Appellant\n\n\n                         Vs..\n\n\n1.The Joint Commissioner,\n   Hindu Religious and Charitable\n   Endowments Department,\n   Kancheepuram.\n\n2.The Assistant Commissioner,\n   Hindu Religious and Charitable\n   Endowments Department,\n   Kancheepuram.\n\n3.The Executive Officer,\n   Arulmigu Ekambaranathar\n   Thirukovil, Chengalpattu.                   ..Respondents\n\n\n\n     Writ Appeal filed under Clause 15 of the Letters Patent\nAppeal  against  the  order passed in W.P.No.32223  of  2002\ndated 07.08.2002.\n\n          For Appellant       : Mr.Pon Ramkumar for\n                                Mrs.AL.Ganthimathi\n\n          For respondents     : Mr.P.Subramanian,\n          1 &amp; 2                 Government Advocate\n\n          For 3rd respondent : Mr.T.Thirumaran\n                              \n\n\n                          JUDGMENT\n<\/pre>\n<p id=\"p_1\">     (Judgment of the Court was delivered by P.SATHASIVAM,J.)<\/p>\n<p>      The  above writ appeal is directed against  the  order<\/p>\n<p>dated  07.08.2002  made in W.P.No.32223 of 2002, in  and  by<\/p>\n<p>which,  the  learned  single Judge has  dismissed  the  writ<\/p>\n<p>petition  at  the admission stage, with liberty  to  file  a<\/p>\n<p>revision or regular civil suit.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">      2..  Heard   the  learned counsel  appearing  for  the<\/p>\n<p>appellant as well as the   respondents.<\/p>\n<p id=\"p_3\">      3.  On  going through the relief prayed  for  and  the<\/p>\n<p>proceedings of the first respondent dated 22.07.2002 as well<\/p>\n<p>as  the  order of the learned single Judge dated 07.08.2002,<\/p>\n<p>we  are  of  the view that absolutely there is no ground  to<\/p>\n<p>interfere  with the said order.  The learned  single  judge,<\/p>\n<p>after  finding  that  the  impugned  proceedings  cannot  be<\/p>\n<p>canvassed  by  way of writ proceedings,  has  permitted  the<\/p>\n<p>writ  petitioner either to file a revision or a  civil  suit<\/p>\n<p>before  the  appropriate  forum.   Unfortunately,  the  writ<\/p>\n<p>petitioner, instead of availing such remedy, has  filed  the<\/p>\n<p>above writ appeal and obtained an order of stay.<\/p>\n<p id=\"p_4\">      4.   In view of the grievance expressed by the   third<\/p>\n<p>respondent,  which  is  clear  from  the  counter  affidavit<\/p>\n<p>dated  03.02.2004, we are not inclined to show  any  further<\/p>\n<p>indulgence  in  favour of the appellant.  Consequently,  the<\/p>\n<p>writ appeal fails and the same is dismissed.   However it is<\/p>\n<p>for the appellant to work out his remedy as per the order of<\/p>\n<p>the  learned single Judge dated 07.08.2002, if the  same  is<\/p>\n<p>permissible at this juncture.
