Justice B.P.RAY\n\n Dated :13\/12\/2010\n\n O R D E R\n                     C.N.RAMACHANDRAN NAIR &amp;\n                        BHABANI PRASAD RAY, JJ.\n                ....................................................................\n                          O.P.(CAT) No.1106 of 2010\n                ....................................................................\n               Dated this the 13th day of December, 2010.\n\n                                       JUDGMENT\n<\/pre>\n<p id=\"p_1\">Ramachandran Nair, J.\n<\/p>\n<p id=\"p_1\">      It is seen that the impugned order is passed by the Tribunal taking<\/p>\n<p>note of the imminent retirement of the respondent in March 2010. In<\/p>\n<p>the first place, Railways which has filed this case has not explained the<\/p>\n<p>delay in filing this O.P. i.e. nearly after eight months of the Tribunal<\/p>\n<p>issuing the order. On merits also we do not find any case for the<\/p>\n<p>Railways because respondent was allowed to function as Assistant<\/p>\n<p>Guard and he was given promotion as Goods Guard before his<\/p>\n<p>retirement. Now the request of the Railway is that respondent&#8217;s<\/p>\n<p>eligibility could be considered only after conducting an interview for<\/p>\n<p>him. We are unable to appreciate the delay and latches on the part of<\/p>\n<p>the Railways in handling the whole matter. We cannot permit the<\/p>\n<p>Railways to conduct interview for determining eligibility for promotion<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                2<\/span><\/p>\n<p>of a person much after his retirement.
