The applicant accused had<br \/>\nearlier filed Criminal Misc. Application No. 9566 of 2010.\n<\/p>\n<p id=\"p_1\">2.\tThe<br \/>\napplicant accused is charged with having committed offence under<br \/>\n<a href=\"\/doc\/619940\/\" id=\"a_1\">Sections 363<\/a>, <a href=\"\/doc\/695990\/\" id=\"a_2\">364<\/a>, <a href=\"\/doc\/37788\/\" id=\"a_3\">34<\/a>, <a href=\"\/doc\/1560742\/\" id=\"a_4\">302<\/a> and <a href=\"\/doc\/386021\/\" id=\"a_5\">201<\/a> of the Indian Penal Code for which<br \/>\nFIR being I C.R.No. 287 of 2010 has been registered with Makarpura<br \/>\nPolice Station, District: Vadodara.\n<\/p>\n<p id=\"p_2\">3.\tLearned<br \/>\ncounsel Mr. B.S.Patel submitted that considering the nature of<br \/>\noffence and the role attributed by the applicant with regard to<br \/>\ndestroying the evidence or tampering with the evidence, at the most,<br \/>\nthe offence under <a href=\"\/doc\/386021\/\" id=\"a_6\">Section 201<\/a> is attracted. He further submitted that<br \/>\nas now the charge sheet has been filed and the applicant is a female<br \/>\naged about 50 years, she may be released subject to any conditions.\n<\/p>\n<p id=\"p_3\">4.\tLearned<br \/>\nAPP Mr. Sejpal resisted the application and submitted that<br \/>\nconsidering the nature of offence and the manner in which it is<br \/>\nalleged to have been committed, it can even prima facie suggest that<br \/>\nthe offence is not for under <a href=\"\/doc\/386021\/\" id=\"a_7\">section 201<\/a> only. He, therefore,<br \/>\nsubmitted that as the deceased minor child was done to death by the<br \/>\nother co-accused (son of the applicant) and thereafter kept for two<br \/>\ndays and therefore present application may not be entertained merely<br \/>\nbecause the charge-sheet is filed.\n<\/p>\n<p id=\"p_4\">5.\tIn<br \/>\nview of the rival submissions it is required to be considered whether<br \/>\nthe present application can be entertained or not.\n<\/p>\n<p id=\"p_5\">5.1.\tIt<br \/>\nis well accepted that this Court is not required to appreciate and<br \/>\nscrutinize the evidence in detail for deciding the bail application.<br \/>\nHowever, for considering the prima facie case, the relevant aspects<br \/>\nlike, nature of offence, manner in which it is alleged to have been<br \/>\ncommitted, role attributed and weapon used, are required to be<br \/>\nconsidered. In the facts of the present case, the applicant, prima<br \/>\nfacie,  cannot be said to have not involved as the evidence prima<br \/>\nfacie suggests the involvement of the applicant in the offence and<br \/>\ntherefore the submissions made by learned counsel Mr. B.S.Patel<br \/>\nregarding her role cannot be readily accepted. However, considering<br \/>\nthe guidelines<br \/>\nwith regard to grant of bail as laid down by the Hon&#8217;ble Apex Court<br \/>\nin the judgment reported in AIR<br \/>\n2005 716<br \/>\nin the case of Jayendra<br \/>\nSarawathi Swamigal V\/s. State of Tamil Nadu as<br \/>\nwell as (2005)8 SCC 21<br \/>\nin the case of State of U.P<br \/>\nthrough CBI V\/s. Amarmani Tripathi<br \/>\nand also considering the fact that the applicant is a female, only on<br \/>\nthat ground, present application deserves to be allowed subject to<br \/>\nthe following conditions.\n<\/p>\n<p id=\"p_6\">6.\tAccordingly,<br \/>\n\tpresent application stands allowed. The applicant is ordered to be<br \/>\n\treleased on regular bail in connection with F.I.R. being I C.R.No.<br \/>\n\t287 of 2010 registered with Makarpura Police Station, District:<br \/>\n\tVadodara, on her executing a bond of Rs.5,000\/- (Rupees Five<br \/>\n\tThousand) with one solvent surety of the like amount to the<br \/>\n\tsatisfaction of the lower Court and subject to the conditions that<br \/>\n\tshe shall:\n<\/p>\n<p id=\"p_7\">(a)\tnot<br \/>\ntake undue advantage of her liberty or abuse her liberty.\n<\/p>\n<p id=\"p_8\">(b)\tnot<br \/>\nto try to tamper or pressurize the prosecution witnesses or<br \/>\ncomplainant in any manner.\n<\/p>\n<p id=\"p_9\">(c)\tnot<br \/>\nact in any manner injurious to the interest of the prosecution.\n<\/p>\n<p id=\"p_10\">(d)\tmaintain<br \/>\nlaw and order and should cooperate with the investigating officers.\n<\/p>\n<p id=\"p_11\">(e)\tfurnish<br \/>\nthe address of her residence to the Investigating Officer and also to<br \/>\nthe Court at the time of execution of the bond and shall not change<br \/>\nher residence without prior permission of the Court.\n<\/p>\n<p id=\"p_12\">(f)\tsurrender<br \/>\nher passport, if any, to the lower Court, within a week.\n<\/p>\n<p id=\"p_13\">7.\tIf<br \/>\n\tbreach of any of the above conditions is committed, the concerned<br \/>\n\tSessions Judge will be  free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p id=\"p_14\">8.\tBail<br \/>\n\tbefore the lower Court having jurisdiction to try the case. It would<br \/>\n\tbe open to the trial Court concerned to give time to furnish the<br \/>\n\tsolvency certificate if prayed for.\n<\/p>\n<p id=\"p_15\">9.\tRule<br \/>\n\tis made absolute to the aforesaid   extent.
