Act.  It was also stated in the impugned order that as<br \/>\nthe said bootlegging activities of the detenu are dangerous and<br \/>\naffecting maintenance of &#8216;public order&#8217; and &#8216;public health&#8217;, order of<br \/>\ndetention has been passed against her.\n<\/p>\n<p>2.2\t\tShe has<br \/>\nsubmitted that on the basis of  aforesaid criminal cases registered<br \/>\nagainst the detenu, it cannot be said that the activities of the<br \/>\ndetenu has become prejudicial to the maintenance of &#8216;Public Order&#8217;.<br \/>\nIn support of her case she has placed reliance on a decision of the<br \/>\nHon&#8217;ble Apex Court in the case of ?SArun Ghosh Vs. State of<br \/>\nWest Bengal?? 1970(1)SCC 98 wherein the Hon&#8217;ble Apex Court<br \/>\nat Para-3 held as under,<\/p>\n<p>?S&#8230;that<br \/>\ndisturbance of public order is to be distinguished from acts directed<br \/>\nagainst individuals which do not disturb the society to the extent of<br \/>\ncausing a general disturbance of public tranquility.  It is the<br \/>\ndegree of disturbance and its effect upon the life of the community<br \/>\nin a locality which determines whether the disturbance amounts only<br \/>\nto a breach of law and order. The question whether a man has only<br \/>\ncommitted a breach of law and order or has acted in a manner likely<br \/>\nto cause a disturbance of the public order is a question of degree<br \/>\nand the extent of the reach of the act upon the society.  There is no<br \/>\nformula by which one case can be distinguished from another.??\n<\/p>\n<p>2.3\t\tSimilar<br \/>\nprinciple has been followed by the Hon&#8217;ble Apex Court in the case of<br \/>\n?SDarpan @ Dharban Kumar Sharma Vs. State of Tamil Nadu and<br \/>\nOrs.?? reported in (2003)2 SCC 313 and by this Court in the<br \/>\ncase of ?SSurajsinh @ Suru @ Suresh Lallusinh Rajput Vs. State<br \/>\nof Gujarat and Ors.?? reported in 2004(1)GLH 454.\n<\/p>\n<p>3.0\t\tThe<br \/>\nlearned A.G.P. for respondent-detaining Authority has supported the<br \/>\norder of detention as well as grounds stated therein and has<br \/>\ncontended that the Authority has passed the impugned order after<br \/>\ntaking into consideration all the facts and circumstances of the<br \/>\ncase, and hence, no case is made out calling for interference of this<br \/>\nCourt.\n<\/p>\n<p>4.0\t\tAs a<br \/>\nresult of hearing and perusal of the record it appears that in this<br \/>\ncase the only material is aforesaid criminal cases registered against<br \/>\nthe detenu and on the basis of that it cannot be said that the<br \/>\nactivity of the detenu has become a threat to the maintenance of<br \/>\n&#8216;public order&#8217; and &#8216;public health&#8217;. The offences registered against<br \/>\nthe detenu pertains to prohibition to which I have already made<br \/>\nreference in my earlier part of the judgment. Mere involvement of<br \/>\ndetenu in bootlegging activities may not amount to dangerous activity<br \/>\nby detenu and mere mention of them unless supported by any evidence<br \/>\ncannot be said to be material and germane for the purpose of arriving<br \/>\nat subjective satisfaction that the activity of the detenu is<br \/>\nprejudicial to the maintenance of &#8216;public order&#8217; and &#8216;public health&#8217;.\n<\/p>\n<p>4.1\t\t I am,<br \/>\ntherefore, of the view that the detaining authority has passed the<br \/>\norder of detention without there being any credible or cogent<br \/>\nmaterial on record in this behalf.  I have  considered factual and<br \/>\nlegal aspects emerging from the record and also considered the rival<br \/>\nsubmissions and the facts of the case and also considered the<br \/>\njudgment of the Hon&#8217;ble Apex Court in the case of ?SArun<br \/>\nGhosh??(Supra) as well as ?SDarpan @ Dharban Kumar<br \/>\nSharma??(Supra) and the judgment of this Court in the case<br \/>\nof ?SSurajsinh @ Suru @ Suresh Lallusinh Rajput??<br \/>\n(Supra). In view of the facts and circumstances of the present case<br \/>\nand in view of the ratio laid down in the decision mentioned above,<br \/>\nthe order of detention cannot be sustained and it deserves to be<br \/>\nquashed and set aside.\n<\/p>\n<p>5.0\t\tIn the<br \/>\nresult, this petition is allowed. The order of detention dated<br \/>\n03.12.2007 passed by Police Commissioner, Vadodara is hereby quashed<br \/>\nand set aside.  The detenu is, therefore, ordered to be set at<br \/>\nliberty forthwith, if she is not required in connection with any<br \/>\nother case by the Authority. Rule is made absolute.
