Her date of birth was correctly entered as 05.11.1984.\n<\/p>\n<p id=\"p_3\">2.2\tThe petitioner having passed 12th Std. from the respondent No. 3 school, was issued school Leaving certificate. However, in the certificate  date of birth is mentioned as 27.07.1985, which is incorrect.\n<\/p>\n<p id=\"p_4\">3.  Learned advocate for the petitioner submitted that the certificate of birth given by statutory authority at Annexure ?SA?? shows the correct date of birth as 05.11.1984.\n<\/p>\n<p id=\"p_5\">4.\tIt<br \/>\nis also submitted by the learned advocate for the petitioner that<br \/>\neither through mistake or though oversight, the respondent No.3<br \/>\nSchool has mentioned  the date of birth as 27.07.1985 in the School<br \/>\nLeaving Certificate.\n<\/p>\n<p id=\"p_6\">5.\tThus,<br \/>\nthere is a mistake in School Leaving Certificate issued by the<br \/>\nrespondent No.3 School and therefore, they can rectify the mistake on<br \/>\nthe basis of the document at Annexure &#8216;A&#8217;.\n<\/p>\n<p id=\"p_7\">6.\tLearned<br \/>\nadvocate appearing for respondents authority who has issued<br \/>\nCertificate submitted that the respondent school has no powers to do<br \/>\nso and necessary orders are required from the Court to make the<br \/>\nnecessary correction.\n<\/p>\n<p id=\"p_8\">7.\t\tLearned<br \/>\nAsstt. Government Pleader Ms Nisha Parikh appearing for the<br \/>\nrespondents No.1 and 2 has no much objection, if the aforesaid<br \/>\ndirection is given on the basis of the  Birth Certificate at Annexure<br \/>\n?SA?? to the petition.\n<\/p>\n<p id=\"p_9\">8.\tLooking<br \/>\nto the facts and circumstances of the case and, the Certificate<br \/>\nissued under <a href=\"\/doc\/433561\/\" id=\"a_1\">section 12<\/a> and <a href=\"\/doc\/828894\/\" id=\"a_1\">17<\/a> of The Registration of Birth and Death<br \/>\nAct,1969 the prayer  as prayed for is required to be granted since<br \/>\nthe docuemtns at Annexure &#8216;A&#8217; is a statutory Certificate, which  has<br \/>\nvery high evidentiary value. So far as the facts, which are mentioned<br \/>\nin the said Certificate at Annexure ?SA?? reveal the date of birth<br \/>\nof the petitioner as 05.11.1984.  The details given in the<br \/>\nCertificate have been recorded as per the statutory provision under<br \/>\nthe Act,1969. The date of birth mentioned in Annexure ?SA?? ought<br \/>\nto have been reflected in Certificate at Annexure ?SD?? issued by<br \/>\nthe respondent school. The contention raised by the learned counsel<br \/>\nappearing on behalf of the respondents that in pursuance of the Rule<br \/>\n12 of Gujarat Secondary Education Rules 1974, such amendment in the<br \/>\nschool leaving certificate is not permissible, once the student,<br \/>\npresent petitioner has left the school. This contention is not<br \/>\naccepted by this Court mainly for the reason that errors are required<br \/>\nto be corrected. The respondents are not error proof authorities. If<br \/>\nthe error has been accepted by the respondents denial of corrections<br \/>\nof the documents is an arbitrary action. The only question, which is<br \/>\nnow left out is modus operandi for carrying out the corrections in<br \/>\nschool leaving certificate. There can be several methods of<br \/>\ncorrections of school leaving certificate like direct correction in<br \/>\nthe school leaving certificate itself or by keeping the certified<br \/>\ncopy of birth registration certificate issued by the State of Gujarat<br \/>\nunder <a href=\"\/doc\/433561\/\" id=\"a_2\">Sections 12<\/a> and <a href=\"\/doc\/828894\/\" id=\"a_3\">17<\/a> of the Registration of Birth and Death Act<br \/>\n1969, by the concerned school in their register and amended copy of<br \/>\nschool leaving certificate can be given to the petitioner or by<br \/>\nputting notes in margin that this amendment in the birth date is<br \/>\ncarried out as per the certificate issued by the State Government,<br \/>\nbut, total denial by the concerned respondents that they shall not<br \/>\namend the school leaving certificate, despite the certificate of<br \/>\nbirth issued by the State of Gujarat tantamounts to violation of<br \/>\npublic duty and hence, writ of mandamus is issued upon the concerned<br \/>\nrespondents to carry out necessary amendment in school leaving<br \/>\ncertificate on the basis of document issued by the State of Gujarat<br \/>\nnamely the Birth Certificate issued under the Act, 1969. It is for<br \/>\nthe concerned respondent school to keep and preserve a<br \/>\ncertified\/original of Annexure ?SA?? in the school register and<br \/>\nthereafter, they can issue the corrected copy of school leaving<br \/>\ncertificate by putting necessary notes in the margin. But the error<br \/>\nhas to be corrected by the concerned respondents authorities. There<br \/>\ncannot be any error, which cannot be corrected. Rule made absolute to<br \/>\nthe aforesaid extent with no order as to costs.
