Sr. Counsel Mr. PM Thakkar for ld. Counsel Mr. YM Thakkar for the<br \/>\npetitioners and ld. APP Mr. Pujari for respondent No.1 State.\n<\/p>\n<p id=\"p_2\">\t\tUndisputedly,<br \/>\nthe victim girl and petitioner No.1 accused  are well-qualified and I<br \/>\nam told that they are holding Diploma in Engineering. Ld.APP Mr.<br \/>\nPujari has fairly admitted that the victim girl, in her statement,<br \/>\nhas clearly stated that she had voluntarily left her parental home<br \/>\nand left with boy and at present she is living her life as a<br \/>\nlegally-wedded wife of petitioner No.1. So, without commenting on the<br \/>\nmerits  of the case placed before the Court, this Court is inclined<br \/>\nto admit the Cri. Rev. Application. The Court also can not ignore one<br \/>\nmajor aspect that at present the victim girl is a mother of a child<br \/>\nout of wedlock with petitioner No.1 husband.\n<\/p>\n<p id=\"p_3\">\t\tHence,<br \/>\nRule.  Ld. APP Mr. LR Pujari appears and waives service of Rule for<br \/>\nrespondent No.1 State.\n<\/p>\n<p id=\"p_4\">\t\tPending<br \/>\nthe hearing and final disposal of the Cri.<br \/>\nRev. Application, the proceedings of Sessions case No.386\/2004<br \/>\npending before the Sessions Court, Dahod arising out of CR No.<br \/>\nI.41\/2003 registered with Dahod Town Police Station, shall remained<br \/>\nstayed.\n<\/p>\n<p id=\"p_5\">\t\tD.S.\n<\/p>\n<p id=\"p_6\">Permitted.&#8221;\n<\/p>\n<p id=\"p_7\">\t\tThis<br \/>\nCourt has gone through the order passed below the discharge<br \/>\napplication wherein the Sessions Court has observed that the victim<br \/>\nis staying with the accused as wife and husband and the during the<br \/>\nwedlock, one child is also born. As per the above referred order<br \/>\nalso, the petitioner no.1 and the victim are residing as husband and<br \/>\nwife. In view of the above, I am of the opinion that to continue the<br \/>\ncriminal proceedings is nothing but harassment to the petitioners.\n<\/p>\n<p id=\"p_8\">\t\tIn<br \/>\nview of the above, this revision application is allowed.
