Code. Learned APP has contended that the ground on which<br \/>\n\tthe bail is granted is totally baseless. He has contended that the<br \/>\n\tlearned Judge has ignored the seriousness of the crime in question<br \/>\n\tas the accused were involved in hatching the conspiracy for killing<br \/>\n\tthe victim and were arrested with the weapons. He has contended that<br \/>\n\tthe investigation was carried out by the Investigating Agency, the<br \/>\n\tstatement of witnesses were recorded and the muddamal was also<br \/>\n\tseized and Ravangi Nodh was prepared regarding the muddamal sent to<br \/>\n\tthe Forensic Science Laboratory. He has contended that this is a<br \/>\n\tserious offence and due to the negligent act on the part of the<br \/>\n\tinvestigating agency the respondents &#8211; accused were released<br \/>\n\ton bail. This is an offence against the woman and such offence<br \/>\n\tshould be required to be viewed seriously. He has contended that<br \/>\n\twhen there is direct evidence found against the accused then in that<br \/>\n\tcase, bail should not have been granted by the trial Court.\n<\/p>\n<p id=\"p_3\">I<br \/>\n\thave gone through the papers produced before me and the case diary<br \/>\n\tof the Investigating Officer. I have also heard learned Advocate for<br \/>\n\tthe respondent &#8211; accused.\n<\/p>\n<p id=\"p_4\">The<br \/>\n\tInvestigating Officer, who is also present in the Court, has fairly<br \/>\n\tadmitted that he has committed some mistakes, which is not malafide,<br \/>\n\tbut it is bonafide mistake, and due to such bonafide msitake, he<br \/>\n\tcould not file the charge-sheet in time. Investigating Officer has<br \/>\n\talso submitted that as he was busy with some other work, he could<br \/>\n\tnot send the Ravangi Nodh to the Forensic Science Laboratory, in<br \/>\n\ttime.\n<\/p>\n<p id=\"p_5\">On<br \/>\n\tperusal of the order of the learned Judge, it appears that the<br \/>\n\tlearned Judge has not committed any error in enlarging the<br \/>\n\trespondent &#8211; accused on regular bail. Therefore, I am not<br \/>\n\tinclined to interfere with the order passed by the Sessions Court.<br \/>\n\tHence, this application is dismissed.
