SOLANKI - Respondent(s)\n \n\n======================================\n \nAppearance : \nMR\nMITUL K SHELAT for Petitioner(s) : 1, \nMR JS BRAHMBHATT for\nRespondent(s) : 1, \n====================================== \n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 21\/07\/2010 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p id=\"p_1\">1.\tThe<br \/>\npetitioner has prayed to quash and set aside the judgement and award<br \/>\ndated 31st January 2003 passed by Industrial Tribunal,<br \/>\nAhmedabad in Reference I.T. No.163 of 1998.\n<\/p>\n<p id=\"p_1\">2.\tThe<br \/>\nrespondent herein was serving as Conductor in the petitioner<br \/>\nCorporation. It was alleged that when he was on duty between Arneg<br \/>\nand Bavra, he permitted one lady passenger to travel from Gangad to<br \/>\nBavra without issuance of ticket and when the checking inspector<br \/>\nsought explanation the respondent attempted to assault the checking<br \/>\ninspector with ticket tray. It was also alleged that he had abused<br \/>\nthe members of the squad. Departmental inquiry was initiated which<br \/>\nresulted in punishment of reduction in pay scale by five steps. In<br \/>\nthe appeal filed by the respondent the said punishment was reduced to<br \/>\nreduction in pay scale by four steps. The second  appellate authority<br \/>\nreduced the punishment further by reducing the pay scale to two<br \/>\nstages instead of four and withholding back wages. The respondent<br \/>\ntherefore raised industrial dispute which was numbered as  Reference<br \/>\nI.T. No.163 of 1998. The Tribunal modified the order of the second<br \/>\nappellate authority by setting aside the  punishment except the part<br \/>\nof back wages.\n<\/p>\n<p id=\"p_2\">3.\tHeard<br \/>\nthe learned Advocates for the parties at length and perused the<br \/>\nrelevant documents on record. As a result of this exercise it is<br \/>\nfound from the record that the alleged misconduct on the part of the<br \/>\nrespondent was proved beyond doubt.  Apart from this there were 30<br \/>\npast defaults against the very same respondent. It was also noticed<br \/>\nthat when explanation was sought the respondent has even tried to<br \/>\nassault the authority which is a serious misconduct. Looking to the<br \/>\noverall facts and circumstances of the case and also the past<br \/>\ndefaults, I am of the view that the punishment imposed upon the<br \/>\nsecond appellate authority was just and proper and the Tribunal has<br \/>\nclearly committed an error in setting aside the said order.\n<\/p>\n<p id=\"p_3\">4.\tIn<br \/>\nthe premises aforesaid, the impugned judgement and award of the<br \/>\nIndustrial Tribunal, Ahmedabad passed in Reference I.T. no.163 of<br \/>\n1998 is hereby quashed and set aside. The order of second appellate<br \/>\nauthority is restored.
