For the purpose of census<br \/>\nwork,  personnel are recruited through employment  exchange.<br \/>\nAfter the census work is over their employment would come to<br \/>\nan  end\t inasmuch  as such employees are taken\ton  duty  on<br \/>\ntemporary  basis.  From 1971 onwards, on each occasion, when<br \/>\non  completion\tof  the census work, on the request  of\t the<br \/>\nRegistrar  General and Census Commissioner of India, certain<br \/>\nbenefits  were\tgiven  to the census workers, such  as,\t top<br \/>\npriority  for recruitment to the posts of Junior Assistants,<br \/>\nRecord\tClerks,\t Peons,\t etc.  and age relaxation  of  three<br \/>\nyears  and  rule of reservation while  making  appointments.<br \/>\nSimilar\t orders\t had been issued on each occasion after\t the<br \/>\ncensus\twork  was  over\t at the instance  of  the  Registrar<br \/>\nGeneral\t and Census Commissioner of India.  For the  purpose<br \/>\nof  census  operations\twhich  commenced in  the  year\t1991<br \/>\ncertain\t workers,  including respondents, were engaged on  a<br \/>\nconsolidated  pay to carry out the census work for a  period<br \/>\nof  18\tmonths\tfrom  1.2.1991\t to  30.6.1992.\t  After\t the<br \/>\ncompletion   of\t the  census   work,  their  services\twere<br \/>\nterminated.  On May 15, 1991, the State Government issued an<br \/>\norder  imposing a ban on recruitment of temporary employees,<br \/>\nfor  a\tperiod of one year from that date, other than  those<br \/>\nwho  are  sponsored  by\t the   Tamil  Nadu  Public   Service<br \/>\nCommission  [hereinafter  referred to as the  Commission].<br \/>\nThis  ban  was\tcontinued  for an  indefinite  period.\t The<br \/>\nRegistrar  General  and Census Commissioner of India,  by  a<br \/>\nletter\tsent  on December 26, 1991, requested the  State  of<br \/>\nTamil  Nadu  to\t take  appropriate steps  in  absorbing\t the<br \/>\ntemporary  workers employed in the census operations at\t the<br \/>\nstate  level  in its services and in the undertakings  under<br \/>\nits  control.\tSimilar request was made by the Director  of<br \/>\nCensus\tOperations, Madras.  The services of the respondents<br \/>\nin  the present case who had been engaged as census  workers<br \/>\nwere  terminated  or retrenched on June 30,  1992.   Certain<br \/>\nconcessions were sought to be extended to the respondents in<br \/>\nG.O.Ms.Nos.341\tand  444 but the concessions extended  under<br \/>\nthe   earlier  order  were   withdrawn\tand  more  stringent<br \/>\nconditions were imposed for their absorption.  The resultant<br \/>\nposition  is  that  there was a ban on\tthe  recruitment  of<br \/>\ntemporary   employees\tthrough\t  employment  exchange\t and<br \/>\nrecruitment of both temporary and permanent employees had to<br \/>\nbe  made  only\tfrom the list of persons  sponsored  by\t the<br \/>\nCommission.   Thus, the temporary employees who were working<br \/>\nin Census Department and whose services were terminated also<br \/>\nhad  to\t pass such qualifying examination conducted  by\t the<br \/>\nCommission.   In  this background, the respondents filed  an<br \/>\napplication  before  the Tamil Nadu Administrative  Tribunal<br \/>\n[hereinafter referred to as the Tribunal] that they had to<br \/>\nbe absorbed either in the State Government service or in any<br \/>\nof  the\t undertakings  inasmuch as they had  worked  for  15<br \/>\nmonths\tcontinuously  and  they sought for  a  direction  to<br \/>\nabsorb them as Junior Assistants or Typists.  The appellants<br \/>\nresisted  the  said petition on the basis that the  Tribunal<br \/>\ndoes  not  have\t jurisdiction to entertain  the\t application<br \/>\nsince  the respondents were not employed in any civil  post;<br \/>\nthat,  in  view of various Government orders indicating\t the<br \/>\npolicy\tthat  the respondents could not be recruited to\t the<br \/>\nState  Government  service except on being sponsored by\t the<br \/>\nCommission.  The Tribunal, however, held that the appellants<br \/>\nhad  absorbed  the  terminated temporary  employees  of\t the<br \/>\nCensus\tDepartment  in 1971 and 1981 and the  G.O.Ms.Nos.341<br \/>\ndated 13.12.92 and 444 dated 23.12.92 were subsequent to the<br \/>\none   issued  on  15.5.91  imposing   general  ban  on\t the<br \/>\nrecruitment  of temporary employees sponsored by  employment<br \/>\nexchange  and, therefore, the subsequent G.O.Ms.  issued for<br \/>\nthe specific category of employees would exclude the earlier<br \/>\nG.O.Ms\tand thus the respondents were entitled to absorption<br \/>\nin the State Government and directed the State Government to<br \/>\nconsider  their cases for such absorption within a period of<br \/>\ntwo  months.   Hence this appeal by special leave.   Several<br \/>\ncontentions  have  been raised before us but in view of\t the<br \/>\nstand  taken  now  by the appellants, it is  unnecessary  to<br \/>\nexamine\t them.\t On March 11, 1999, when the matter came  up<br \/>\nbefore\tus,  we heard the learned counsel on both  sides  at<br \/>\nlength and felt that considering the special features of the<br \/>\ncase,  it  would be appropriate for the State Government  to<br \/>\nframe  a  scheme  to  absorb   the  respondents\t and   other<br \/>\nemployees,  who\t were  similarly placed and  who  have\tbeen<br \/>\nretrenched.   On the commencement of the census\t operations,<br \/>\npersons\t who  have registered themselves in  the  employment<br \/>\nexchange  get  jobs in that Department.\t However,  when\t the<br \/>\nproject\t is over, their employment would come to an end\t and<br \/>\nthey  are retrenched thereby losing both the employment\t and<br \/>\ntheir  position\t in  the queue in the  employment  exchange.<br \/>\nBearing\t this  aspect in mind, the Government was  asked  to<br \/>\nwork   out   an\t  appropriate\t scheme.    Now,   Shri\t  V.\n<\/p>\n<p id=\"p_2\">Krishnamurthy,\tthe learned counsel for the appellants,\t has<br \/>\nbrought to our notice that the appellant has issued an order<br \/>\nG.O.Ms.No.144  dated 11.8.99 which takes note of the various<br \/>\naspects\t to which we have adverted to earlier for absorption<br \/>\nof the respondents subject to the following conditions:\n<\/p>\n<p id=\"p_3\">      (i) Retrenched employees of the Census Organisation in<br \/>\nTamil Nadu with not less than six months service were placed<br \/>\nin  priority  (iii)  list  under Group\tIII  for  employment<br \/>\nassistance  through Employment Exchanges.  (ii) A period  of<br \/>\nthree  years  was ordered to be excluded in computing  their<br \/>\nage  for  appointment through the Tamil Nadu Public  Service<br \/>\nCommission  and the Employment Exchanges, provided they\t had<br \/>\nrendered  temporary  service of at least six months  in\t the<br \/>\nCensus\tOrganisation  of  this\tState.\t(iii)  The  rule  of<br \/>\nreservation was to be following in making the appointment of<br \/>\nretrenched census employees.\n<\/p>\n<p id=\"p_4\">      However,\tit  is\tbrought\t to   our  notice  that\t the<br \/>\ncondition  in clause (i) above would impose hardship on\t the<br \/>\nrespondents  if they are to be placed in Group III and\tthey<br \/>\nhad  to\t be  placed in Group IV, condition  in\tclause\t(ii)<br \/>\ncannot\tbe  worked out at all because even if the period  of<br \/>\nthree  years stated therein is excluded the appellants\twill<br \/>\nnot  get any benefit because their services had been put  to<br \/>\nan  end\t in the year 1992 and over seven years have  elapsed<br \/>\nsince then and, therefore, they cannot fulfil that condition<br \/>\nat  all.   In  the  circumstances,   we\t direct\t the   State<br \/>\nGovernment  to\tmodify\tthe scheme in respect of  these\t two<br \/>\nconditions.    It  would  be   appropriate  for\t the   State<br \/>\nGovernment  to delete these two conditions and all that\t may<br \/>\nbe  insisted  upon is that the retrenched employees  of\t the<br \/>\nCensus\tDepartment  should  be placed in Group\tIV  and\t the<br \/>\ncondition  relating  to\t the exclusion of three\t years\tfrom<br \/>\ntheir  age shall be deleted.  Subject to this  modification,<br \/>\nthe  scheme  proposed by the State Government may be  worked<br \/>\nout so as to absorb the respondents in services of the State<br \/>\nGovernment  or\tin any of the Local Authority or  Government<br \/>\nundertakings   as  may\tbe   feasible  as  expeditiously  as<br \/>\npossible.
