      The petitioner is Sree Vidya Vardhakha High School, an<\/p>\n
aided High School, having High School section only. It is stated<\/p>\n
that the school was started in the year 1966. The school is<\/p>\n
situated in R.S.No.30\/6 A of Meenja Village in Kasaragod Taluk.<\/p>\n
It is stated that adjacent to the school compound, larger extent<\/p>\n
of Government properties are available as purampoke land.<\/p>\n
      2.    The petitioner applied to the Government for<\/p>\n
assignment of an extent of 3.78 acres of land. The application<\/p>\n
was routed through the District Educational Officer, Kasaragod.<\/p>\n
It is stated that the Tahsildar and District Collector reported that<\/p>\n
the request made by the petitioner is genuine. The files were<\/p>\n
forwarded to the Land Revenue Commissioner who forwarded<\/p>\n
the same to the Government. It is stated that since the petitioner<\/p>\n
did not get any information, he applied under the Right to<\/p>\n
Information Act<\/a> to the Tahsildar who issued Ext.P1 dated<\/p>\n
WPC No.15559\/2008                 2<\/span><\/p>\n
24.2.2008 to the petitioner stating that the application for<\/p>\n
assignment was rejected by the Land Revenue Commissioner as<\/p>\n
per letter dated 26.12.2007. The petitioner again applied under<\/p>\n
the Right to Information Act<\/a> to the District Collector, Kasaragod<\/p>\n
to supply copy of the letter referred to in Ext.P1. Thereafter, the<\/p>\n
petitioner received Ext.P5 from the District Collector. Ext.P5 is a<\/p>\n
letter issued by the Land Revenue Commissioner to the District<\/p>\n
Collector in which it is stated that the proposal for assignment of<\/p>\n
land was rejected by the Government and the records were sent<\/p>\n
back. The order passed by the Government was not<\/p>\n
communicated along with Ext.P5. It is not produced along with<\/p>\n
the counter affidavit also. It is not known whether the<\/p>\n
Government has properly considered the matter. The contention<\/p>\n
of the petitioner is that he was not heard by any of the<\/p>\n
authorities before rejecting the application for assignment of<\/p>\n
land.\n<\/p>\n
\n
      3.   The prayer in the Writ Petition is to quash Ext.P5<\/p>\n
order and to issue a writ of mandamus commanding the<\/p>\n
Commissioner for Land Revenue to hear the petitioner and pass<\/p>\n

fresh orders. There is also a prayer for declaration that the<\/p>\n
petitioner is entitled to the assignment of an extent of 3.78 acres<\/p>\n
of land.\n<\/p>\n
\n
      4.   The Under Secretary, Revenue Department has filed a<\/p>\n
counter affidavit. In paragraph 2 of the counter affidavit, it is<\/p>\n
stated as follows:\n<\/p>\n
           “The Manager, Vidya Vardhaka High School,<\/p>\n
           Meeyapadavu of Meenja Village had applied<\/p>\n
           for assignment of 3.78 Acres of land in R.S.<\/p>\n
           No. 30\/1 C2, 29\/1B1B3, 30\/1E1A1H and R.S.<\/p><\/blockquote>\n
\n           No.30\/1E1AM of Meenja Village for the<\/p>\n
           purpose of school play ground.       Out of the<\/p>\n
           above 3.78 acres of Land 0.71 Acres of Land in<\/p>\n
           R.S.No.30\/1C1 has already been de-reserved<\/p>\n
           from SC\/ST category to G.A. Category as per<\/p>\n
           District Collectors proceedings No.C2-47084\/86<\/p>\n
           (1) dated 6.6.90.     From the remaining lands<\/p>\n
           measuring 1.74 acres in R.S.No.29\/1B1B3, 1.20<\/p>\n
           acres in R.S.No.30\/1E1A1H and 0.13 acres in<\/p>\n
           RS No.30\/1E1AM of Meenja Village is set apart<\/p>\n
           for public purpose category and which is de-<\/p>\n
           reserved and made available for assignment<\/p>\n
           under GA category and proposed in favour of<\/p>\n
WPC No.15559\/2008                 4<\/span><\/p>\n
           the Manager Vidhya Vardhaka High School<\/p>\n
           Meeyapadavu as per the proceedings No.C2-<\/p>\n
           30102\/04 dated 16.2.2006. These procedures<\/p>\n
           were taken under the provisions of Institutional<\/p>\n
           Assignment Rules, and KLA Act, 1964 in favour<\/p>\n
           of the petitioner of the above Writ Petition.”<\/p><\/blockquote>\n

     5.    From the counter affidavit, it is, prima facie, clear that<\/p>\n
the land is available for assignment. However, in paragraph 5 of<\/p>\n
the counter affidavit, it is stated that the petitioner has no right<\/p>\n
over the property. Paragraph 5 is quoted below:<\/p>\n
                 “The LA proposal submitted in favour of<\/p>\n
           the petitioner was not considered by the<\/p>\n
           Government.       The Government sanction is<\/p>\n
           inevitable     for    the    institutional   Land<\/p>\n
           Assignment. In this case, respondents 2 to 4<\/p>\n
           obeyed the order of the Government and<\/p>\n
           Government decision was conveyed to the<\/p>\n
           petitioner in time. Hence, there is no violation<\/p>\n
           of natural justice and it safeguards the interest<\/p>\n
           of Government. The land under proposal is GA<\/p>\n
           land on the basis of de-reservation proposal.<\/p>\n
           The petitioner has no right over the property,<\/p>\n
           now the Institution is utilising the Government<\/p>\n

           land   without    permission   of   the   fourth<\/p>\n
           respondent and the fourth respondent is<\/p>\n
           responsible for the eviction of encroachment<\/p>\n
           from the Government properties on each and<\/p>\n
           every case reported.”<\/p><\/blockquote>\n

     6.    The application for assignment of land was disposed<\/p>\n
of by the Government under the Kerala Land Assignment Act and<\/p>\n
the relevant rules. There is no record to indicate that the<\/p>\n
Government      considered   the  matter    after   affording  an<\/p>\n
opportunity of being heard to the petitioner and after taking into<\/p>\n
account all the relevant facts.    It is alleged that the report<\/p>\n
submitted by the Tahsildar and the District Collector were also<\/p>\n
not taken note of. There is no speaking order stating reasons for<\/p>\n
rejection of the application submitted by the petitioner. In these<\/p>\n
circumstances, Ext.P5 order is liable to be quashed.<\/p>\n
     7.    For the aforesaid reasons, Ext.P5 letter No.LR(J)6-<\/p>\n
58515\/07(2) dated 26.12.2007 issued by the Land Revenue<\/p>\n
Commissioner is quashed. The Government shall consider the<\/p>\n
application for assignment made by the petitioner afresh, after<\/p>\n

affording an opportunity of being heard to the petitioner and<\/p>\n
after calling for the report of the Tahsildar and the District<\/p>\n
Collector.   All the relevant records shall be placed before the<\/p>\n
Government to enable the Government to take a proper and just<\/p>\n
decision. The Government shall pass final orders within a period<\/p>\n
of three months from the date of receipt of a copy of the<\/p>\n
judgment, after affording an opportunity of being heard to the<\/p>\n
petitioner. The petitioner shall produce copy of the Writ Petition<\/p>\n
along with the exhibits, copy of the counter affidavit and<\/p>\n
certified copy of the judgment before the first respondent.<\/p>\n
      The Writ Petition is allowed as above.\n<\/p>\n
