Sunil<br \/>\nBhati), under <a href=\"\/doc\/1823824\/\" id=\"a_1\">Section 138<\/a>\/<a href=\"\/doc\/595945\/\" id=\"a_2\">142<\/a> Negotiable Instruments Act, P.S. Civil Lines,<br \/>\nDistrict &#8211; Rampur.\n<\/p>\n<p id=\"p_2\">It is contended by the learned counsel for the applicant that the proceeding of<br \/>\nthe aforesaid case was sent to the Lok Adalat without intimation\/information<br \/>\nto the applicant, which proceedings were at the summoning stage and<br \/>\ntherefore, there was no question for the applicant to appear in the case at this<br \/>\nstage.\n<\/p>\n<p id=\"p_3\">It is next contended that as there was no compromise between the parties and<br \/>\nas the applicant has given no application for sending the proceeding to the<br \/>\nLok Adalat therefore, the matter referring to Lok Adalat is bad in law.\n<\/p>\n<p id=\"p_4\">Issue notice to opposite party no.2 returnable within four weeks. Steps be<br \/>\ntaken within a week.\n<\/p>\n<p id=\"p_5\">Learned A.G.A. prays for and is granted four weeks&#8217; time to file counter<br \/>\naffidavit. The opposite party no.2 may also file counter affidavit within the<br \/>\nsaid period. As prayed by the learned counsel for the applicant two weeks<br \/>\nthereafter is granted for filing rejoinder affidavit.\n<\/p>\n<p id=\"p_6\">List after expiry of the aforesaid period before appropriate Court.\n<\/p>\n<p id=\"p_7\">Till the next date of listing operation of the order dated 20.09.2009 passed in<br \/>\nCase Crime No. 5029 of 2007 shall be kept in abeyance.\n<\/p>\n<p id=\"p_8\">Order Date :- 2.8.2010<br \/>\nSunil Kr.
