Leave granted.\n<\/p>\n<p id=\"p_3\">\n<p id=\"p_4\">2.    Challenge in this appeal is to the judgment of a Division Bench of<\/p>\n<p>Bombay High Court, Aurangabad Bench, dismissing the appeal filed by the<\/p>\n<p>appellant who was convicted for offences punishable under <a href=\"\/doc\/1560742\/\" id=\"a_1\">Sections 302<\/a><\/p>\n<p>and <a href=\"\/doc\/538436\/\" id=\"a_1\">498-A<\/a> of the Indian Penal Code, 1860 (in short the `<a href=\"\/doc\/1569253\/\" id=\"a_2\">IPC<\/a>&#8216;), so far as the<br \/>\nconviction under <a href=\"\/doc\/1560742\/\" id=\"a_3\">Section 302<\/a> IPC is concerned, while directing acquittal in<\/p>\n<p>respect of offence punishable under <a href=\"\/doc\/538436\/\" id=\"a_4\">Section 498-A<\/a> IPC. Seven persons<\/p>\n<p>faced trial before the learned Additional Sessions Judge, Amalner.<\/p>\n<p id=\"p_5\">3.    Brief facts giving rise to the prosecution are as under:<\/p>\n<p id=\"p_6\">      Akbarbeg (PW-4) is the father of Sayarabi (hereinafter referred to as<\/p>\n<p>the `deceased&#8217;). The marriage of the deceased Sayarabi with accused No.5<\/p>\n<p>Riyazoddin, present appellant was preferred one year back. Accused Nos.1<\/p>\n<p>and 2 are the parents and accused Nos.3 and 6 are the brothers of accused<\/p>\n<p>No.5. Accused No.4 is the wife of accused No.3.\n<\/p>\n<p id=\"p_7\">\n<p id=\"p_8\">       It was alleged that the accused were giving ill treatment to deceased<\/p>\n<p>Sayarabi during the period of her stay in the matrimonial house at Parola,<\/p>\n<p>Dist. Jalgaon. The accused No.5-appellant was abusing and beating the<\/p>\n<p>deceased Sayarabi. Accused Nos.1 and 2 had brought the deceased to her<\/p>\n<p>parent&#8217;s house at village Dherangeon Tal Onerrangaon Dist. Jalgaon three<\/p>\n<p>months back. Deceased disclosed about her ill treatment at the hands of<\/p>\n<p>accused to her relatives.\n<\/p>\n<p id=\"p_9\">\n<p><span class=\"hidden_text\" id=\"span_1\">                                     2<\/span><br \/>\n          On 12.5.1996 the marriage of niece of P.W.4 Akbarbeg was<\/p>\n<p>performed at Dharangaon. Accused No. 3 and 5 had attended the said<\/p>\n<p>marriage. They demanded Rs.2000\/- for the construction of a house from<\/p>\n<p>P.W. 4 Akberbeg. He expressed his inability to pay the amount.<\/p>\n<p id=\"p_10\">          On 20.5.1996 the deceased was sent to stay at her matrimonial house<\/p>\n<p>along with accused 1 and 2. On 25.5.1996 at about 2.00 midnight P.W.4<\/p>\n<p>Akbarbeg received the message through police about the serious condition<\/p>\n<p>of the deceased. Thereafter he along with his relatives paid visit to the<\/p>\n<p>matrimonial house of his deceased daughter. He saw the dead body of his<\/p>\n<p>daughter with burn injury in her matrimonial house. He found kerosene<\/p>\n<p>smell on the hair and half burnt cloth.\n<\/p>\n<p id=\"p_11\">\n<p id=\"p_12\">          Ramesh (PW-1) the Police Patil of Parola lodged an occurrence<\/p>\n<p>report to the police. On the basis of his report A.D. bearing No. 35\/96 was<\/p>\n<p>registered. Inquest panchanama on the dead body was prepared on<\/p>\n<p>25.5.1996 in A.D. case. Spot panchanama was also prepared in A.D.Case.<\/p>\n<p>Dead body was sent for conducting the post mortem to the cottage Hospital,<\/p>\n<p>Parola.\n<\/p>\n<p id=\"p_13\">\n<p><span class=\"hidden_text\" id=\"span_1\">                                      3<\/span><br \/>\n      Akberbeg came to know through his relative Rahanabi (PW-5) that<\/p>\n<p>the accused No.5 committed the murder of the deceased by pouring<\/p>\n<p>kerosene oil on her person and setting her on fire. Accused Nos.1 to 4 and 6<\/p>\n<p>abetted the accused No.5 in the commission of murder of the deceased.<\/p>\n<p>P.W.4 Akberbeg lodged the complaint dated 25.5.1996 alleging ill-<\/p>\n<p>treatment to the deceased prior to 25.5.1996 and committing her murder on<\/p>\n<p>24.5.1996 at about 11-00 P.M.\n<\/p>\n<p id=\"p_14\">\n<p id=\"p_15\">        On the basis of his complaint crime bearing No.121\/1996 was<\/p>\n<p>registered with Parola Police station at about 1.00 p.m. M.D. Patil (PW-11)<\/p>\n<p>carried out the investigation of the crime. On 27.5.1996, he sent the seized<\/p>\n<p>articles for examination to the C.A. Aurangabad. After the completion of<\/p>\n<p>investigation on 14.8.1996 he submitted the charge sheet against the<\/p>\n<p>accused for the offences as stated above to the learned Judicial Magistrate,<\/p>\n<p>First Class. Parola.\n<\/p>\n<p id=\"p_16\">\n<p id=\"p_17\">       The learned Judicial Magistrate, First Class, Parola by an order dated<\/p>\n<p>21.8.1996 committed the case to the Additional Sessions Judge, Amalner, as<\/p>\n<p>the offence punishable under <a href=\"\/doc\/1560742\/\" id=\"a_5\">Section 302<\/a> IPC is exclusively triable by the<\/p>\n<p>Court of Sessions.\n<\/p>\n<p id=\"p_18\">\n<p><span class=\"hidden_text\" id=\"span_2\">                                    4<\/span><br \/>\n       In Sessions case charge was framed against accused Nos.1 to 6 for<\/p>\n<p>the offence punishable under <a href=\"\/doc\/538436\/\" id=\"a_6\">Section 498-A<\/a> read with <a href=\"\/doc\/37788\/\" id=\"a_7\">section 34<\/a> IPC and<\/p>\n<p>against accused Nos.1 to 4 and 6 under <a href=\"\/doc\/1560742\/\" id=\"a_8\">Section 302<\/a> read with <a href=\"\/doc\/112749\/\" id=\"a_9\">Section 114<\/a><\/p>\n<p>IPC.\n<\/p>\n<p id=\"p_19\">\n<p id=\"p_20\">       The charge was read over and explained to the accused in vernacular.<\/p>\n<p>They pleaded not guilty and claimed to be tried. The defence of the accused<\/p>\n<p>is that the house caught fire due to short circuit. Deceased sustained burn<\/p>\n<p>injury on account of house catching fire in a short circuit.<\/p>\n<p id=\"p_21\">       The trial Court directed acquittal of A-1 to A-4 and A-6 but held the<\/p>\n<p>present appellant guilty of offence punishable under <a href=\"\/doc\/1560742\/\" id=\"a_10\">Sections 302<\/a> and <a href=\"\/doc\/1868826\/\" id=\"a_11\">498-<\/a><\/p>\n<p>A IPC. In appeal, as noted above the High Court found that the accusations<\/p>\n<p>so far as <a href=\"\/doc\/538436\/\" id=\"a_12\">Section 498-A<\/a> are concerned are not established, but the evidence<\/p>\n<p>was sufficient to hold the appellant guilty of offence punishable under<\/p>\n<p><a href=\"\/doc\/1560742\/\" id=\"a_13\">Section 302<\/a> IPC.\n<\/p>\n<p id=\"p_22\">\n<p id=\"p_23\">4.     In support of the appeal, learned counsel for the appellant submitted<\/p>\n<p>that there was no direct evidence and the prosecution case was based on<\/p>\n<p><span class=\"hidden_text\" id=\"span_3\">                                      5<\/span><br \/>\ncircumstantial evidence. The circumstances highlighted do not lead to<\/p>\n<p>conclude about the guilt of the accused.\n<\/p>\n<p id=\"p_24\">\n<p id=\"p_25\">5.     Learned counsel for the State on the other hand supported the<\/p>\n<p>judgment.\n<\/p>\n<p id=\"p_26\">\n<p id=\"p_27\">6.     The circumstances highlighted by the trial Court and the High Court<\/p>\n<p>are essentially as follows:\n<\/p>\n<p id=\"p_28\">\n<pre id=\"pre_1\">       (i)     The appellant was residing with his wife.\n\n       (ii)    Death of wife at odd hours (midnight) and in unnatural manner.\n\n<\/pre>\n<p id=\"p_29\">       (iii)   Kerosene smell in the body and articles around the body.<\/p>\n<p id=\"p_30\">       (iv)    False defence (i.e. fire by short circuit).<\/p>\n<p id=\"p_31\">7.     Learned counsel for the appellant submitted that there is no evidence<\/p>\n<p>to show that the deceased was sprinkled with kerosene. The evidence clearly<\/p>\n<p>established that there was no homicidal death and it was due to short circuit<\/p>\n<p>of electricity.\n<\/p>\n<p id=\"p_32\">\n<p><span class=\"hidden_text\" id=\"span_4\">                                        6<\/span>\n<\/p>\n<p id=\"p_33\">8.    It has been consistently laid down by this Court that where a case<\/p>\n<p>rests squarely on circumstantial evidence, the inference of guilt can be<\/p>\n<p>justified only when all the incriminating facts and circumstances are found<\/p>\n<p>to be incompatible with the innocence of the accused or the guilt of any<\/p>\n<p>other person. (<a href=\"\/doc\/1204531\/\" id=\"a_14\">See Hukam Singh v. State of Rajasthan<\/a> AIR (1977 SC 1063);<\/p>\n<p><a href=\"\/doc\/444871\/\" id=\"a_15\">Eradu and Ors. v. State of Hyderabad<\/a> (AIR 1956 SC 316); <a href=\"\/doc\/1945016\/\" id=\"a_16\">Earabhadrappa v.<\/p>\n<p>State of Karnataka<\/a> (AIR 1983 SC 446); <a href=\"\/doc\/1585519\/\" id=\"a_17\">State of U.P. v. Sukhbasi<\/a> and Ors.<\/p>\n<p>(AIR 1985 SC 1224); <a href=\"\/doc\/1597551\/\" id=\"a_18\">Balwinder Singh v. State of Punjab<\/a> (AIR 1987 SC<\/p>\n<p id=\"p_34\">350); <a href=\"\/doc\/425869\/\" id=\"a_19\">Ashok Kumar Chatterjee v. State of M.P<\/a>. (AIR 1989 SC 1890). The<\/p>\n<p>circumstances from which an inference as to the guilt of the accused is<\/p>\n<p>drawn have to be proved beyond reasonable doubt and have to be shown to<\/p>\n<p>be closely connected with the principal fact sought to be inferred from those<\/p>\n<p>circumstances. <a href=\"\/doc\/9122\/\" id=\"a_20\">In Bhagat Ram v. State of Punjab<\/a> (AIR 1954 SC 621), it was<\/p>\n<p>laid down that where the case depends upon the conclusion drawn from<\/p>\n<p>circumstances the cumulative effect of the circumstances must be such as to<\/p>\n<p>negative the innocence of the accused and bring the offences home beyond<\/p>\n<p>any reasonable doubt.\n<\/p>\n<p id=\"p_35\">\n<p id=\"p_36\">9.    We may also make a reference to a decision of this Court in <a href=\"\/doc\/1718159\/\" id=\"a_21\">C.<\/p>\n<p>Chenga Reddy and Ors. v. State of A.P<\/a>. (1996) 10 SCC 193, wherein it has<\/p>\n<p>been observed thus:\n<\/p>\n<p id=\"p_37\"><span class=\"hidden_text\" id=\"span_5\">                                    7<\/span><br \/>\n                    &#8220;In a case based on circumstantial evidence, the<br \/>\n             settled law is that the circumstances from which the<br \/>\n             conclusion of guilt is drawn should be fully proved and<br \/>\n             such circumstances must be conclusive in nature.<br \/>\n             Moreover, all the circumstances should be complete and<br \/>\n             there should be no gap left in the chain of evidence.<br \/>\n             Further the proved circumstances must be consistent<br \/>\n             only with the hypothesis of the guilt of the accused and<br \/>\n             totally inconsistent with his innocence&#8230;.&#8221;.<\/p>\n<p id=\"p_38\">10.   <a href=\"\/doc\/307495\/\" id=\"a_22\">In Padala Veera Reddy v. State of A.P. and Ors<\/a>. (AIR 1990 SC 79), it<\/p>\n<p>was laid down that when a case rests upon circumstantial evidence, such<\/p>\n<p>evidence must satisfy the following tests:\n<\/p>\n<p id=\"p_39\">\n<blockquote id=\"blockquote_1\"><p>            &#8220;(1) the circumstances from which an inference of guilt<br \/>\n            is sought to be drawn, must be cogently and firmly<br \/>\n            established;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>            (2) those circumstances should be of a definite<br \/>\n            tendency unerringly pointing towards guilt of the<br \/>\n            accused;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>            (3) the circumstances, taken cumulatively should form<br \/>\n            a chain so complete that there is no escape from the<br \/>\n            conclusion that within all human probability the crime<br \/>\n            was committed by the accused and none else; and<\/p>\n<p>            (4) the circumstantial evidence in order to sustain<br \/>\n            conviction must be complete and incapable of<br \/>\n            explanation of any other hypothesis than that of the guilt<br \/>\n            of the accused and such evidence should not only be<br \/>\n            consistent with the guilt of the accused but should be<br \/>\n            inconsistent with his innocence.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\" id=\"span_6\">                                    8<\/span><\/p>\n<p id=\"p_40\">11.   <a href=\"\/doc\/141148\/\" id=\"a_23\">In State of U.P. v. Ashok Kumar Srivastava<\/a>, (1992 Crl.LJ 1104), it<\/p>\n<p>was pointed out that great care must be taken in evaluating circumstantial<\/p>\n<p>evidence and if the evidence relied on is reasonably capable of two<\/p>\n<p>inferences, the one in favour of the accused must be accepted. It was also<\/p>\n<p>pointed out that the circumstances relied upon must be found to have been<\/p>\n<p>fully established and the cumulative effect of all the facts so established<\/p>\n<p>must be consistent only with the hypothesis of guilt.<\/p>\n<p id=\"p_41\">12.   Sir Alfred Wills in his admirable book &#8220;Wills&#8217; Circumstantial<\/p>\n<p>Evidence&#8221; (Chapter VI) lays down the following rules specially to be<\/p>\n<p>observed in the case of circumstantial evidence: (1) the facts alleged as the<\/p>\n<p>basis of any legal inference must be clearly proved and beyond reasonable<\/p>\n<p>doubt connected with the factum probandum; (2) the burden of proof is<\/p>\n<p>always on the party who asserts the existence of any fact, which infers legal<\/p>\n<p>accountability; (3) in all cases, whether of direct or circumstantial evidence<\/p>\n<p>the best evidence must be adduced which the nature of the case admits; (4)<\/p>\n<p>in order to justify the inference of guilt, the inculpatory facts must be<\/p>\n<p>incompatible with the innocence of the accused and incapable of<\/p>\n<p>explanation, upon any other reasonable hypothesis than that of his guilt, (5)<\/p>\n<p><span class=\"hidden_text\" id=\"span_7\">                                     9<\/span><br \/>\nif there be any reasonable doubt of the guilt of the accused, he is entitled as<\/p>\n<p>of right to be acquitted&#8221;.\n<\/p>\n<p id=\"p_42\">\n<p id=\"p_43\">13.   There is no doubt that conviction can be based solely on<\/p>\n<p>circumstantial evidence but it should be tested by the touch-stone of law<\/p>\n<p>relating to circumstantial evidence laid down by the this Court as far back as<\/p>\n<p>in 1952.\n<\/p>\n<p id=\"p_44\">\n<p id=\"p_45\">14.   In Hanumant Govind Nargundkar and Anr. V. State of Madhya<\/p>\n<p>Pradesh, (AIR 1952 SC 343), wherein it was observed thus:<\/p>\n<blockquote id=\"blockquote_3\"><p>                    &#8220;It is well to remember that in cases where the<br \/>\n             evidence is of a circumstantial nature, the circumstances<br \/>\n             from which the conclusion of guilt is to be drawn should<br \/>\n             be in the first instance be fully established and all the<br \/>\n             facts so established should be consistent only with the<br \/>\n             hypothesis of the guilt of the accused. Again, the<br \/>\n             circumstances should be of a conclusive nature and<br \/>\n             tendency and they should be such as to exclude every<br \/>\n             hypothesis but the one proposed to be proved. In other<br \/>\n             words, there must be a chain of evidence so far complete<br \/>\n             as not to leave any reasonable ground for a conclusion<br \/>\n             consistent with the innocence of the accused and it must<br \/>\n             be such as to show that within all human probability the<br \/>\n             act must have been done by the accused.&#8221;\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\" id=\"span_8\">                                     10<\/span><\/p>\n<p id=\"p_46\">15.   A reference may be made to a later decision in <a href=\"\/doc\/1505859\/\" id=\"a_24\">Sharad Birdhichand<\/p>\n<p>Sarda v. State of Maharashtra<\/a>, (AIR 1984 SC 1622). Therein, while dealing<\/p>\n<p>with circumstantial evidence, it has been held that onus was on the<\/p>\n<p>prosecution to prove that the chain is complete and the infirmity of lacuna in<\/p>\n<p>prosecution cannot be cured by false defence or plea.           The conditions<\/p>\n<p>precedent in the words of this Court, before conviction could be based on<\/p>\n<p>circumstantial evidence, must be fully established. They are:<\/p>\n<blockquote id=\"blockquote_4\"><p>             (1) the circumstances from which the conclusion of<br \/>\n             guilt is to be drawn should be fully established. The<br \/>\n             circumstances concerned `must&#8217; or `should&#8217; and not `may<br \/>\n             be&#8217; established;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_5\"><p>             (2) the facts so established should be consistent only<br \/>\n             with the hypothesis of the guilt of the accused, that is to<br \/>\n             say, they should not be explainable on any other<br \/>\n             hypothesis except that the accused is guilty;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_6\"><p>             (3) the circumstances should be of a conclusive nature<br \/>\n             and tendency;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_7\"><p>             (4) they should exclude every possible hypothesis<br \/>\n             except the one to be proved; and<\/p>\n<p>             (5) there must be a chain of evidence so complete as<br \/>\n             not to leave any reasonable ground for the conclusion<br \/>\n             consistent with the innocence of the accused and must<br \/>\n             show that in all human probability the act must have<br \/>\n             been done by the accused.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\" id=\"span_9\">                                     11<\/span><\/p>\n<p id=\"p_47\">16.   These aspects were highlighted in <a href=\"\/doc\/154646541\/\" id=\"a_25\">State of Rajasthan v. Raja Ram<\/a><\/p>\n<p>(2003 (8) SCC 180), <a href=\"\/doc\/273747\/\" id=\"a_26\">State of Haryana v. Jagbir Singh and Anr<\/a>. (2003 (11)<\/p>\n<p>SCC 261), Kusuma Ankama Rao v State of A.P. (Criminal Appeal<\/p>\n<p>No.185\/2005 disposed of on 7.7.2008) and Manivel and Ors. v. State of<\/p>\n<p>Tami Nadu (Criminal Appeal No.473 of 2001 disposed of on 8.8.2008).<\/p>\n<p id=\"p_48\">17.   The doctor (PW-8) clearly stated that the dead body was totally burnt<\/p>\n<p>and was smelling of kerosene and the cause of death was due to burns and<\/p>\n<p>shock. It was also opined that the injuries found on the dead body were<\/p>\n<p>sufficient in the ordinary course of nature to cause death and by pouring<\/p>\n<p>kerosene the injury as mentioned in Column No.17 of P.M. Notes Exh.78<\/p>\n<p>would be caused. The circumstances highlighted by the prosecution as<\/p>\n<p>analysed in detail by the trial and High Court clearly established the guilt of<\/p>\n<p>the accused.
