Central Information Commission\n                                                      Both appeals Heard: 22.7.2010\n                                                    Decision announced: 30.7.2010\n\n\n     Facts<\/pre>\n<p id=\"p_1\">:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>              These are two appeals received Shri Vihar Durve of Pawan Vihar, Pune &#8211;<br \/>\n     one stemming from information provided by CPIO Ms. Zoya C.B. of the DOPT<br \/>\n     and the other against the information provided by CPIO Shri Tarun Kumar,<br \/>\n     Central Information Commission. Since both hinge on the same issue, they have<br \/>\n     been clubbed together for hearing.\n<\/p><\/blockquote>\n<p id=\"p_1\">1.            File No. CIC\/WB\/A\/2009\/000545<br \/>\n              In this case, by an application of 18.11.08 addressed to DoPT, received<br \/>\n     by CPIO only on 2.12.08 Shri Vihar Durve applied for the following information:<br \/>\n     1                       &#8220;Inform me and furnish me the name of Authority or<br \/>\n     Ministry who is supposed to evaluate the Sec. 4 of RTI compliance of<br \/>\n     each Govt. Department\/Local Authority?\n<\/p>\n<p id=\"p_2\">     2                       Inform     me      and     furnish    me       the<br \/>\n     method\/procedure\/technique\/parameters how each CIC evaluates the<br \/>\n     Sec. 4 of the RTI compliance?\n<\/p>\n<p id=\"p_3\">     3                       Inform me and furnish me details of Power \/<br \/>\n     authority \/ duty \/ obligations cast on each CIC to evaluate sec. 4 of RTI<br \/>\n     compliance.\n<\/p>\n<p id=\"p_4\">     4                       Inform me and furnish me the advantages of<br \/>\n     evaluating sec. 4 compliance of RTI to RTI applicant and Govt.<br \/>\n     Department or Local Authorities.\n<\/p>\n<p id=\"p_5\">     5                       Inform me and furnish me the disadvantages of<br \/>\n     evaluating sec. 4 compliance of RTI to RTI applicant and Govt.<br \/>\n     Department or Local Authorities.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                                1<\/span><\/p>\n<p id=\"p_6\"> 6                       Inform me and furnish me effect of evaluating sec. 4<br \/>\ncompliance of RTI on India&#8217;s Transparency &amp; Corruption Index or taking<br \/>\nRTI to its logical conclusion.\n<\/p>\n<p id=\"p_7\">7                       Inform me and furnish me effect of not evaluating<br \/>\nsec. 4 compliance of RTI on India&#8217;s Transparency &amp; Corruption Index or<br \/>\ntaking RTI to its logical conclusion.\n<\/p>\n<p id=\"p_8\">8                       Inform me and furnish me effect of evaluating sec. 4<br \/>\ncompliance of RTI on Global Warming or taking RTI to its logical<br \/>\nconclusion.\n<\/p>\n<p id=\"p_9\">9                       Inform me and furnish me effect of not evaluating<br \/>\nsec. 4 compliance of RTI on Global Warming or taking RTI to its logical<br \/>\nconclusion.\n<\/p>\n<p id=\"p_10\">10                      Inform me and furnish me the budgetary provisions<br \/>\nmeant for conducting yearly RTI Conclave by CIC.<\/p>\n<pre id=\"pre_1\">\n11                      Inform me and furnish me the cost of conducting\nyearly Conclave by CICs\n12                      Inform me and furnish me when will CIC,\n<\/pre>\n<p id=\"p_11\">compliance of Sec. 4 of RTI by yearly RTI compliance?<br \/>\n13                      Inform me name of person who is supposed to<br \/>\ndisseminate above information on CIC&#8217;s website?             Why it is not<br \/>\npublished? When will it be published<\/p>\n<p>      To this, he received pointwise reply dated 23.12.08 from CPIO Ms. Zoya<br \/>\nC.B., U.S. (RTI) informing him as follows:\n<\/p>\n<blockquote id=\"blockquote_1\"><p>      &#8220;Point No. 1 &amp; 2: Under Sec. 25(2) of the Act, the CIC may ask a<br \/>\n      public authority in relation to the exercise of its function under this<br \/>\n      Act does not conform with the provisions or spirit of this Act, it may<br \/>\n      give to the authority a recommendation specifying the steps which<br \/>\n      ought in its opinion to be taken for promoting such conformity.<br \/>\n      Point No. 3: Powers &amp; functions of the CIC and the State<br \/>\n      Information Commissions are given under sec. 18 of the <a href=\"\/doc\/671631\/\" id=\"a_1\">RTI Act<\/a>,<br \/>\n      2005.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>             Point No. 4 &amp; 5: Does not form part of information.<br \/>\n      Point No. 6 to 9: Information is not available with the CPIO<br \/>\n      Point No. 10: There are no separate provisions for the same.<br \/>\n      Point No. 11: Pertains to Central Information Commission.<br \/>\n      Point No. 12: Information is not available.<br \/>\n      Point No. 13: Pertains to Central Information Commission.&#8221;<\/p><\/blockquote>\n<p id=\"p_12\">      Aggrieved by this response, for the reasons mentioned in his appeal, Shri<br \/>\nDurve moved an appeal before Ms. Anuradha Chagti, D.S., DOPT contesting<br \/>\neach point as below:\n<\/p>\n<blockquote id=\"blockquote_3\"><p>      Point No1<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                        2<\/span><br \/>\n       &#8220;1.      My appeal point: CPIO, CIC of India vide letter no.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>               CIC\/CPIO\/2008\/1278 dated 27th Oct., 2008 has informed me<br \/>\n               that Nodal Agency for monitoring Sec. 4 of RTI is Ministry of<br \/>\n               Personnel, Public Grievance &amp; Pensions, Department of<br \/>\n               Personnel &amp; Training (attached herewith)<br \/>\n               Therefore,\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_5\"><p>               1) CPIO be directed to furnish me correct information and<br \/>\n                      furnish me supporting documents which states that<br \/>\n                      CIC of India is Nodal Agency to monitor sec. 4 of RTI.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_6\"><p>               2) Also CPIO be directed to be specific about what is meant<br \/>\n                      by SPIRIT of RTI Act.\n<\/p><\/blockquote>\n<p id=\"p_13\">Point No 2\n<\/p>\n<p id=\"p_14\">      2. My appeal point:      CPIO, CIC of India vide letter no.\n<\/p>\n<p id=\"p_15\">            CIC\/CPIO\/2008\/1278 dated 27 Oct 2008 has informed me<br \/>\n            that Nodal Agency for monitoring Sec. 4 of RTI is Ministry of<br \/>\n            Personnel, Public Grievance &amp; Pensions, DOPT (attached)<br \/>\n            herewith<br \/>\n           Therefore\n<\/p>\n<p id=\"p_16\">1.                  CPIO be directed to furnish me correct information<br \/>\nand furnish me supporting documents which states that CIC of India is<br \/>\nNodal Agency to Monitor Sec. 4 of RTI.\n<\/p>\n<p id=\"p_17\">2.                  Also CPIO be directed to be specific about what is<br \/>\nmeant by Spirit of RTI Act.\n<\/p>\n<p id=\"p_18\">3.                  CPIO be directed to inform me in detail the method \/<br \/>\nprocedure \/ technique \/ parameters how each CIC evaluates the sec. 4 of<br \/>\nRTI compliance.\n<\/p>\n<p id=\"p_19\">Point No 3\n<\/p>\n<p id=\"p_20\">      3. My Appeal point: CPIO be directed to furnish me correct<br \/>\n            information about obligation cast on each CIC to evaluate<br \/>\n            sec. 4 of RTI compliance.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_2\">Point No. 5<\/span><\/p>\n<p id=\"p_21\">      4. My appeal point: CPIO can&#8217;t interpret what comes under RTI &amp;<br \/>\n           what does not interpretation of <a href=\"\/doc\/671631\/\" id=\"a_2\">RTI Act<\/a> is sole discretion of<br \/>\n           Hon. Information Commissioners.\n<\/p>\n<p id=\"p_22\">           Hence CPIO be directed to furnish me correct information about<br \/>\n               points No. 4 &amp; 5.\n<\/p>\n<p id=\"p_23\">Point No. 6:\n<\/p>\n<p id=\"p_24\">      5.       My appeal point: CPIO be directed to forward my RTI<br \/>\n               application where the information is available.<br \/>\nPoint No 10\n<\/p>\n<p id=\"p_25\">      6.        Also following information not furnished to me from my RTI<br \/>\n               application 3(iii) (1) Daily progress made on &#8230; to (6) The<\/p>\n<p><span class=\"hidden_text\" id=\"span_3\">                                         3<\/span><br \/>\n              number of similar applications &#8230; is not furnished. Hence<br \/>\n             CPIO be directed to furnish me correct information above<br \/>\n             points.&#8221;\n<\/p>\n<p id=\"p_26\">      Upon this, Ms. Anuradha Chagti, DS (RTI) in her order of 17.2.09 has<br \/>\nfound as follows:\n<\/p>\n<blockquote id=\"blockquote_7\"><p>      &#8220;Point No. 1 to 2: Sec.4 (1) of the <a href=\"\/doc\/671631\/\" id=\"a_3\">RTI Act<\/a> reads as under:\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_8\"><p>      a)     maintain all its records duly catalogued and indexed in a<br \/>\n             manner and the form which facilitates the right to information<br \/>\n             under this Act and ensure that all records that are<br \/>\n             appropriate to be computerised are, within a reasonable time<br \/>\n             and subject to availability of resources, computerised and<br \/>\n             connected through a network all over the country on different<br \/>\n             systems so that access to such records is facilitated;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_9\"><p>      b)     publish within one hundred and twenty days from the<br \/>\n             enactment of this Act,&#8211;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_10\"><p>             (i) the particulars of its organisation, functions and duties;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_11\"><p>             (ii) the powers and duties of its officers and employees;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_12\"><p>             (iii) the procedure followed in the decision making process,<br \/>\n                   including channels of supervision and accountability;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_13\"><p>             (iv) the norms set by it for the discharge of its functions;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_14\"><p>             (v) the rules, regulations, instructions, manuals and records,<br \/>\n                   held by it or under its control or used by its employees<br \/>\n                   for discharging its functions;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_15\"><p>             (vi) a statement of the categories of documents that are held<br \/>\n                   by it or under its control;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_16\"><p>             (vii) the particulars of any arrangement that exists for<br \/>\n                   consultation with, or representation by, the members of<br \/>\n                   the public in relation to the formulation of its policy or<br \/>\n                   implementation thereof;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_17\"><p>             (viii) a statement of the boards, councils, committees and<br \/>\n                   other bodies consisting of two or more persons<br \/>\n                   constituted as its part or for the purpose of its advice,<br \/>\n                   and as to whether meetings of those boards, councils,<br \/>\n                   committees and other bodies are open to the public, or<br \/>\n                   the minutes of such meetings are accessible for public;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_18\"><p>             (ix) a directory of its officers and employees;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_19\"><p>             (x) the monthly remuneration received by each of its<br \/>\n                   officers and employees, including the system of<br \/>\n                   compensation as provided in its regulations;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_20\"><p>             (xi) the budget allocated to each of its agency, indicating the<br \/>\n                   particulars of all plans, proposed expenditures and<br \/>\n                   reports on disbursements made;\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\" id=\"span_4\">                                        4<\/span><\/p>\n<blockquote id=\"blockquote_21\"><p>       (xii) the manner of execution of subsidy programmes,<br \/>\n            including the amounts allocated and the details of<br \/>\n            beneficiaries of such programmes;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_22\"><p>      (xiii)     particulars of recipients of concessions, permits or<br \/>\n            authorisations granted by it;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_23\"><p>      (xiv) details in respect of the information, available to or held<br \/>\n            by it, reduced in an electronic form;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_24\"><p>      (xv) the particulars of facilities available to citizens for<br \/>\n            obtaining information, including the working hours of a<br \/>\n            library or reading room, if maintained for public use;<br \/>\n      (xvi) the names, designations and other particulars of the<br \/>\n            Public Information Officers;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_25\"><p>      (xvii) such other information as may be prescribed; and<br \/>\n            thereafter update these publications every year; &#8221;\n<\/p><\/blockquote>\n<p id=\"p_27\">c)     publish all relevant facts while formulating important policies<br \/>\n      or announcing the decisions which affect public;\n<\/p>\n<p id=\"p_28\">d)      provide reasons for its administrative or quasi-judicial<br \/>\n      decisions to affected persons.\n<\/p>\n<p id=\"p_29\">Further Sec. 25(1) reads as &#8220;The Central Information Commission<br \/>\nor State Information Commission, as the case may be, shall, as<br \/>\nsoon as practicable after the end of each year, prepare a report on<br \/>\nthe implementation of the provisions of this Act during that year and<br \/>\nforward a copy thereof to the appropriate Government.\n<\/p>\n<p id=\"p_30\">No other supporting document is available with this Division.\n<\/p>\n<p id=\"p_31\">Point 3 to 5: Information has been provided on what is available<br \/>\nwith this Department. No other supporting document is available<br \/>\nwith the Division.\n<\/p>\n<p id=\"p_32\">Point No. 6: Information is neither available with the CPIO nor it is<br \/>\nknown if such correlation has been done by any public authority.\n<\/p>\n<p id=\"p_33\">Point No. 7: Information is neither available with the CPIO nor it is<br \/>\nknown if such correlation has been done by any public authority.\n<\/p>\n<p id=\"p_34\">Point No. 8: Information is neither available with the CPIO nor it is<br \/>\nknown if such correlation has been done by any public authority.\n<\/p>\n<p id=\"p_35\">Point No. 9: Information is neither available with the CPIO nor it is<br \/>\nknown if such correlation has been done by any public authority.\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_5\">                                  5<\/span><\/p>\n<p id=\"p_36\">            Point No. 10: Information has already been provided.            The<br \/>\n           information desired is not maintained in any format and is therefore<br \/>\n           not available with the CPIO.\n<\/p>\n<p id=\"p_37\">           It is reiterated that interpretation of the provisions of the Act is<br \/>\n           beyond the scope of the Act.&#8221;\n<\/p>\n<p id=\"p_38\">           Appellant&#8217;s prayer in his second appeal before us is as below:<br \/>\n           &#8220;a)    CPIO, DOPT be directed to furnish me correct<br \/>\n                  information about the Nodal Agency to monitor<br \/>\n                  Compliance of Sec. 4 of Govt. Agencies when he \/ she<br \/>\n                  said Nodal Agency is CIC.\n<\/p>\n<p id=\"p_39\">           b)              CPIO, CIC be directed to furnish me the<br \/>\n                  method, parameter etc. i.e. how DOPT monitors<br \/>\n                  Compliance of Sec. 4 of Govt. Agencies from year to<br \/>\n                  year basis.&#8221;\n<\/p>\n<p id=\"p_40\">2.         File No. CIC\/WB\/A\/2010\/000303<br \/>\n           In this case Shri Durve by an application of 21.9.08 received by the CPIO<br \/>\n     on 30.9.08 has sought the following information:\n<\/p>\n<blockquote id=\"blockquote_26\"><p>           &#8220;1.    Inform me and furnish me the name of Authority or Ministry<br \/>\n                  who is supposed to evaluate the Sec. 4 of RTI compliance of<br \/>\n                  each Govt. Department\/Local Authority?\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_27\"><p>           2.                        Inform me and furnish me the<br \/>\n                  method\/procedure\/technique\/parameters how each CIC<br \/>\n                  evaluates the Sec. 4 of the RTI compliance?\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_28\"><p>           3.                        Inform me and furnish me details of<br \/>\n                  Power \/ authority \/ duty \/ obligations cast on each CIC to<br \/>\n                  evaluate sec. 4 of RTI compliance.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_29\"><p>           4.                        Inform me and furnish me the advantages<br \/>\n                  of evaluating sec. 4 compliance of RTI to RTI applicant and<br \/>\n                  Govt. Department or Local Authorities.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_30\"><p>           5.                        Inform me and furnish me the<br \/>\n                  disadvantages of evaluating sec. 4 compliance of RTI to RTI<br \/>\n                  applicant and Govt. Department or Local Authorities.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_31\"><p>           6.                        Inform me and furnish me effect of<br \/>\n                  evaluating sec. 4 compliance of RTI on India&#8217;s Transparency<br \/>\n                  &amp; Corruption Index or taking RTI to its logical conclusion.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_32\"><p>           7.                        Inform me and furnish me effect of not<br \/>\n                  evaluating sec. 4 compliance of RTI on India&#8217;s Transparency<br \/>\n                  &amp; Corruption Index or taking RTI to its logical conclusion.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\" id=\"span_6\">                                             6<\/span><\/p>\n<p id=\"p_41\">       8.                         Inform me and furnish me effect of<br \/>\n             evaluating sec. 4 compliance of RTI on Global Warming or<br \/>\n             taking RTI to its logical conclusion.\n<\/p>\n<p id=\"p_42\">      9.                         Inform me and furnish me effect of not<br \/>\n             evaluating sec. 4 compliance of RTI on Global Warming or<br \/>\n             taking RTI to its logical conclusion.\n<\/p>\n<p id=\"p_43\">      10.                        Inform me and furnish me the budgetary<br \/>\n             provisions meant for conducting yearly RTI Conclave by<br \/>\n             CIC.\n<\/p>\n<p id=\"p_44\">      11.                        Inform me and furnish me the cost of<br \/>\n             conducting yearly Conclave by CICs\n<\/p>\n<p id=\"p_45\">      12.                        Inform me and furnish me when will CIC,<br \/>\n             compliance of Sec. 4 of RTI by yearly RTI compliance?\n<\/p>\n<p id=\"p_46\">      13.                        Inform me name of person who is<br \/>\n             supposed to disseminate above information on CIC&#8217;s<br \/>\n             website? Why it is not published? When will it be<br \/>\n             published?\n<\/p>\n<p id=\"p_47\">      AND\n<\/p>\n<p id=\"p_48\">      1. Daily progress made on my application so far i.e. when did my<br \/>\n            application reach which officer for how long did it stay with<br \/>\n            that officer and what was the action taken by her \/ him?\n<\/p>\n<p id=\"p_49\">      2. Name and designation of the officials \/ employees who were<br \/>\n            supported to take action on my application and that of the<br \/>\n            officer who is supposed to take final decision in the matter.\n<\/p>\n<p id=\"p_50\">      3. Copies of documents relating to my application with all the file<br \/>\n            notings thereon.\n<\/p>\n<p id=\"p_51\">      4. How much is the time limit for disposal of applications of this<br \/>\n            type, going by your rules or citizens charter.\n<\/p>\n<p id=\"p_52\">      5. Copies of action initiated against official and \/ or employees for<br \/>\n            delaying action in the matter beyond the prescribed time limit<br \/>\n            as per your rules or citizens charter.\n<\/p>\n<p id=\"p_53\">      6. The number of similar application received within seven days<br \/>\n            from the receipt of my application and their respective<br \/>\n            status.&#8221;\n<\/p>\n<p id=\"p_54\">      To this Shri Durve received a response point wise dated 29.1.08 from<br \/>\nCPIO Shri Tarun Kumar, Jt. Secretary, informing him as follows:\n<\/p>\n<blockquote id=\"blockquote_33\"><p>      &#8220;1.    The Nodal Ministry for such valuation is Ministry of<br \/>\n             Personnel, Public Grievances &amp; Pensions, Department of<br \/>\n             Personnel &amp; Training.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_34\"><p>      2.     The CIC examines the issues of sec. 4 compliance in a case<br \/>\n             that case before it in a complaint or an appeal under Sec.<br \/>\n             18\/19 of <a href=\"\/doc\/671631\/\" id=\"a_4\">RTI Act<\/a>.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\" id=\"span_7\">                                       7<\/span><\/p>\n<blockquote id=\"blockquote_35\"><p>       3.            The powers of the Commissioners\/Commission are<br \/>\n      described in Chapter 3 of the <a href=\"\/doc\/671631\/\" id=\"a_5\">RTI Act<\/a>.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_36\"><p>              4-5 CPIO provides information u\/s 2(f) of the <a href=\"\/doc\/671631\/\" id=\"a_6\">RTI Act<\/a>. He cannot<br \/>\n                    interpret or evaluate the particular provisions of <a href=\"\/doc\/671631\/\" id=\"a_7\">RTI Act<\/a>.<br \/>\n                    You may seek legal opinion of an Advocate or an expert at<br \/>\n                    your level.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_37\"><p>             6-9. The Central Information Commission has a limited role of<br \/>\n                    examining a complaint or an Appeal. The non compliance of<br \/>\n                    Sec. 4 by a particular Public Authority only, and not<br \/>\n                    evaluating it in terms of transparency, corruption and Global<br \/>\n                    Warming.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_38\"><p>             10.11          The Commission does not hold any conclave however<br \/>\n                    it organized so far in two Conventions in 2006-07 &amp; 2007-08.<br \/>\n                    No specific budget has been allocated in the Demands for<br \/>\n                    grant for the Annual Convention of CIC. Expenditure on the<br \/>\n                    Annual Conventions of CIC is incurred from out of the overall<br \/>\n                    funds allocated to CIC in the Demands for Grants.<br \/>\n                    Information specifies to holding of the convention on<br \/>\n                    expenditure incurred is not available. The conference wise<br \/>\n                    the expenditure is made out on two heads on different items,<br \/>\n                    activities requirements of the convention from heads &#8220;other<br \/>\n                    administrative expenses&#8221; and office expenses and payments<br \/>\n                    were also made in 2006 on travel expenses of some<br \/>\n                    invitees. It is re-emphasized that there is no separate head<br \/>\n                    for Conference \/ Convention.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_39\"><p>             12, 13 &amp; 14: The CIC compliance with sec. 4 of the <a href=\"\/doc\/671631\/\" id=\"a_8\">RTI Act<\/a> every<br \/>\n                    year and is available in our web site www.cic.gov.in and the<br \/>\n                    web site is up dated periodically.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_40\"><p>             15          Shri Pankaj KP Shreyaskar in consultation with NIC for<br \/>\n                    Sec. 4 compliance.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_41\"><p>            1.      Your application was received on 30.9.2008 and was<br \/>\n                    diarized by diary No. 41997\/08 and it was received by the<br \/>\n                    CPIO on the same date. CPIO is supposed to reply to RTI<br \/>\n                    application.\n<\/p><\/blockquote>\n<p id=\"p_55\">2.3                 The undersigned is replying the RTI application and there is<br \/>\n      no noting on the subject.\n<\/p>\n<p id=\"p_56\">      4.            As per the <a href=\"\/doc\/671631\/\" id=\"a_9\">RTI Act<\/a> 30 days are prescribed for disposal of<br \/>\n      such RTI application by t he CPIO. In view of above there is no delay.\n<\/p>\n<p id=\"p_57\">      5.            Details of Similar RTI applications received from 30.9.3008<br \/>\n      to 10.10.2008 are enclosed with application A.&#8221;\n<\/p>\n<p id=\"p_58\">            Because of the perceived contradiction in information provided by DoPT<br \/>\n      and CIC Shri Durve moved an appeal on 1.12.08 before the Appellate Authority<br \/>\n      Central Information Commission contesting the information provided, as follows:\n<\/p>\n<p><span class=\"hidden_text\" id=\"span_8\">                                              8<\/span><\/p>\n<p id=\"p_59\">        &#8220;1.    As per Sec. 19(8) (a) of RTI<br \/>\n               The CIC or State Information Commission. as the case may<br \/>\n               be has the power to:\n<\/p>\n<p id=\"p_60\">               a)     require the public authority to take any such action as<br \/>\n                      may be necessary to secure compliance with the<br \/>\n                      provisions of this act, including:\n<\/p>\n<p id=\"p_61\">(i)                                  by providing access to information, if so<br \/>\nrequested, in a particular form;\n<\/p>\n<p id=\"p_62\">(ii)                                 by appointing a Central Public<br \/>\nInformation Officer or State Public Information Officer, as the case may<br \/>\nbe.\n<\/p>\n<p id=\"p_63\">(iii)                                By publishing certain information or<br \/>\ncategories of information.\n<\/p>\n<p id=\"p_64\">(iv)                                 By making necessary changes to its<br \/>\npractices in relation to the maintenance management and destruction or<br \/>\nrecords.\n<\/p>\n<p id=\"p_65\">(v)                                    By enhancing the provisions of training<br \/>\non the right to information for its officials.\n<\/p>\n<p id=\"p_66\">(vi)                                 By providing it with an annual report in<br \/>\ncompliance with clause (b) of sub section (I) of Sec. 4.\n<\/p>\n<p id=\"p_67\">       In light of above provisions, CPIO furnished me wrong information.<br \/>\n       It is responsibility of CIC to assess the progress of suo moto<br \/>\n       compliance of Sec. 4 and hence CPIO be directed to furnish me<br \/>\n       correct information.\n<\/p>\n<p id=\"p_68\">       Appellant Shri Durve&#8217;s specific plea on all answers provided is athe<br \/>\nfollowing:\n<\/p>\n<p id=\"p_69\">1.     Also CPIO be directed to inform me relevant portion \/ section from<br \/>\nthe <a href=\"\/doc\/671631\/\" id=\"a_10\">RTI Act<\/a> i.e. the source of information from where he informed me that<br \/>\nthe Nodal Ministry for such valuation is Ministry of Personnel, Public<br \/>\nGrievances &amp; Pensions, Department of Personnel &amp; Training.\n<\/p>\n<p id=\"p_70\">2.     Very specific information regarding Duty &amp; Obligations cast on each<br \/>\nCIC to evaluate sec. 4 of RTI compliance was sought.\n<\/p>\n<p id=\"p_71\">       However, CPIO just referred to powers of information<br \/>\n       Commissioners &amp; Deliberately refused to furnish me details of<br \/>\n       duty\/obligation cast on Information Commission.<br \/>\n       CPIO be directed to furnish me correct information about the duty \/<br \/>\n       obligation cast on Information Commissioners to evaluate sec. 4 of<br \/>\n       RTI Compliance.&#8221;\n<\/p>\n<p id=\"p_72\">3.     CPIO be directed to furnish me correct information about the<br \/>\nadvantages of evaluating sec. 4 compliance of RTI to RTI applicant and<br \/>\nGovt. Department or Local Authorities.\n<\/p>\n<p id=\"p_73\">4.     CPIO be directed to inform me the exact date &amp; other necessary<br \/>\ndetails about when would CIC start discharging its duty &amp; would conduct<\/p>\n<p><span class=\"hidden_text\" id=\"span_9\">                                         9<\/span><br \/>\n yearly RTI conclave to monitor the progress of Sec. 4 compliance of all<br \/>\nGovt. Agencies.&#8221;\n<\/p>\n<p id=\"p_74\">       In his order of 16.1.09 Shri Mohammed Haleem Khan has arrived at the<br \/>\nfollowing decision:\n<\/p>\n<blockquote id=\"blockquote_42\"><p>       &#8220;Point No.1: At the time of hearing the appellant was asked<br \/>\n       specifically what are his grievances against the reply of CPIO. The<br \/>\n       appellant was emphatic that since CPIO has not given him any<br \/>\n       document in support of the reply, he should supply the document<br \/>\n       along with that. The matter was discussed with the CPIO and it<br \/>\n       emerged that in view of the fact that DOPT is the nodal Ministry, the<br \/>\n       CPIO&#8217;s reply cannot be considered wanting and accordingly this<br \/>\n       issue should be treated as adequately replied. Subsequently the<br \/>\n       appellant provided a copy of DOPT&#8217;s letter dated 23rd December,<br \/>\n       2008 wherein DOPT has quoted sec. 25(5) and therefore,<br \/>\n       according to the appellant the burden of Sec. 4 compliance by<br \/>\n       public authorities falls on the CIC. Since this letter is of a<br \/>\n       subsequent date, CPIO cannot be found wanting for not replying<br \/>\n       accordingly and not supplying this document along with his reply.<br \/>\n       Shri Tarun Kumar, however, emphasized that CPIO has not given<br \/>\n       wrong information to which the appellant did not agree. First<br \/>\n       Appellate Authority after hearing both the parties has come to the<br \/>\n       conclusion that CPIO has replied on the basis of records \/<br \/>\n       information he had and cannot be faulted.<br \/>\n       Point No. 2: The CPIO elaborated that he has given information<br \/>\n       that Commission takes a view of sec. 4 disclosure on a case to<br \/>\n       case basis at the time of disposal of complaints and appeals under<br \/>\n       sec. 18 &amp; 19 of the <a href=\"\/doc\/671631\/\" id=\"a_11\">RTI Act<\/a>. The CPIO agreed to supply a copy of<br \/>\n       the Rules made by DOPT and the Regulations made by the<br \/>\n       Commission in this regard.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_43\"><p>       Point No. 3 to 9:    The appellant is satisfied with the reply.<br \/>\n       Point No. 10 &amp; 11: The reply of the CPIO with regard to Point No.<br \/>\n       10 &amp; 11 was not found adequate. The CPIO was accordingly<br \/>\n       directed to provide the details of budget provision and actual<br \/>\n       utilization in the years 2006-07, 2007-08 and 2008-09 for the<br \/>\n       Annual Conventions. The Budget of the Commission may be put<br \/>\n       on website as part of the mandatory disclosure u\/s 4(1) (b) (xvi) if<br \/>\n       not done already.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_44\"><p>       Point No. 12: The CPIO has given the reply, however, the appellant<br \/>\n       is not satisfied with the reply and desired that he should be<br \/>\n       informed of the exact date and other necessary details about when<br \/>\n       would CIC start discharging its duty &amp; would conduct yearly RTI<br \/>\n       Conclave to monitor the progress of sec. 4 compliance of all Govt.<br \/>\n       agencies. It was clarified by the CPIO that the Commission have<\/p>\n<p><span class=\"hidden_text\" id=\"span_10\">                                        10<\/span><br \/>\n        complied with the sec. 4 of the <a href=\"\/doc\/671631\/\" id=\"a_12\">RTI Act<\/a>. It was decided that the<br \/>\n       matter will be revisited and wherever required updated. It was<br \/>\n       decided that the date of updating will also be put up against each<br \/>\n       update.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_45\"><p>       Point No. 13: The appellant is satisfied with the reply.\n<\/p><\/blockquote>\n<p id=\"p_75\">6.             Regarding other points, the reply submitted by the CPIO<br \/>\nwere discussed in the light of the comments of the appellant and it was<br \/>\nagreed that if photo copy of the file of his RTI application is provided to the<br \/>\nappellant in full, it will suffice the query. CPIO is accordingly directed to<br \/>\nprovide a copy of the same to the appellant.\n<\/p>\n<p id=\"p_76\">7.             First Appellate authority appreciated the effort made by Shri<br \/>\nVihar Durve and Shri Rakesh Agarwal for participating and presenting<br \/>\ntheir point of view personally before the First Appellate Authority.&#8221;\n<\/p>\n<blockquote id=\"blockquote_46\"><p>       In this case, appellant&#8217;s prayer before us in his second appeal is as below:<br \/>\n       &#8220;a)     CPIO, CIC be directed to furnish me with Documentary<br \/>\n               Evidence about the Nodal Agency to monitor<br \/>\n               compliance of Sec. 4 of Govt. Agencies when he said<br \/>\n               Nodal Agency is DOPT Ministry.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_47\"><p>       b)      CPIO, CIC be directed to furnish me the method,<br \/>\n               parameter etc. i.e. how CIC monitors Compliance of Sec.<br \/>\n               4 of Govt. Agencies from year to year basis.&#8221;<\/p><\/blockquote>\n<p id=\"p_77\">       The key issue, therefore, in both cases is the appropriate authority under<br \/>\nthe <a href=\"\/doc\/671631\/\" id=\"a_13\">RTI Act<\/a> to enforce compliance with sec. 4.\n<\/p>\n<p id=\"p_78\">       The appeal was heard by video conference on 22.7.2010. The following<br \/>\nare present:\n<\/p>\n<blockquote id=\"blockquote_48\"><p>       Appellant at NIC Studio, Pune<br \/>\n             Shri Vihar Durve<br \/>\n       Respondent at CIC Studio, New Delhi.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_49\"><p>             Shri Tarun Kumar, Jt. Secy. CIC<br \/>\n             Shri K. K. Girdhar, CPIO, DOPT<br \/>\n       Observer at CIC Studio, New Delhi.<\/p><\/blockquote>\n<p id=\"p_79\">               Shri Venkatesh Nayak<\/p>\n<p>       Shri R. K. Girdhar, CPIO, DOPT submitted that compliance with Sec. 4 of<br \/>\nthe <a href=\"\/doc\/671631\/\" id=\"a_14\">RTI Act<\/a> 2005 is a statutory requirement. The relevant clause of the Act<\/p>\n<p><span class=\"hidden_text\" id=\"span_11\">                                         11<\/span><br \/>\n through which this is to be enforced has been provided to appellant Shri Durve.<br \/>\nCPIO Shri Tarun Kumar on the other hand submitted that this authority will lie<br \/>\nwith the &#8220;appropriate Government&#8221; u\/s 26(3) (g) which specifically lays down as<br \/>\nfollows:\n<\/p>\n<blockquote id=\"blockquote_50\"><p>       26(3) The appropriate Government shall, if necessary, update and<br \/>\n             publish the guidelines referred to in sub-section (2) at<br \/>\n             regular intervals which shall, in particular and without<br \/>\n             prejudice to the generality of sub-section (2), include&#8211;\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_51\"><p>              (g)     the provisions providing for the voluntary disclosure<br \/>\n                     of categories of records in accordance with <a href=\"\/doc\/13503\/\" id=\"a_15\">section 4<\/a>;<\/p><\/blockquote>\n<p id=\"p_80\">       Both CPIOs submitted that it is not possible for either public authority to<br \/>\nregularly access compliance by public authorities within their jurisdictions.<br \/>\nAppellant Shri Durve on the other hand submitted that since it is within the<br \/>\nauthority of Central Information Commission to monitor the implementation of the<br \/>\n<a href=\"\/doc\/671631\/\" id=\"a_16\">RTI Act<\/a> u\/s 25 it will also be necessary for CIC to enforce compliance with sec. 4.<br \/>\nIn a subsequent hearing in a separate case, appellant Shri Durve also referred to<br \/>\na decision of this Commission in <a href=\"\/doc\/820713\/\" id=\"a_17\">CCIC\/WB\/C\/2009\/000468 Vihar Durve vs. Rajya<br \/>\nSabha Sectt<\/a>. Regarding the Report of Department Related Parliamentary<br \/>\nStanding Committee on Personnel, Public Grievances Law &amp; Justice. However,<br \/>\nthis is not the point at issue in the present hearing.\n<\/p>\n<p id=\"p_81\">                                DECISION NOTICE<br \/>\n       In this case, CPIOs, both of CIC &amp; DOPT, have provided the information<br \/>\nsought by appellant Shri Vihar Durve in the form held by them and according to<br \/>\ntheir understanding of the law. However, what emerges from the appeals is an<br \/>\napparent hiatus in the law with regard to enforcement of compliance with sec. 4<br \/>\nwhich is a vital element of the law to achieve the objective of the law described in<br \/>\nits preamble &#8220;to promote transparency and accountability in the working of every<br \/>\npublic authority&#8221;. While, therefore, both appeals are dismissed, this Commission<br \/>\nplaces on record its appreciations of the efforts of appellant Shri Vihar Durve in<br \/>\nagitating a point which deserves attention both by the Information Commission<br \/>\nand the Government. The clarification of this issue will, therefore, be pursued by<\/p>\n<p><span class=\"hidden_text\" id=\"span_12\">                                          12<\/span><br \/>\n the Central Information Commission with the DOPT with reference to the Report<br \/>\nof Department Related Parliamentary Standing Committee of on Personnel,<br \/>\nPublic Grievances Law &amp; Justice to avoid any ambiguity in imposition or<br \/>\nenforcement of this clause thereby hopefully leading to closer adherence with the<br \/>\nletter and spirit of the law.\n<\/p>\n<p id=\"p_82\">       Reserved in the hearing, this decision is announced in open chamber on<br \/>\n30.7.&#8217;10.
