Rana, Advocate\n         for the appellant.\n\n         Mr. Mehardeep Singh, Assistant Advocate\n         General, Punjab, for the State\n\n\nKanwaljit Singh Ahluwalia, J. (Oral)\n<\/pre>\n<p>         The present appeal was filed by Mohinder Kaur alias Mindo.<\/p>\n<p>This appeal was accepted and Mohinder Kaur alias Mindo was acquitted<\/p>\n<p>by this Court vide order dated 30.10.2007. Co-accused Chuhar Singh<\/p>\n<p>had died during trial and regarding his death response was sought from<\/p>\n<p>Advocate General, Punjab.\n<\/p>\n<p>         An affidavit has been filed along with a Magisterial Enquiry<\/p>\n<p>conducted by the Sub Divisional Magistrate-cum-Enquiry Officer,<\/p>\n<p>Hoshiarpur. The wife and daughter of Chuhar Singh, deceased, had<\/p>\n<p>absolved Kapoor Singh, Assistant Sub Inspector.          A very detailed<\/p>\n<p>enquiry has been conducted running into 22 pages and it has been held<\/p>\n<p>that the cause of death of Chuhar Singh was not torture or beating given<br \/>\n<span class=\"hidden_text\"> Criminal Appeal No. 1232-SB of 2003                                2<\/span><\/p>\n<p>by Mahilpur Police but the cause of death in this case was hemorrhage<\/p>\n<p>and shock and respiratory failure due to bleeding duodenal ulcer and<\/p>\n<p>ulcerative gastritis and chronic supparative lung disease and empyema.<\/p>\n<p>The evidence of pre-existing suppurative lung disease crdiomegaly and<\/p>\n<p>hepatomegaly contributed to his morbidity and mortality.<\/p>\n<p>         The     Sub    Divisional    Magistrate-cum-Enquiry   Officer,<\/p>\n<p>Hoshiarpur, has further held as under:-\n<\/p>\n<blockquote><p>                             &#8220;It is evident from the record that on<\/p>\n<p>                   9.9.2000 at 4.00 P.M. Sh. Chuhar Singh was<\/p>\n<p>                   brought by ASI Kapoor Singh and his police party<\/p>\n<p>                   from JIC Amritsar to the Civil Hospital, Hoshiarpur,<\/p>\n<p>                   where Dr. Harindejit Singh Garg who was an<\/p>\n<p>                   Emergency Medical Officer at that time examined<\/p>\n<p>                   him and found his pulse and blood pressure<\/p>\n<p>                   unrecordable and his hands and feet were cold.<\/p>\n<p>                   Doctor advised ASI Kapoor Singh to get Sh. Chuhar<\/p>\n<p>                   Singh admitted in the Civil Hospital, but ASI Kapoor<\/p>\n<p>                   Singh did not pay any heed to his advice and took<\/p>\n<p>                   away Chuhar Singh to the Courts where he was to<\/p>\n<p>                   be produced. ASI Kapoor Singh got him admitted in<\/p>\n<p>                   the Civil Hospital, Hoshiarpur, at 5.45 P.M. on<\/p>\n<p>                   9.9.2000 as a result the condition of Sh. Chuhar<\/p>\n<p>                   Singh became bad to worse. Had he admitted Sh.<\/p>\n<p>                   Chuhar Singh in the Hospital at the time, the Doctor<\/p>\n<p>                   had advised him, the life of Sh. Chuhar Singh could<\/p>\n<p>                   have been saved. In view of this, ASI Kapoor Singh<br \/>\n<span class=\"hidden_text\"> Criminal Appeal No. 1232-SB of 2003                                       3<\/span><\/p>\n<p>                      could be held responsible for not providing medical<\/p>\n<p>                      treatment at appropriate time to deceased Sh.<\/p>\n<p>                      Chuhar Singh. ASI Kapoor Singh has not discharged<\/p>\n<p>                      his duty diligently. He has shown irresponsible<\/p>\n<p>                      attitude towards the deceased Sh. Chuhar Singh by<\/p>\n<p>                      not admitting him in the Ciivl Hospital Hoshiarpur at<\/p>\n<p>                      4.00 P.M. on 9.9.2000 for treatment. It is grave<\/p>\n<p>                      carelessness on the part of Govt. official because<\/p>\n<p>                      timely medical treatment could have saved his life. It<\/p>\n<p>                      is recommended that necessary action be taken<\/p>\n<p>                      against him under the provisions of the Police<\/p>\n<p>                      Rules&#8221;.<\/p><\/blockquote>\n<p>         Thereafter, an affidavit has been filed by the Deputy<\/p>\n<p>Superintendent   of     Police,   Garhshankar,    District   Hoshiarpur   on<\/p>\n<p>29.5.2008. It is stated therein that subsequently, statements of Mukhtiar<\/p>\n<p>Singh, nephew of Chuhar Singh, Surjit Kaur, widow and Harjinder Kaur,<\/p>\n<p>daughter of Chuhar Singh have been recorded.         They have stated that<\/p>\n<p>Kapoor Singh, Assistant Sub Inspector, was not responsible.
