In the judgment rendered by me in the batch of Writ petitions in<br \/>\nW.P.Nos.409 of 2004 etc.,  dated 06.01.2006, relying upon the judgment of the<br \/>\nSupreme Court in Kunalsingh Vs.Union of India and another reported in 2003 (4)<br \/>\nSCC 524,  I have held that as per <a href=\"\/doc\/639570\/\" id=\"a_1\">Section 47(1)<\/a> of the Persons with Disabilities<br \/>\n(Equal Opportunities, Protection of Rights and Full Participation) Act, 1995,<br \/>\nany person acquired disability during the course of employment either in<br \/>\nconsequence of the nature of employment or otherwise, the &#8220;disability&#8221; as<br \/>\ndefined under <a href=\"\/doc\/699626\/\" id=\"a_2\">Section 2(i)<\/a> of the Act, is to be shifted to some other post with<br \/>\nthe same pay scale and service benefits and even in cases where it is not<br \/>\npossible to adjust the employee against any post he should be kept on a<br \/>\nsupernumerary post until a suitable post was available or he attains the age of<br \/>\nsuperannuation whichever is earlier.\n<\/p>\n<p id=\"p_2\">\t3. I have also held that the Act has come into force on 07.02.1996 and any<br \/>\nemployee who was discharged thereafter on account of the disability acquired is<br \/>\nvested with such right.\n<\/p>\n<p id=\"p_3\">\t4. I have also held that in Para.29 of the said judgment while deciding<br \/>\nabout the term disability under <a href=\"\/doc\/699626\/\" id=\"a_3\">Section 2(i)<\/a> of the Persons with Disabilities<br \/>\n(Equal Opportunities, Protection of Rights and Full Participation) Act, 1995, is<br \/>\ndifferent from the term &#8220;person with disability&#8221; defined under 2(t) of the Act<br \/>\nand only in respect of those cases where, person who is not in employment<br \/>\nseeking the benefit under the Act in respect of schemes promulgated therein, the<br \/>\ncertificate of medical authority contemplated under the Act is required.<br \/>\nHowever, in respect of the persons who are already in services who have acquired<br \/>\ndisability during employment there was no necessity for producing  a certificate<br \/>\nfrom medical authority contemplated under <a href=\"\/doc\/699626\/\" id=\"a_4\">Section 2(p)<\/a> of the said Act.\n<\/p>\n<p id=\"p_4\">\t5. Apart from many other reasons, I have come to the said conclusion on<br \/>\nthe basis that the various disabilities mentioned under <a href=\"\/doc\/699626\/\" id=\"a_5\">Section 2(i)<\/a> of the<br \/>\nPersons with Disabilities (Equal Opportunities, Protection of Rights and Full<br \/>\nParticipation) Act, 1995 have been independently defined under the definition<br \/>\nclause itself and therefore construing the said provision as a beneficial<br \/>\nlegislation.  I have held that finding of any authority about saud disabilities<br \/>\nis sufficient for the purpose of the Act.\n<\/p>\n<p id=\"p_5\">\t6. The relevant passage in the judgment are &#8220;Therefore in my considered<br \/>\nview, the contentions of the learned counsels that unless and until a<br \/>\ncertificate issued by the competent authority contemplated under the Act is<br \/>\ngiven, the benefits under <a href=\"\/doc\/639570\/\" id=\"a_6\">Section 47<\/a> of the Act cannot be claimed is an<br \/>\nuntenable argument.  Further as laid down by the Supreme Court, the beneficial<br \/>\nlegislation like Act 1 of 1996 must be construed with the object of the Act and<br \/>\nits purpose must be preferred to the one which obstructs the objects and<br \/>\nparalyses the purpose.  Therefore, the finding of any authority about disability<br \/>\nis sufficient for the purpose of the Act.&#8221;\n<\/p>\n<p id=\"p_6\">\t7. Even though, it is true that the certificate of the medical authority<br \/>\nas prescribed under the Act is not necessary for the purpose of conferring<br \/>\nbenefit under <a href=\"\/doc\/639570\/\" id=\"a_7\">Section 47(1)<\/a> of the said Act, there must be some certificate to<br \/>\nprove that the person has suffered any one of the disabilities mentioned under<br \/>\n<a href=\"\/doc\/699626\/\" id=\"a_8\">Section 2(i)<\/a> of the Act, by construing the definition of various disabilities<br \/>\nexplained by way of definition under <a href=\"\/doc\/699626\/\" id=\"a_9\">Section 2<\/a> of Persons with Disabilities<br \/>\n(Equal Opportunities, Protection of Rights and Full Participation) Act, 1995.<br \/>\nTherefore, touch stone to decide about the disability explained in the medical<br \/>\ncertificate is <a href=\"\/doc\/699626\/\" id=\"a_10\">Section 2(i)<\/a> itself.\n<\/p>\n<p id=\"p_7\">\t8. In cases where the certificate produced by a medical board or any of<br \/>\nthe authority for the purpose of stating that a person is unfit due to the<br \/>\nmedical reason, is unable to be construed as a disability under the above said<br \/>\nAct,  it is always open to the employer to refer such employee for a fresh<br \/>\ncertificate to show whether the disabilities comes within the meaning of the<br \/>\nsaid Act namely <a href=\"\/doc\/699626\/\" id=\"a_11\">Section 2(i)<\/a> of the Persons with Disabilities (Equal<br \/>\nOpportunities, Protection of Rights and Full Participation) Act, 1995,  for,<br \/>\nunder the said Act person having disability but those disabilities which are<br \/>\ndefined therein alone are entitled to the benefits of <a href=\"\/doc\/639570\/\" id=\"a_12\">Section 47(1)<\/a> of the Act.\n<\/p>\n<p id=\"p_8\">\t9. In this case, the Regional Medical Board, Tirunelveli has simply given<br \/>\nthe following certificate:\n<\/p>\n<p id=\"p_9\">\t&#8220;TIRUNELVELI MEDICAL COLLEGE HOSPITAL, \t\t\t\tTIRUNELVELI-11<\/p>\n<p>\tWe the Chairman and the members of the Regional Medical Board, Tirunelveli<br \/>\nMedical College Hospital have examined Thiru.R.Sankar, Junior Tradesman, TNSTC,<br \/>\nTirunelveli on detailed examination, it is observed that he is unfit.&#8221;\n<\/p>\n<p id=\"p_10\">\t10. In view of the fact that the certificate does not disclose what is the<br \/>\ndisability suffered by the petitioner and to find out whether the disability<br \/>\nsuffered is in accordance with <a href=\"\/doc\/699626\/\" id=\"a_13\">section 2(i)<\/a> of the  Persons with Disabilities<br \/>\n(Equal Opportunities, Protection of Rights and Full Participation) Act, 1995,<br \/>\nthe respondents are directed to send the petitioner to the medical Board again<br \/>\nfor a detailed medical report to identify the nature of disability suffered by<br \/>\nthe petitioner and thereafter pass orders conferring the benefits on the<br \/>\npetitioner under <a href=\"\/doc\/639570\/\" id=\"a_14\">Section 47(1)<\/a> of the Act, provided, the petitioner is certified<br \/>\nto have suffered a disability as per <a href=\"\/doc\/699626\/\" id=\"a_15\">Section 2(i)<\/a> of the Act.  The writ petition<br \/>\nis ordered accordingly. There is no order as to costs.
