The sale deed is fraud and<br \/>\n\ttherefore, Sub Registrar has power to decline the registration.  It<br \/>\n\thas been submitted that therefore, this Court may entertain the<br \/>\n\tpetition and may not relegate the petitioner to approach before the<br \/>\n\tCivil Court.\n<\/p>\n<p id=\"p_3\">It<br \/>\n\tdeserves to be recorded that the subject matter of the petition is<br \/>\n\tessentially a dispute between the private parties namely the<br \/>\n\tpetitioner on the one hand and the executor of the document of sale<br \/>\n\tdeed.  Whether the power of attorney is genuine or not or as to<br \/>\n\twhether the original author of the power of attorney executed the<br \/>\n\tpower of attorney or not and that power is properly exercised or not<br \/>\n\tare essentially the dispute between the private parties which can<br \/>\n\tnot be conveniently gone into this petition under <a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a> of the<br \/>\n\tConstitution of India.  So far as the action of the Sub Registrar<br \/>\n\tfor registration of the document is concerned, in normal<br \/>\n\tcircumstances, if the document is properly presented before him and<br \/>\n\tis properly stamped, he would be required to accept the document for<br \/>\n\tregistration unless there is any prohibitory order of competent<br \/>\n\tauthority or of the competent forum.\n<\/p>\n<p id=\"p_4\">If<br \/>\n\tthe petitioner has any grievance about the genuineness of the power<br \/>\n\tof attorney or the power of attorney is not executed by the author<br \/>\n\tor that the sale deed is executed by way of playing fraud, the<br \/>\n\tpetitioner has to resort to the appropriate proceedings before the<br \/>\n\tCivil Court where such question can be conveniently examined and the<br \/>\n\trights can be crystallized between the private parties.  The<br \/>\n\tcontention of the learned advocate that Sub Registrar has power to<br \/>\n\trefuse registration on the alleged ground of no genuineness of the<br \/>\n\tpower of attorney or that the author of the power of attorney did<br \/>\n\tnot execute the power of attorney, cannot be entertained by Sub<br \/>\n\tRegistrar while accepting the document presented for registration.<br \/>\n\tIt is essentially a dispute between the private parties and the<br \/>\n\tCivil Court can only conveniently said issues.  Therefore, the<br \/>\n\tpresent petition is not maintainable.\n<\/p>\n<p id=\"p_5\">The<br \/>\n\tlearned counsel for the petitioner attempted to rely upon the<br \/>\n\tdecision of Gauhati High Court in the case of <a href=\"\/doc\/919736\/\" id=\"a_1\">New India Assurance<br \/>\n\tCo. Ltd. vs. Member, Motor Accidents Claims Tribunal, Gauhati and<br \/>\n\tothers<\/a>, reported in 2007 SCJ 1360, by contending that the petition<br \/>\n\twould be maintainable if it involves the question of fraud.  It was<br \/>\n\tsubmitted that such fraud would vitiate other action and therefore,<br \/>\n\tthe writ can be maintained.\n<\/p>\n<p id=\"p_6\">I<br \/>\n\tam afraid such contention can be accepted on the ground as sought to<br \/>\n\tbe canvased.  The award obtained by fraud in the proceedings of the<br \/>\n\tCourt would stand on different footing with sale deed executed by<br \/>\n\tprivate parties.  Therefore,  the said decision is of no help to the<br \/>\n\tpetitioner.\n<\/p>\n<p id=\"p_7\">In<br \/>\n\tview of the above, as the petitioner has the remedy for ventilating<br \/>\n\tthe grievances by approaching before the Civil Court, the present<br \/>\n\tpetition can not be entertained.  The same is disposed of<br \/>\n\taccordingly.
