Respondent\n\nPRAYER\n\nWrit Petition is filed under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the Constitution of\nIndia praying to issue a Writ of Certiorarified Mandamus, to call for the\nrecords relating to the impugned order in ref.P &amp; IR, dated 24.05.2007 issued by\nthe respondent in so far as it refuses to treat the period of absence of the\npetitioner from 30.09.2001 to till 4.6.2007 as duty, and quash the same and\ndirect the respondent herein to treat the period from 30.09.2001 to till\n5.6.2007as duty and pay the salary and other monetary and attendance benefits\nfor the relevant period to the petitioner.\n\n!For Petitioner\t... Mr.C.Godwin\n\n:ORDER\n<\/pre>\n<p id=\"p_1\">\tThe petitioner has approached this court, with a prayer, for issuance of a<br \/>\nwrit, in the nature of certiorari, to quash the impugned part of order, vide<br \/>\nwhich, the benefit of back-wages and salary, from the date of termination, till<br \/>\nreinstatement has been denied to the petitioner.\n<\/p>\n<p id=\"p_1\">\t2.The petitioner was working as &#8216;Record Clerk&#8217; with the respondent<br \/>\nInsurance Corporation, and on account of his involvement in a murder case, he<br \/>\nwas placed under suspension.  The petitioner was convicted by the learned<br \/>\nSessions Judge and his conviction was upheld upto the Hon&#8217;ble High Court.\n<\/p>\n<p id=\"p_2\">\t3.In view of the conviction of the petitioner, by the Sessions Judge,<br \/>\npetitioner was removed from service for the conduct leading to his conviction.<br \/>\nThe petitioner preferred an appeal against the decision of this Court before the<br \/>\nHon&#8217;ble Supreme Court of India. The Hon&#8217;ble Supreme Court, by giving benefit of<br \/>\ndoubt, acquitted the petitioner of the charges.\n<\/p>\n<p id=\"p_3\">\t4.The petitioner, on acquittal, approached the respondent for<br \/>\nreinstatement with continuity of service with all consequential benefits.  The<br \/>\nrequest of the petitioner was accepted and he was ordered to join duty, however,<br \/>\nthe period from the date of his removal, till realization was ordered to be<br \/>\ntreated as &#8220;The period not spent on duty&#8221;, i.e.,  Dies non.\n<\/p>\n<p id=\"p_4\">\t5.The learned counsel for the petitioner has challenged the impugned<br \/>\norder, by contending that the order,  on the face of it, arbitrary, as on<br \/>\naccount of acquittal, the very basis of his removal had ceased to exist,<br \/>\ntherefore, the petitioner is entitled to reinstatement with all consequential<br \/>\nbenefits.\n<\/p>\n<p id=\"p_5\">\t6.It is also the case of the petitioner, that he was always willing to<br \/>\nwork and it was the respondent, who removed him from service, on account of his<br \/>\nconviction by the court.\n<\/p>\n<p id=\"p_6\">\t7.The writ is opposed by the learned counsel for respondent, by placing<br \/>\nreliance on Regulation 38,  which has a statutory force of law.\n<\/p>\n<p id=\"p_7\">\t8.The Regulation 38, governing service condition of the petitioner reads<br \/>\nas under:-\n<\/p>\n<p id=\"p_8\">\t&#8220;Treatment of the Period of Suspension:-\n<\/p>\n<p id=\"p_9\">\t38.When the suspension of an employee is held to be unjustified or not<br \/>\nwholly justified; or when an employee who has been dismissed, removed and<br \/>\nsuspended is reinstated, the disciplinary, appellate, or reviewing authority, as<br \/>\nthe case may be whose decision shall be final, may grant to him for the period<br \/>\nof his absence from duty-\n<\/p>\n<p id=\"p_10\">\t(a)if he is honourably acquitted, the full pay and allowances which he<br \/>\nwould have been entitled to if he had not been dismissed, removed or suspended,<br \/>\nless the subsistence allowance;\n<\/p>\n<p id=\"p_11\">\t(b)if otherwise, such proportion or pay and allowance as the disciplinary,<br \/>\nappellate or reviewing authority may prescribe.\n<\/p>\n<p id=\"p_12\">In a case falling under clause (a), the period of absence from duty will be<br \/>\ntreated as a period spent on duty. [in a case falling under clause (b), the<br \/>\nperiod of absence shall not be treated as a period spent on duty, but the<br \/>\ndisciplinary, appellate or the reviewing authority may, at its discretion, grant<br \/>\nleave for the period of extent admissible to the employee under the rules; any<br \/>\nperiod of absence which has not been treated as period spent on duty or on leave<br \/>\nshall not count as service for any purpose under these Regulations but will not<br \/>\nconstitute break in service].\n<\/p>\n<p id=\"p_13\">No order passed under this regulation shall have the effect of compelling any<br \/>\nemployee to refund the subsistence allowance payable under regulation 31.&#8221;\n<\/p>\n<p id=\"p_14\">\t9.It is not in dispute that the petitioner has not been acquitted<br \/>\nHonourably, but on benefit of doubt.
