JUSTICE NARENDRA KUMAR JAIN\n\n\nMr. Sunil Kumar Jain on behalf of\nMr. Satish Pachori, for the petitioner.\nMr. Pradeep Shrimal, Public Prosecutor\t\n\t\t\t\t\t\t\tfor the State.\n                   ****\t\t\n<\/pre>\n<p id=\"p_1\">\t\tHeard the learned counsel for petitioner.\n<\/p>\n<p id=\"p_1\">2.\t\tApplicants\/respondent Nos.2 and 3 filed an application under <a href=\"\/doc\/1056396\/\" id=\"a_1\">Section 125<\/a> Cr.P.C. for grant of maintenance against non-applicant\/petitioner. Learned Family Court, Kota vide its order dated 25.06.2011, allowed the application and directed the non-applicant\/petitioner to pay a sum of Rs.1,500\/- per month to Kavita (wife) and Rs. 500\/- per month to Kumari Siddhi (daughter), totalling to Rs.2,000\/- per month as maintenance from the date of application.\n<\/p>\n<p id=\"p_2\">3.\t\tSubmission of the learned counsel for petitioner is that petitioner is ready to keep his wife and daughter with him. He also submitted that on earlier occasion, a criminal case was lodged against the petitioner, wherein compromise took place, but soon thereafter the present application was filed, therefore, respondents are not entitled to get maintenance.\n<\/p>\n<p id=\"p_3\">4.\t\tI have considered the submissions of the learned counsel for petitioner in the light of reasons assigned by the Family Court for awarding maintenance in favour of respondent Nos.2 and 3.\n<\/p>\n<p id=\"p_4\">5.\t\tSubmissions of the learned counsel for petitioner have been considered and dealt with by the Court below while passing an order of maintenance, which has been directed to be paid from the date of application.
