{"id":270094,"date":"2010-04-08T00:00:00","date_gmt":"2010-04-07T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/vs-2-5-on-8-april-2010"},"modified":"2017-04-15T01:45:59","modified_gmt":"2017-04-14T20:15:59","slug":"vs-2-5-on-8-april-2010","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/vs-2-5-on-8-april-2010","title":{"rendered":"====================================== vs 2.5 on 8 April, 2010"},"content":{"rendered":"<div class=\"docsource_main\">Gujarat High Court<\/div>\n<div class=\"doc_title\">====================================== vs 2.5 on 8 April, 2010<\/div>\n<div class=\"doc_author\">Author: D.H.Waghela,&amp;Nbsp;<\/div>\n<pre id=\"pre_1\">   Gujarat High Court Case Information System \n\n  \n  \n    \n\n \n \n    \t      \n         \n\t    \n\t\t   Print\n\t\t\t\t          \n\n  \n\n\n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t\n\n\n \n\n\n\t \n\nSCA\/3842\/2010\t 1\/ 3\tORDER \n \n \n\n\t\n\n \n\nIN\nTHE HIGH COURT OF GUJARAT AT AHMEDABAD\n \n\n \n\n\n \n\nSPECIAL\nCIVIL APPLICATION No. 3842 of 2010\n \n\n======================================\n \n\nPANKAJBHAI\nCHHAGANLAL BAVISHI \n\n \n\nVersus\n \n\nSTATE\nOF GUJARAT AND OTEHRS \n\n \n\n====================================== \nAppearance\n: \nMR NIRAD D BUCH for NANAVATY\nADVOCATES for Petitioner Nos.1, 1.2.1, 1.2.2, 1.2.3, 1.2.4,\n1.2.5,1.2.6  \nMR AMIT PATEL, AGP for Respondent No.1. \nNone for\nRespondent Nos.2 - 3. \n======================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE D.H.WAGHELA\n\t\t\n\t\n\n \n\nDate\n: 08\/04\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p id=\"p_1\">1.\tThe<br \/>\npetitioner has invoked Articles 226 and 227 of the Constitution for<br \/>\nthe prayers reading as under:\n<\/p>\n<p id=\"p_1\"> 8.<br \/>\n The petitioners, therefore, prays as under:\n<\/p>\n<p id=\"p_2\">(A)\tYour<br \/>\nLordships be pleased to issue a writ of mandamus or a writ in the<br \/>\nnature of mandamus or any other appropriate writ, order or direction<br \/>\nquashing and setting aside the orders dated 30.11.1983 passed by<br \/>\nRespondent No.3, order dated 18.11.2008 and 13.10.2009 passed by<br \/>\nRespondent No.1 and further be pleased to hold that each of the<br \/>\npetitioners are entitled to hold the land to the tune of 1500 sq.<br \/>\nmeters and further be pleased to permanently restrain the respondents<br \/>\nand\/or their officers, servants, representatives, agents from taking<br \/>\nany coercive action in pursuance of the impugned orders.\n<\/p>\n<p id=\"p_3\">(B)\tPending<br \/>\nadmission, hearing and disposal of this petition, Your Lordships be<br \/>\npleased to stay implementation and\/or operation and\/or execution of<br \/>\nthe impugned orders dated 30.11.1983 passed by Respondent No.3, order<br \/>\ndated 18.11.2008 and 13.10.2009 passed by the Respondent No.1 and<br \/>\nfurther be pleased to restrain the respondent authorities from taking<br \/>\nany coercive action in pursuance of the orders impugned in this<br \/>\npetition.\n<\/p>\n<p id=\"p_4\">2.\tAdmittedly,<br \/>\nthe lands in question are not in possession of the petitioners, who<br \/>\nare heirs of the original owner of the land, who has passed away on a<br \/>\ndate which was not disclosed despite a query in that regard.<br \/>\nAccording to the prescribed form submitted by the original land<br \/>\nholder, under <a href=\"\/doc\/994481\/\" id=\"a_1\">Section 6<\/a> of the Urban Land (Ceiling and <a href=\"\/doc\/1489134\/\" id=\"a_1\">Regulation)<br \/>\nAct<\/a>, 1976 (for short  the Act ), he was holding land in excess of<br \/>\nthe prescribed limit and after hearing and considering his objections<br \/>\nthe impugned order dated 30.11.1983 was made by the Deputy Collector<br \/>\nunder the Act.  According to the averments made on oath in the<br \/>\npetition itself, the deceased holder had preferred an appeal under<br \/>\n<a href=\"\/doc\/1329456\/\" id=\"a_2\">Section 33<\/a> before the Urban Land Ceiling Tribunal and it was<br \/>\ndismissed.  Further details of that appeal, the order made therein<br \/>\nand the date of the order clearly appear to have been deliberately<br \/>\nsuppressed.  It is further averred that present petitioners had<br \/>\nthereafter preferred Special Civil Application No.5899 of 2008 and<br \/>\nthat petition was permitted to be withdrawn on 17.7.2008 on the<br \/>\nstatement that the petitioners wanted to make representation to the<br \/>\nauthorities.   Although it is stated in paragraph 3.3 of the petition<br \/>\nthat the order passed by learned tribunal as well as order dated<br \/>\n17.7.2008 in Special Civil Application No.5899 of 2008 are<br \/>\ncollectively annexed, the order of the Tribunal is admittedly not<br \/>\nannexed, and learned counsel, Mr.Buch has apologized for such lapse.<br \/>\nHe also admitted that, even outside the petition and record, such<br \/>\norder was not available with him.  Thus, in short, repeated attempts<br \/>\nare made at assailing original order dated 30.11.1983, which was<br \/>\nadmittedly confirmed in appeal and even without disclosing that order<br \/>\nsecond attempt is sought to be made for reopening the case for<br \/>\narguments on merits.\n<\/p>\n<p id=\"p_5\">3.\tAs<br \/>\npointed out by learned AGP, Mr.Patel, it was observed by Division<br \/>\nBench of this Court in Competent Authority and Additional<br \/>\nCollector and Another v. Shantaben D\/o. Devabhai and Others [2010 (1)<br \/>\nGLH 486], in similar<br \/>\ncircumstances, that the petitioners were all along aware about ULC<br \/>\nproceedings, they had filed no declaration under <a href=\"\/doc\/994481\/\" id=\"a_3\">Section 6<\/a> (1), they<br \/>\nhad opposed taking of possession by the Government, their appeal was<br \/>\nrejected by the tribunal on 31.1.1987 and after keeping silence for<br \/>\nyears together, without challenging order of the tribunal, writ<br \/>\npetition was filed.  Such petition was held to be not maintainable at<br \/>\nall.\n<\/p>\n<p id=\"p_6\">4.\tIn<br \/>\nthe above circumstances, the petition is not only required to be<br \/>\ndismissed in limine,<br \/>\nbut the practice of suppressing material facts and even order of the<br \/>\ntribunal as also making repeated attempts at reviving a cause of<br \/>\naction by making worthless representation and obtaining a response<br \/>\nthereon has to be deprecated with an order to pay exemplary cost,<br \/>\nbecause it amounts to gross abuse of the process of this Court and a<br \/>\nwholly avoidable burden on the limited resources and public time of<br \/>\nheavily over-burdened Courts.  Therefore, the petition is summarily<br \/>\ndismissed with cost quantified at Rs.25,000\/-, which shall be paid by<br \/>\nthe petitioners to respondent no.1 within a period of one month.
