No.26893 of 2011\n                           Ram Lakhan Mahto, son of Jagdish Mahto\n                                             Versus\n                                     The State Of Bihar\n                                           -----------\n<\/pre>\n<p>2.   18.08.2011                  Heard learned counsel for the petitioner and the<\/p>\n<p>                  State.\n<\/p>\n<p>                                 The petitioner seeks bail in a case instituted for<\/p>\n<p>                  the offence under Sections 376\/511 of the Indian Penal Code.<\/p>\n<p>                                 It has been submitted that the Complainant is the<\/p>\n<p>                  agnate of the petitioner and subsequently she compromised<\/p>\n<p>                  the matter with the accused persons.\n<\/p>\n<p>                               Considering the same, let the petitioner above<\/p>\n<p>                  named, be released on bail on furnishing bail bond of Rs.<\/p>\n<p>                  5,000\/- (Five thousand) with two sureties of the like amount<\/p>\n<p>                  each or any other surety to be fixed by the court concerned to<\/p>\n<p>                  the satisfaction of Chief Judicial Magistrate, Aurangabad, in<\/p>\n<p>                  connection with Madanpur P.S. Case No. 81 of 2009 subject to<\/p>\n<p>                  the following conditions: (i) That one of the bailors will be a<\/p>\n<p>                  close relative of the petitioner, who will give an affidavit giving<\/p>\n<p>                  genealogy as to how he is related with the petitioner. The bailor<\/p>\n<p>                  will undertake to furnish information to the court about any<\/p>\n<p>                  change in the address of the petitioner. (ii) That the affidavit<\/p>\n<p>                  shall clearly state that the petitioner is not an accused in any<\/p>\n<p>                  other case and, if he is, he shall not be released on bail. (iii)<\/p>\n<p>                  That the bailor shall also state on affidavit that he will inform the<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>        court concerned if the petitioner is implicated in any other case<\/p>\n<p>        of similar nature after his release in the present case and<\/p>\n<p>        thereafter the court below will be at liberty to initiate the<\/p>\n<p>        proceeding for cancellation of bail on the ground of misuse. (iv)<\/p>\n<p>        That the petitioner will give an undertaking that he will receive<\/p>\n<p>        the police papers on the given date and be present on date<\/p>\n<p>        fixed for charge and if he fails to do so on two given dates and<\/p>\n<p>        delays the trial in any manner, his bail will be liable to be<\/p>\n<p>        cancelled for reasons of misuse.
