No.24195\/2009-T\n                      ~~~~~~~~~~~~~~~~~~~~~~~~~~~\n                   Dated this the 24th day of August, 2009\n\n                           J U D G M E N T\n<\/pre>\n<p id=\"p_1\">      The petitioner is working as H.S.S.T in the Higher Secondary School,<\/p>\n<p>Thiruvampady. The main prayer in the writ petition is to quash Ext.P4 and<\/p>\n<p>to issue a direction to the second respondent to grant the benefit of Ext.P3<\/p>\n<p>Government Order to the petitioner.\n<\/p>\n<p id=\"p_1\">      2.     The petitioner who was working as H.S.A (Maths) was<\/p>\n<p>transferred as H.S.S.T (Junior) (Maths) with effect from 25\/07\/2001, which<\/p>\n<p>was approved also.\n<\/p>\n<p id=\"p_2\">      3.     The person appointed in the resultant vacancy of H.S.A,<\/p>\n<p>namely, Smt.S.Ambili was also given approval with effect from 25\/07\/2001,<\/p>\n<p>which is evidenced by Ext.P2. The petitioner is entitled for the benefit of<\/p>\n<p>Ext.P3 Government Order whereby the Government ordered that the Aided<\/p>\n<p>Higher Secondary School Teachers appointed by transfer as part-time\/junior<\/p>\n<p>from among qualified H.S.As\/U.P.S.As\/L.P.S.As between 13\/05\/1998 to<\/p>\n<p>12\/11\/2001 are entitled for the benefit of full time scale of pay irrespective<\/p>\n<p>of the periods of teaching as in the case of Government School transferees<\/p>\n<p>as H.S.S.Ts (Juniors). The request made by the petitioner was rejected by<\/p>\n<p>W.P.(C). No.24195\/2009<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                   -:2:-<\/span><\/p>\n<p>the Director as per Ext.P4.     Presently, Ext.P5 is the revision petition<\/p>\n<p>pending against Ext.P4 order.     There will be a direction to the first<\/p>\n<p>respondent to take a decision on Ext.P5 after hearing the petitioner within a<\/p>\n<p>period of three months from the date of receipt of a copy of this judgment.<\/p>\n<p id=\"p_3\">     The writ petition is disposed of as above.
