Justice ANTONY DOMINIC\n\n Dated :04\/06\/2009\n\n O R D E R\n                       ANTONY DOMINIC, J.\n                     ================\n                 W.P.(C) NO. 15388 OF 2009 (P)\n                 =====================\n\n             Dated this the 4th day of June, 2009\n\n                         J U D G M E N T\n<\/pre>\n<p id=\"p_1\">      Petitioner submits that he is an Attender working under the<\/p>\n<p>1st respondent society. Earlier he was dismissed from the services<\/p>\n<p>and following the award of the Industrial Tribunal, Alappuzha in ID<\/p>\n<p>No.59\/02, he was reinstated in service as per Ext.P1 order.<\/p>\n<p>Subsequently, Ext.P2 order was issued placing the petitioner<\/p>\n<p>under suspension alleging certain misconducts. Memo of charges<\/p>\n<p>were issued and enquiry was conducted. Report has been<\/p>\n<p>submitted finding the petitioner guilty and by Ext.P7, petitioner<\/p>\n<p>was called upon to make his representations against the findings<\/p>\n<p>of the enquiry officer.\n<\/p>\n<p id=\"p_1\">      2.    The petitioner complained against the manner in which<\/p>\n<p>enquiry was conducted and therefore sought reopening of the<\/p>\n<p>enquiry by filing Ext.P8.\n<\/p>\n<p id=\"p_2\">      3.    Petitioner has a complaint that the 1st respondent has<\/p>\n<p>not paid his subsistence allowance since 22\/4\/2008 when he was<\/p>\n<p>placed under suspension. According to him, his representations in<\/p>\n<p>this behalf did not yield any result and therefore he has filed<\/p>\n<p>WPC 15388\/09<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                   :2 :<\/span><\/p>\n<p>Exts.P5 and P6 before the 2nd respondent complaining of non<\/p>\n<p>payment of the subsistence allowance. It is stated that this also<\/p>\n<p>has not been responded. It is at this stage the writ petition is filed<\/p>\n<p>mainly praying that the enquiry should be reopened and<\/p>\n<p>subsistence allowance should be paid.\n<\/p>\n<p id=\"p_3\">      4.    In my view, the prayer for reopening of the enquiry<\/p>\n<p>now made is misconceived.          If the enquiry is invalid for any<\/p>\n<p>reason, it is for the petitioner to point out the alleged irregularities<\/p>\n<p>in his representation, which he has been called upon to submit in<\/p>\n<p>response to Ext.P7.\n<\/p>\n<p id=\"p_4\">      5.    It is the settled position of law that the enquiry officer<\/p>\n<p>is only a delegate of the disciplinary authority and that the<\/p>\n<p>disciplinary authority is not bound by the findings of the enquiry<\/p>\n<p>officer. Therefore, if there is any invalidating factor in the conduct<\/p>\n<p>of the enquiry, it is always open to the petitioner to take<\/p>\n<p>advantage of the same before the disciplinary authority, in which<\/p>\n<p>event, it is to the disciplinary authority to consider that issue as<\/p>\n<p>well. Therefore, at this stage, nothing has been brought out for<\/p>\n<p>interference in this writ petition.\n<\/p>\n<p id=\"p_5\">      6.    Be that as it may,in so far as the case of the petitioner<\/p>\n<p>WPC 15388\/09<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                 :3 :<\/span><\/p>\n<p>regarding the non payment of subsistence allowance is<\/p>\n<p>concerned, having regard to the fact that this issue has been<\/p>\n<p>raised before the 2nd respondent by filing Exts.P5 and P6, it is<\/p>\n<p>directed   that   the   2nd   respondent   shall  consider   those<\/p>\n<p>representations and pass orders thereon, as expeditiously as<\/p>\n<p>possible, at any rate within 6 weeks of production of a copy of this<\/p>\n<p>judgment.\n<\/p>\n<p id=\"p_6\">     7.
