Justice ANTONY DOMINIC\n\n Dated :06\/10\/2009\n\n O R D E R\n                       ANTONY DOMINIC, J.\n                     ================\n                  W.P.(C) NO. 4230 OF 2007 (C)\n                =====================\n\n           Dated this the 6th day of October, 2009\n\n                         J U D G M E N T\n<\/pre>\n<p id=\"p_1\">      Although notice has been served, there is no appearance on<\/p>\n<p>behalf of the 5th respondent.\n<\/p>\n<p id=\"p_1\">      2.   The case of the petitioner is that the 5th respondent<\/p>\n<p>had obtained a building plan approved by the 3rd respondent<\/p>\n<p>Municipality.   But   however,    he    proceeded    to  undertake<\/p>\n<p>construction in violation of the conditions of building permit. It is<\/p>\n<p>stated that this was complained to the Municipality which issued a<\/p>\n<p>provisional order under Section 406 of the Kerala Municipalities<\/p>\n<p>Act. The explanation made by the 5th respondent was not<\/p>\n<p>satisfactory to the Municipality and therefore Municipality<\/p>\n<p>confirmed the provisional order as per Ext.P1.<\/p>\n<p id=\"p_2\">      3.   The 5th respondent did not challenge Ext.P1 and<\/p>\n<p>therefore Ext.P1 order has become final and binding on him. He<\/p>\n<p>did not comply with the said order, but however, it would appear<\/p>\n<p>that on a representation made by him, the Chief Town Planner<\/p>\n<p>made    Ext.P5(2)    recommendation     dated   3\/3\/2006   to   the<\/p>\n<p>Government stating that it was only on account of a realignment<\/p>\n<p>WPC 4230\/07<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                :2 :<\/span><\/p>\n<p>of the boundaries of the property that the prescribed set back<\/p>\n<p>could not be fully complied with. It was stated that if the building<\/p>\n<p>has been constructed in compliance with the building permit in all<\/p>\n<p>other respects, the Secretary could regularize the construction.<\/p>\n<p id=\"p_3\">      4.   Acting upon the recommendation of the Chief Town<\/p>\n<p>Planner as above, the Government issued Ext.P5 order dated<\/p>\n<p>11\/5\/2006 requiring the 4th respondent that if the construction is<\/p>\n<p>in compliance with the building permit in all other respects, the<\/p>\n<p>building constructed could be regularized. The recommendation<\/p>\n<p>made by the Chief Town Planner also discloses that the<\/p>\n<p>construction of the building was completed on 14\/2\/2003. As a<\/p>\n<p>result of Ext.P5 order of the Government mentioned above,<\/p>\n<p>further action on Ext.P1 was not taken and it is in these<\/p>\n<p>circumstances this writ petition has been filed by the petitioner.<\/p>\n<p id=\"p_4\">      5.   The only issue that arises for consideration is the<\/p>\n<p>validity of Ext.P5 and the recommendation made by the Chief<\/p>\n<p>Town Planner, which is also enclosed to the same. The<\/p>\n<p>recommendation of the Chief Town Planner is on the basis that<\/p>\n<p>the construction of the building was completed on 14\/2\/2003. He<\/p>\n<p>also accepts the fact that the set back on the northern side is not<\/p>\n<p>WPC 4230\/07<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                :3 :<\/span><\/p>\n<p>in compliance with the conditions of the building permit.<\/p>\n<p>However, he says that if the construction is in compliance with the<\/p>\n<p>building permit in all other respects, the construction could be<\/p>\n<p>regularized in terms of Section 406 of the Kerala Municipalities<\/p>\n<p>Act, 1994. It is acting upon the said recommendation of the Chief<\/p>\n<p>Town Planner that Ext.P5 order has been issued by the<\/p>\n<p>Government.\n<\/p>\n<p id=\"p_5\">     6.    The relevant provision of the <a href=\"\/doc\/1986722\/\" id=\"a_1\">Municipalities Act<\/a><\/p>\n<p>providing for regularization of construction is    <a href=\"\/doc\/1986722\/\" id=\"a_1\">Section 407<\/a>. A<\/p>\n<p>reading of the said section shows that the power under <a href=\"\/doc\/1986722\/\" id=\"a_2\">Section<\/p>\n<p>407<\/a> can be invoked only in respect of any building constructed on<\/p>\n<p>or before 15th of October 1999.     The provisions of the Kerala<\/p>\n<p>Building (Regularization of Unauthorized Construction and Land<\/p>\n<p>Development) Rules, 1999 also defines unauthorised construction<\/p>\n<p>as constructions carried out and completed before 15th of October<\/p>\n<p>1999. The statute thus having fixed a cut off date viz., 15th of<\/p>\n<p>October 1999, unless the construction of the building in question<\/p>\n<p>has been completed before that date, there is no question of any<\/p>\n<p>regularization as recommended by the Chief Town Planner.<\/p>\n<p id=\"p_6\">     7.    In this case, even going by the recommendation of the<\/p>\n<p>WPC 4230\/07<br \/>\n<span class=\"hidden_text\" id=\"span_2\">                                :4 :<\/span><\/p>\n<p>Chief Town Planner, construction of the building was completed<\/p>\n<p>only on 14\/2\/2003. If that be the factual position, there does not<\/p>\n<p>arise any question of regularisation.
