\n<p id=\"p_8\">6.\t\tI<br \/>\nhave considered the submissions made by the learned Counsel for the<br \/>\nrespective parties, and perused the contents of the FIR as well as<br \/>\nother material on record.  The material on record, prima facie, does<br \/>\nnot point out the direct involvement of the applicant in the<br \/>\ncommission of the offence, in the manner alleged. It, further,<br \/>\ntranspires that there appears to be a possibility that the<br \/>\nprosecutrix may have voluntarily left her house, and has asked the<br \/>\napplicant to take her away, as she did not like the boy, to whom she<br \/>\nwas going to be engaged. The investigation is over and the<br \/>\ncharge-sheet has now been filed and, therefore, there is no<br \/>\npossibility that the applicant will abscond, tamper with the evidence<br \/>\nor pressurize the witnesses. Considering the totality of<br \/>\nthe facts and circumstances of the case, as emerging from the<br \/>\nmaterial on record, the manner in which the offence is alleged to<br \/>\nhave taken place and the nature and gravity of the offence, the<br \/>\napplication deserves to be allowed.\n<\/p>\n<p id=\"p_9\">7.\t\tFor<br \/>\nthe reasons stated above, the<br \/>\napplication is allowed. The applicant is ordered to be released on<br \/>\nbail in connection with FIR, being I-C.R. No. 92 of 2008 registered<br \/>\nwith Radhanpur Police Station, on his executing a personal bond to<br \/>\nthe tune of Rs.10,000\/- (Rupees Ten Thousand Only), with one solvent<br \/>\nsurety of the like amount to the satisfaction of the trial Court and<br \/>\nsubject to the conditions that the applicant:\n<\/p>\n<p id=\"p_10\">\ta)\tshall<br \/>\n\tnot take undue advantage of his \tliberty or abuse his liberty in any<br \/>\n\t\tmanner;\n<\/p>\n<p id=\"p_11\">\tb)\tshall<br \/>\n\tnot act in a manner injurious to \tthe \tinterest of the prosecution<br \/>\n\tor \ttamper with \tevidence or intimidate \twitnesses;\n<\/p>\n<p id=\"p_12\">\tc)<br \/>\n\t \tshall maintain law and order and shall \tcooperate fully with the<br \/>\n\tinvestigating \tofficers and shall make himself \tavailable \tfor<br \/>\n\tinvestigation, as and \twhenever directed;\n<\/p>\n<p id=\"p_13\">\td)\tshall<br \/>\n\tmark his presence before the \tInvestigating Officer of the concerned<br \/>\n\t\tPolice Station on the 15th and 30th day of<br \/>\n\t\tevery English calendar month, between \t10:00 am to<br \/>\n\t5:00 pm, till the\tcommencement of trial;\n<\/p>\n<p id=\"p_14\">\te)\tshall<br \/>\n\tnot leave the local limits of the \tState of Gujarat without the<br \/>\n\tprior \tpermission of the concerned Sessions \tJudge;\n<\/p>\n<p id=\"p_15\">\tf)\tshall<br \/>\n\tfurnish his residential address \tto \tthe \tInvestigating Officer and<br \/>\n\talso to \tthe \tcourt at the time of execution of \tthe \tbond and shall<br \/>\n\tnot change his\tresidential \taddress \twithout prior permission of<br \/>\n\tthis \tCourt;\n<\/p>\n<p id=\"p_16\">\tg)\tshall<br \/>\n\tsurrender his Passport, if any, \tto \tthe \tlower Court within a week.\n<\/p>\n<p id=\"p_17\">8.\t\tIf<br \/>\nthe applicant commits breach of any of the above conditions, the<br \/>\nconcerned Sessions Judge will be free to issue warrants or take<br \/>\nappropriate action in the matter.\n<\/p>\n<p id=\"p_18\">9.\t\tIt<br \/>\nis made clear that no observations made by this Court be construed as<br \/>\nhaving any bearing on the merits of the case, at the time of the<br \/>\ntrial. The trial Court will proceed in accordance with law,<br \/>\nunaffected and uninfluenced by any observations contained in this<br \/>\norder.\n<\/p>\n<p id=\"p_19\">10.\t\tBail<br \/>\nbefore the lower Court having jurisdiction to try the case. It would<br \/>\nbe open to the trial Court concerned to give time to furnish the<br \/>\nsolvency certificate, if prayed for.\n<\/p>\n<p id=\"p_20\">11.\t\tRule<br \/>\nis made absolute.
