Hemlata on 11 August, 2010<\/div>\n<pre id=\"pre_1\">                           W.P.No.10431\/2010\n\n     Chhannulal &amp; others                                Smt.Hemlata\n\n\n\n\n11.8.2010<\/pre>\n<p id=\"p_1\">        Shri Vivek Mishra, counsel for petitioners.<br \/>\n        This petition is directed against an order dated 19.1.2010<br \/>\nby the III Civil Judge Class-II, Balaqhat in civil suit no.75-<br \/>\nA\/2009, by which the trial Court while deciding issues no.1 &amp; 2<br \/>\nheld that the plaintiffs have not properly valued the suit, the<br \/>\nplaintiffs are required to value the suit as per valuation of the<br \/>\nsuit property.\n<\/p>\n<p id=\"p_1\">        Learned counsel for petitioners submitted that plaintiffs<br \/>\nwere not party to the sale deed and in view of the settled law<br \/>\nby      this    Court      in     Rameshchandra                &amp;         others   Vs.<br \/>\nJayendrasingh &amp; others [2003(1) MPLJ 379] no ad-valorem<br \/>\nCourt fee was required, the impugned order may be set aside.\n<\/p>\n<p id=\"p_2\">        It is settled law that to ascertain valuation for the<br \/>\npurposes of Court fee averments of the plaint are to be seen.<br \/>\nFrom the perusal of para 7 of the plaint the plaintiff has pleaded<br \/>\nthus :-\n<\/p>\n<blockquote id=\"blockquote_1\"><p>                  &#8220;;g fd jkelgk; tSlk fd n&#8217;kkZ;k x;k gS] fcekjh ls<br \/>\n               ihfMr Fkk rFkk mldh lksp le&gt; Hkh chekjh ls izHkkfor<br \/>\n               Fkh A jkelgk; ds lkFk oknh dza 4 tks fd fof{kIr jgk<br \/>\n               djrk Fkk] ,slk izrhr gksrk gS fd okfn;ksa dh vuqifLFkfr<br \/>\n               esa izfroknh ds ifr Jh fnus&#8217;k ixkfj;k us iM;a= jp dj<br \/>\n               jkelgk; ls mldh vLoLFkrk dk ,oa oknh dzza 4 dk<br \/>\n               fof{kIrrk dk vuqfpr ykHk mBk dj okfn;ksa dh tkudkjh<br \/>\n               ,oa lgefr ds cxSj fodz; i= iaft;r djok fn;k gS A<br \/>\n               jkelgk; us dHkh Hkh fodz; i= esa n&#8217;kkZ; vuqlkj lkB<br \/>\n               gtkj :i;s dh jkf&#8217;k izkIr ugh dh gS A mDr fodz; i=<br \/>\n               loZnk &gt;wBk ,oa fcuk eki tkus dk gS A&#8221;<\/p><\/blockquote>\n<p id=\"p_3\">        The case of plaintiffs is that father of plaintiffs Ramsahay<br \/>\nwas sick and his understanding was also affected by ailment.<br \/>\nAlongwith Ramsahay the plaintiff no.4 who is of unsound mind<br \/>\nwas residing. It appears that in absence of plaintiffs, husband of<br \/>\ndefendant Dinesh Chandra by conspiracy and taking advantage<br \/>\n                            W.P.No.10431\/2010<\/p>\n<p>     Chhannulal &amp; others                         Smt.Hemlata<\/p>\n<p>of sickness of Ramsahay and unsound mind of plaintiff no.4 got<br \/>\nsale deed executed which could not come into the notice of<br \/>\nplaintiffs.     Ramsahay had never received consideration of<br \/>\nRs.60,000\/-.      The      sale   deed   is    false   and   without   any<br \/>\nconsideration. In para 8 the plaintiffs have further pleaded that<br \/>\ndefendant by using undue influence and playing fraud on<br \/>\nRamsahay got executed the sale deed without consideration.\n<\/p>\n<p id=\"p_4\">        The aforesaid fact shows that the sale deed was not void,<br \/>\nbut could have been voidable and can be set aside on the basis<br \/>\nof pleading, but once the sale deed is not void then the plaintiffs<br \/>\nare required to value the suit property as per the valuation of<br \/>\nthe sale deed and is further required to pay ad-valorem Court<br \/>\nfee on it. In view of aforesaid, if the trial Court has passed the<br \/>\nimpugned order, no fault is found.\n<\/p>\n<p id=\"p_5\">        So far as judgment of Rameshchandra &amp; others<br \/>\n(supra) is concerned, the learned Single Judge of this Court was<br \/>\nconsidering the case in which the plaintiffs were not party to the<br \/>\nsale deed and the plaintiffs were praying that the sale deed be<br \/>\ndeclared as void. The relief of cancellation of sale deed was not<br \/>\nprayed.
