Mr.Nanavati has submitted the dispute in question<br \/>\nis already settled before the Civil Court. He has  submitted that<br \/>\nlooking to the prayer of the Civil Suit filed before the learned<br \/>\nCivil Judge and the contents of the present application and<br \/>\ncomplaint, it is prima facie established that alleged offence was<br \/>\nregistered before the police against the present applicant and then<br \/>\nit is settled between the parities. Hence there is no question of<br \/>\narrest, re-arrest, interrogation or investigation. He has therefore<br \/>\nprayed that the applicant may be granted anticipatory bail.\n<\/p>\n<p>3.\tHeard<br \/>\nMs.Chetna Shah, learned APP for the respondent State. Ms.Shah has<br \/>\nvehemently opposed the present application.\n<\/p>\n<p>4.\tIt appears that<br \/>\ncompromise is made by the parties before the learned Civil Judge and<br \/>\ndispute in question is settled. Having heard learned counsel for the<br \/>\nparties and perusing the record of the case and taking into<br \/>\nconsideration the facts of the case, I am inclined to grant<br \/>\nanticipatory bail to the applicant. This Court has also taken into<br \/>\nconsideration the law laid down by the Apex Court in the case of<br \/>\n<a href=\"\/doc\/1108032\/\">Siddharam Satlingappa Mhetre v. State of Maharashtra &amp; Ors.,<\/a><br \/>\nreported in (2011) 1 SCC 694, wherein the Apex Court reiterated<br \/>\nthe law laid down by the Constitutional Bench in the case of Shri<br \/>\nGurubaksh Singh Sibbia &amp; Ors., reported in (1980) 2 SCC 565.\n<\/p>\n<p>5.\tThe application is<br \/>\nallowed. The applicant is granted anticipatory bail in the event of<br \/>\nhis arrest in connection with CR No. I-791 of 2007 registered<br \/>\nwith  Amraiwadi Police Station for the offences as alleged in FIR on<br \/>\nhis executing a bond of Rs.10,000\/- [Rupees Ten thousand only] with<br \/>\none surety of the like amount on the following conditions that he<br \/>\nshall:\n<\/p>\n<p>[a]\tco-operate with the<br \/>\ninvestigation and make himself available for interrogation whenever<br \/>\nand wherever required.\n<\/p>\n<p>[b]\tshall remain present<br \/>\nat the concerned Police Station on 11.11.2011 at 11.00 AM ;\n<\/p>\n<p>[c]\tshall not hamper the<br \/>\ninvestigation in any manner nor shall directly or indirectly make any<br \/>\ninducement, threat or promise to any person acquainted with the facts<br \/>\nof the case so as to dissuade him from disclosing such facts to the<br \/>\nCourt or to any police officer;\n<\/p>\n<p>[d]\tat the time of<br \/>\nexecution of bond, furnish him residential address to the<br \/>\ninvestigating officer and the Court concerned and shall not change<br \/>\nthe residence till the final disposal of the case or till further<br \/>\norders;\n<\/p>\n<p>[e]\tnot leave State of<br \/>\nGujarat without the permission of the Court and, if holding a<br \/>\npassport, he shall surrender the same before the Trial Court within a<br \/>\nweek;\n<\/p>\n<p>[f]\tnot obstruct or hamper<br \/>\nthe police investigation and not play mischief with the evidence<br \/>\ncollected or yet to be collected by the police;\n<\/p>\n<p>6.\tIt would be open to the<br \/>\nInvestigating Officer to file an application for remand if he<br \/>\nconsiders it proper and just;
