M.A.Siddiqui,J.\n\n           Shri Ashok Lalwani , Adv. for petitioner.\n\n           Shri Paritosh Trivedi, Adv.for respondents.\n\n     ORDER RESERVED ON 14\/02\/2011.\n\n     ORDER PASSED ON            21\/02\/2011.\n\n                        ORDER\n<\/pre>\n<p id=\"p_1\">     This petition under <a href=\"\/doc\/1679850\/\" id=\"a_1\">Section 482<\/a> of Cr.P.C. has been<\/p>\n<p>filed by the petitioner to invoke the extra ordinary powers<\/p>\n<p>of this Court to order for DNA test of respondent no.2<\/p>\n<p>Sanju Yadav @ Munna Lal Yadav in proceeding under<\/p>\n<p><a href=\"\/doc\/1056396\/\" id=\"a_1\">Section 125<\/a> Cr.P.C.pending before JMFC, Mandla.<\/p>\n<p>(2) In brief, the petition is that respondent no.1 is not<\/p>\n<p>the wife of petitioner and respondent no.2 is not the<\/p>\n<p>legitimate\/illegitimate son of petitioner.   Proceeding for<\/p>\n<p>maintenance of respondent no.2 is pending before JMFC,<\/p>\n<p>Mandla where n application for DNA test of respondent<\/p>\n<p>no.2 has been filed. On 19.1.10 the application for DNA<\/p>\n<p>test has been rejected by JMFC, Mandla and on revision<\/p>\n<p>by Cri.Revision No.21\/10, on 19.4.10, request for DNA<\/p>\n<p>test has been refused. It is alleged that it is necessary not<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                               -2-<\/span><\/p>\n<p>only for deciding the case, but also to wash off the stigma<\/p>\n<p>of illegitimate child which respondent no.2 has to carry<\/p>\n<p>with him through out his life. Respondent has objected<\/p>\n<p>the test. Aggrieved by the orders, this petition has been<\/p>\n<p>filed by the petitioner.\n<\/p>\n<p id=\"p_1\">(3)   Learned    counsel     for    petitioner   submits   that<\/p>\n<p>petitioner is not the husband of respondent no.1 and he<\/p>\n<p>got declaration through a civil suit and she wrongly filed<\/p>\n<p>a case under <a href=\"\/doc\/1056396\/\" id=\"a_2\">Section 125<\/a> Cr.P.C. not for herself but for<\/p>\n<p>her son Sanju. Petitioner has got acquittal from the<\/p>\n<p>criminal case of rape in ST No. 153\/98 on 22nd<\/p>\n<p>April,1999. He got the decree from civil suit that he is<\/p>\n<p>not the husband of respondent no.1.              Petitioner has<\/p>\n<p>rightly moved application for DNA test of the boy Sanju to<\/p>\n<p>ascertain the paternity, but same has been wrongly<\/p>\n<p>refused by the two Courts below. He prays that direction<\/p>\n<p>to do the DNA test of the boy Sanju may be given.<\/p>\n<p>(4)   Respondents     have    opposed      the   request   and<\/p>\n<p>supported both the orders of the Courts below on the<\/p>\n<p>ground that both are reasoned orders and it has been<\/p>\n<p>rightly discussed that it is the duty of the petitioner to<\/p>\n<p>prove his own case and he cannot make the Court as a<\/p>\n<p>tool to collect the evidence and DNA test is a test which<\/p>\n<p>cannot be ordered against the Will of the person.<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                             -3-<\/span><\/p>\n<p>(5)   Learned counsel for petitioner submitted the case<\/p>\n<p>law of Kerala High Court in <a href=\"\/doc\/597286\/\" id=\"a_3\">Sajeera vs. P.K.Salim<\/a> 2000<\/p>\n<p>Cri.L.J.1208 which has also been relied on by the trial<\/p>\n<p>Court in which it has been held that under <a href=\"\/doc\/817818\/\" id=\"a_4\">Section 112<\/a><\/p>\n<p>of Evidence Act, for evidence of legitimacy and paternity<\/p>\n<p>of child, no one can be compelled to undergo blood test.<\/p>\n<p>Blood test should be conducted only with the consent of<\/p>\n<p>the person.     Learned counsel for petitioner has placed<\/p>\n<p>reliance   on   H.M.Prakash       alias   <a href=\"\/doc\/1502997\/\" id=\"a_5\">Dali   vs.State   of<\/p>\n<p>Karnataka<\/a> 2004 (3) KarLJ 584 which is based on<\/p>\n<p><a href=\"\/doc\/633996\/\" id=\"a_6\">section 53<\/a> of the Cr.P.C. and which is about direction to<\/p>\n<p>the police officer and it has no relevancy with the case in<\/p>\n<p>hand. In C.Rajaram vs. Jothi and another Crl.O.P.No.<\/p>\n<p>35499 of 2007 order of DNA test was given as lady gave<\/p>\n<p>birth to a child before nine months of the marriage. So<\/p>\n<p>this authority is also of no relevance.<\/p>\n<p>(6)   Learned counsel for petitioner has placed reliance<\/p>\n<p>on a decision of Apex Court in Buridi Vanajakshmi vs.<\/p>\n<p>Buridi Venkata Satya Varaha Prasad Gangadhar Rao &amp;<\/p>\n<p>Anr. AIR 2010 AP 172 wherein it has been held that<\/p>\n<p>under <a href=\"\/doc\/590166\/\" id=\"a_7\">Hindu Marriage Act<\/a> for the dispute as to paternity<\/p>\n<p>of child, DNA test could be ordered by the High Court<\/p>\n<p>under its inherent powers, but against it is the authority<\/p>\n<p>of Apex Court <a href=\"\/doc\/1259126\/\" id=\"a_8\">Goutam Kundu vs. State of West Bengal<\/a><br \/>\n<span class=\"hidden_text\" id=\"span_2\">                             -4-<\/span><\/p>\n<p>AIR 1993 SC 2295 wherein it has been held that nobody<\/p>\n<p>can be compelled to give sample of blood for analysis.<\/p>\n<p>Almost similar view has been reiterated in <a href=\"\/doc\/338008\/\" id=\"a_9\">Smt. Selvi &amp;<\/p>\n<p>Ors. vs. State of Karnataka<\/a> AIR 2010 SC 1974 wherein<\/p>\n<p>it has been held that for Narco analysis consent is a<\/p>\n<p>must.\n<\/p>\n<p id=\"p_2\">(7)   <a href=\"\/doc\/505918\/\" id=\"a_10\">In Banarsi Dass vs.       Teeku Dutta (Mrs.) And<\/p>\n<p>Another<\/a> (2005) 4 SCC 449 it has been held that under<\/p>\n<p><a href=\"\/doc\/817818\/\" id=\"a_11\">Section 112<\/a> and <a href=\"\/doc\/750738\/\" id=\"a_12\">4<\/a> of Evidence Act, the conclusiveness of<\/p>\n<p>presumption under S.112 cannot be rebutted by DNA<\/p>\n<p>test. The proof of non-access between the parties to<\/p>\n<p>marriage during the relevant period is the only way to<\/p>\n<p>rebut that presumption and DNA test is not to be<\/p>\n<p>directed as a matter of routine, it is to be directed only in<\/p>\n<p>deserving cases.\n<\/p>\n<p id=\"p_3\">(8)   So, looking to the above circumstances of the case, I<\/p>\n<p>find no ground to invoke the extra ordinary jurisdiction of<\/p>\n<p>this Court under S.482 <a href=\"\/doc\/445276\/\" id=\"a_13\">Cr.P.C<\/a>.
