BASANT, J.\n                 - - - - - - - - - - - - - - - - - - - - - -\n                    B.A.No. 7070 of 2007\n                 - - - - - - - - - - - - - - - - - - - - - -\n           Dated this the 20th day of November, 2007\n\n                              O R D E R\n<\/pre>\n<p id=\"p_1\">      Application for anticipatory bail.             The petitioner faces<\/p>\n<p>allegations under <a href=\"\/doc\/1279834\/\" id=\"a_1\">Section 376<\/a> I.P.C.           The defacto complainant\/<\/p>\n<p>victim was allegedly in love with the petitioner.              There was<\/p>\n<p>promise of marriage. Believing the said promise, the defacto<\/p>\n<p>complainant had allegedly yielded to sexual intercourse with the<\/p>\n<p>petitioner. She became pregnant. Two months after the child<\/p>\n<p>birth the present complaint has been filed. Crime has been<\/p>\n<p>registered.   Investigation is in progress.                 The petitioner<\/p>\n<p>apprehends imminent arrest.\n<\/p>\n<p id=\"p_1\">        2.  The learned counsel for the petitioner prays, the<\/p>\n<p>learned Prosecutor opposes the said prayer, and notwithstanding<\/p>\n<p>the opposition I am satisfied, in the facts and circumstances<\/p>\n<p>referred above, that directions under <a href=\"\/doc\/1783708\/\" id=\"a_1\">Section 438<\/a> Cr.P.C. can be<\/p>\n<p>issued in favour of the petitioner, subject to appropriate terms<\/p>\n<p>B.A.No. 7070 of 2007<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                     2<\/span><\/p>\n<p>and conditions.    More detailed discussion of facts appear to me to be<\/p>\n<p>unnecessary.\n<\/p>\n<p id=\"p_2\">      3. In the result:\n<\/p>\n<p id=\"p_3\">      (1) This application is allowed.\n<\/p>\n<p id=\"p_4\">      (2)   The following directions are issued under <a href=\"\/doc\/1783708\/\" id=\"a_2\">Section 438<\/a><\/p>\n<p>Cr.P.C.\n<\/p>\n<p id=\"p_5\">      (a) The petitioner shall surrender before the learned Magistrate<\/p>\n<p>on 27.11.2007 at 11 a.m. The learned Magistrate shall release the<\/p>\n<p>petitioner on regular bail on condition that he executes a      bond for<\/p>\n<p>Rs.50,000\/- (Rupees fifty thousand only) with two solvent sureties<\/p>\n<p>each for the like sum to the satisfaction of the learned Magistrate.<\/p>\n<p id=\"p_6\">      (b) The petitioner shall make himself available for interrogation<\/p>\n<p>before the Investigating Officer between 10 a.m. and 3 p.m. on<\/p>\n<p>28.11.2007 and 29.11.2007. During this period the petitioner can be<\/p>\n<p>interrogated and all necessary steps in investigation, including the<\/p>\n<p>potency test can be conducted by the Investigating Officer. Thereafter<\/p>\n<p>he shall appear before the Investigating Officer on all Mondays and<\/p>\n<p>Fridays between 10 a.m. and 12 noon for a period of two months and<\/p>\n<p>B.A.No. 7070 of 2007<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                   3<\/span><\/p>\n<p>subsequently as and when directed by the Investigating Officer in<\/p>\n<p>writing to do so.\n<\/p>\n<p id=\"p_7\">      (c)   If the petitioner does not appear before the learned<\/p>\n<p>Magistrate as directed in clause (1) above, these directions shall lapse<\/p>\n<p>on 27.11.07 and the police shall be at liberty thereafter to arrest the<\/p>\n<p>petitioner and deal with him in accordance with law.<\/p>\n<p id=\"p_8\">      (d) If the petitioner were arrested prior to his surrender on<\/p>\n<p>27.11.2007 as directed in clause (1) above, he shall be released on bail<\/p>\n<p>on his executing a bond for Rs.50,000\/-           without any surety<\/p>\n<p>undertaking to appear before the learned Magistrate on 27.11.2007.<\/p>\n<p id=\"p_9\">                                             (R.
