Gupta, Advocate, for the\n                 petitioner.\n\n\n                         .      .     .\n\nAJAI LAMBA, J (Oral)\n\n<\/pre>\n<p id=\"p_1\">                 This civil writ petition filed under<\/p>\n<p><a href=\"\/doc\/1712542\/\" id=\"a_1\">Article 226<\/a><a href=\"\/doc\/1331149\/\" id=\"a_1\">\/227<\/a> of the Constitution of India prays<\/p>\n<p>for a writ in the nature of certiorari for quashing<\/p>\n<p>Order dated 18\/29.12.1999 (Annexure P-8) whereunder<\/p>\n<p>penalty of reduction in Time Scale of Pay by one<\/p>\n<p>stage for a period of one year with the stipulation<\/p>\n<p>that   earning   increments         would   be     started   after<\/p>\n<p>expiry of penalty period from the reduced stage of<\/p>\n<p>pay, has been imposed. Subsequently, the petitioner<\/p>\n<p>carried an appeal and revision which orders dated<\/p>\n<p>23\/26.7.2004 (Annexure P-10) and 18.1.2008 (Annexure<\/p>\n<p>P-12) have also been challenged.\n<\/p>\n<p id=\"p_1\">                 Learned counsel for the petitioner, in<\/p>\n<p>brief, states that      the petitioner was transferred<br \/>\n CWP No.2811 of 2009                                             [2]<\/p>\n<p>out of Patiala on 22.3.1994. Rice was despatched to<\/p>\n<p>Hubli in Karnataka on 29\/30.3.1994. On receipt of<\/p>\n<p>Rice   at     Hubli,       it    was    found       that    Rice       contained<\/p>\n<p>excessive       percentage             of     discolouration,                broken<\/p>\n<p>grain, loose bran and it was dull in appearance. The<\/p>\n<p>personnel at the destination i.e. consignee made a<\/p>\n<p>complaint.       An        opportunity         was    given           for     joint<\/p>\n<p>inspection      by    the        persons      who    had    despatched          the<\/p>\n<p>Rice i.e. at Patiala. None however availed of joint<\/p>\n<p>inspection opportunity.\n<\/p>\n<p id=\"p_2\">                      Be that as it may, the Enquiry Officer<\/p>\n<p>exonerated the petitioner essentially on the ground<\/p>\n<p>that     he    stood        transferred         before       the        date    of<\/p>\n<p>despatch. The Disciplinary Authority differed with<\/p>\n<p>the    findings        recorded         by     the     Enquiry          Officer,<\/p>\n<p>however, after giving opportunity of being heard to<\/p>\n<p>the    petitioner,           so     that       the    petitioner             could<\/p>\n<p>persuade      the     Disciplinary           Authority      that        findings<\/p>\n<p>recorded by the Enquiry Officer in his favour are<\/p>\n<p>correct.\n<\/p>\n<p id=\"p_3\">                      Be     that       as    it     may,       for         reasons<\/p>\n<p>recorded in the order, the Disciplinary Authority<\/p>\n<p>imposed       penalty       on    the       petitioner      as        given     out<\/p>\n<p>above.    Appeal      and        review      filed    by    the       petitioner<\/p>\n<p>have also been dismissed.\n<\/p>\n<p id=\"p_4\">                      It has been projected on behalf of the<\/p>\n<p>petitioner that the petitioner was never given an<\/p>\n<p>opportunity         for     joint       inspection.        On     a     specific<\/p>\n<p>query of the Court to the learned counsel to show<br \/>\n CWP No.2811 of 2009                                       [3]<\/p>\n<p>the ground taken in this regard, learned counsel has<\/p>\n<p>been unable to point out any specific ground that<\/p>\n<p>had been taken in this regard. Rather, the ground<\/p>\n<p>taken     is     that        the      petitioner          having      been<\/p>\n<p>transferred,      was       not    required    to    be    invited     for<\/p>\n<p>joint inspection.\n<\/p>\n<p id=\"p_5\">                      The     finding         recorded           by    the<\/p>\n<p>authorities is to the effect that the petitioner was<\/p>\n<p>given opportunity to inspect for joint inspection. I<\/p>\n<p>have also considered the fact that without doubt,<\/p>\n<p>the    petitioner       alongwith      others       was    incharge     of<\/p>\n<p>maintaining       grain       at    Patiala     which           was   found<\/p>\n<p>deficient in quality. There is gap of just about 7\/8<\/p>\n<p>days in the date of transfer of the petitioner and<\/p>\n<p>the despatch of rice to Hubli. Learned counsel for<\/p>\n<p>the petitioner has not been able to point out any<\/p>\n<p>defect in decision making process.
