ORAL JUDGEMENT<\/p>\n
     Instead of taking Civil Application No.477 of
\n     2005 for hearing, with the consent of both the parties,
\n     the main Special Civil Application is taken up for final
\n hearing.\n<\/p>\n
2The petitioner has prayed for an appropriate
\ndirection directing the respondents to issue Advance
\nRoyalty Collection Triplicate Passbook to the petitioner
\nsince, as per the petitioner, the lease is deemed to have
\nbeen extended in light of Rule 18 of the Gujarat Minor
\nand Minerals Rules, 1966 (hereinafter referred to as “the
\nRules”)   till   respondent   no.2   –   Collector takes
\nappropriate decision.\n<\/p>\n
3Upon hearing Mr Desai, learned counsel for the
\npetitioner, and Mr Pradip Bhate, learned AGP, for the
\nrespondents, it appears that there is no dispute on the
\npoint that the Director of the Geology in Appeal as per
\nthe order dated 30th June, 2003 set aside the order of
\nthe Collector rejecting the application for renewal of
\nthe licence and directed for reconsideration of the
\nmatter   after giving opportunity of hearing to the
\npetitioner. There is also no dispute on the point that
\nearlier as per the order dated 16th October, 2002 the
\nDistrict Collector rejected the application of        the
\npetitioner for renewal of the licence.        The ground
\nconsidered by the District Collector was that as the
\ntotal period of 12 years is over, as per Rule 18(4), the
\nrenewal cannot be made and the another ground was that
\nsince last two years the petitioner has not excavated the
\nmineral.    The   Director   of   Geology   in appellate
\njurisdiction found that it is not that in every case the
\nlease cannot be renewed after expiry of 12 years but it
\nhas been observed that if there is sufficient mineral and
\nif the lessee is ready to comply with the conditions, the
\nmatter can be considered for extension and for such
\npurpose reference is made to the instructions dated
\n22.3.1993 issued by the competent authority of the State
\nGovernment.   It is an admitted position that uptil now
\nthe District Collector after the remand has not taken any
\ndecision either to renew the lease of the petitioner or
\nto reject the said application and it has been submitted
\nthat the matter is pending before the District Collector.\n<\/p>\n
4Mr Desai, learned advocate for the petitioner,
\nhowever, submitted that as per Rule 18 if the renewal
\napplication is pending, the petitioner is entitled to
\nbenefit of deeming fiction and it is obligatory on the
\npart of the respondent-authority to issue Advance Royalty
\nCollection Triplicate Passbook to the petitioner and the
\npetitioner is entitled to proceed on the basis that the
\nlease is in operation.\n<\/p>\n
5Considering the facts and   circumstances   of   the
\n case, I find that in case if the authority has taken the
\ndecision of not to allot Advance Royalty Collection
\nTriplicate    Passbook    to   the   petitioner   pending
\nconsideration of the matter by the District Collector
\nafter remand, such an approach on the part of the
\nauthority cannot be said to be unreasonable or arbitrary.
\nHowever, at the same time, it would be expected of the
\nDistrict Collector to take appropriate decision in the
\nmatter and issue cannot be kept hanging for an indefinite
\nperiod. The matter is remanded by the Director of
\nGeology since 30th June, 2003 and as the matter is uptil
\nnow not decided by the District Collector, I find that
\nconsidering the facts and circumstances of the case, the
\nDistrict Collector should be directed to take appropriate
\ndecision on the renewal application of the petitioner as
\nearly as possible, preferably within a period of one
\nmonth from the date of receipt of order of this Court.\n<\/p>\n
6Hence, the relief prayed for by the petitioner to
\nallot the Advance Royalty Collection Triplicate Passbook
\npending the consideration of the matter by the District
\nCollector after remand is not granted but, the District
\nCollector is directed to take appropriate decision in
\naccordance with law upon the       application   of   the
\npetitioner for renewal of the licence as early as
\npossible, preferably within one month from the date of
\nreceipt of order of this Court. It is made clear that
\nthe District Collector shall be at liberty to decide the
\nmatter independently without being influenced by the
\norder of this Court for refusing the prayer for allotment
\nof Advance Royalty Collection Triplicate Passbook to the
\npetitioner for the interregnum period.\n<\/p>\n
7The petition stands disposed of accordingly.\n<\/p>\n
8In view of the order passed in the main Special
\nCivil Application, Civil Application No.477 of 2005 does
\nnot   survive   and   hence   the same is disposed of
\naccordingly.\n<\/p>\n
