Respondent Nos.l to 7\/plaintiffs filed a suit on 14.9.2007<\/p>\n
against the present appellant\/defendant contending that the’p.r’ope1*ty<\/p>\n
bearing Sy. No.59 originally belonged to one Jothoji ;_.~,:aid<\/p>\n
Jothoji Rao had only four daughters Viz..\n<\/p>\n
Subbubai and Susheelabai. The 15* <\/p>\n
Rao, Dattatreya Rao and the defendant are the sons”.jShantabaiap<\/p>\n
{daughter of Jothoji Rao). During t:he time ofsaidt ffothpjlillf\ufb01ao, he<\/p>\n
settled his property bearing Sy.~..No.59]Wlt  further pleaded that the
\neastern portion of the propertylrtzeaslurijng  west 50′ north to
\nsouth 29.5′ was gifted ‘Rap’. lfihata of the property<\/p>\n
was transferred in \u00a7fav5iir”ofl’l_\\\/[antiajiRap “andit was numbered as Sy.<\/p>\n
No.59\/1. The wals. bequeathed under a Will in favour
\nof Subbubai retained number as 59. The said Subbbai
\nbequeathed _th.epwes’tern ‘portion of the property in favour of her only<\/p>\n
dailgfhter  vlvhowlis enjoying the property as absolute<\/p>\n
oWner.__  that the plaintiff No.1’s husband {Mannaji<\/p>\n
 Ran) died   leaving behind the plaintiff and children viz.,<\/p>\n
 No.-3.2  7. After the death of Mannaji Rao, the property<\/p>\n
  “No.59 was transferred in favour of the .15” plaintiff and the<\/p>\n
  plaintiiil’ is regularly paying the property tax and she is in<\/p>\n
‘afolposslessioli and enjoyment of the same. It is pleaded in paraw7 of the<\/p>\n

plaint that the defendant is none other than the younger brother of
\nthe deceased Mannaji Rao. it is stated that Mannaji Rao permitted<\/p>\n
his younger brother to reside in a portion of the property  Sy.<\/p>\n
No.59\/1. which comprises of a bedroom. kitchen <\/p>\n
the 1*” floor and as mentioned in the schedule at  y <\/p>\n
contended that after the death of Manna3’i_Rao.. <\/p>\n
creating all sorts of problem near_th_e suit.._schedule’l’ property and”;<\/p>\n
picked up quarrel on one pretext oi:Vt:he  women folk.
\nTherefore, the plaintiffs decided “to e\\3’ilct:_th’e\u00ab defendant,  accordance
\nwith law. They issued a legal notice calling upon the<\/p>\n
defendant to vacate  de1iver’pr_1.S.session of the suit<\/p>\n
schedule proplertyi:  wassent under RPAD and Under
\nCertificate of P’o’st_ing, sent by RPAD was returned with
\nan endorsement  ‘ ‘lo’ckf;’  notice sent by UCP was not
\nreiluriiedi   comply with the request made in the<\/p>\n
noticei.arid.t;hAere;ibre was filed for possession as well as damages.<\/p>\n
 defendaiit entered appearance. He has admitted the<\/p>\n
 between them, but denied that the suit schedule<\/p>\n
  gifted by the original owner of the property in favour of<\/p>\n
 Ma-r}naj’i”lRao, etc. In nutshell. the case of the defendant that. he is<\/p>\n

In support of the ease of the_.p_laintiffs,”‘plaintiff  <\/p>\n
herself examined as P.Wl and gotj”r\u00abg.r::i1a.rked    The
\ndefendant has got himself examgineddnlags has not got
\nmarked any documents. The   arguments,
\nperusing oral and do.c11:1g;1enta\u00a7f3Ai’ answered issue
\nNos.1 to 5 and 38″   No.6 partly in the
\naffirmative and  in””th–e;11egative in favour of the
\nplaintiffs andfa_gai.ns’t:v  decreed the suit, directing
\nthe defendant tolaqguit;  Vacant possession of the suit
\nschedule  in  the plaintiffs within 3 months from the<\/p>\n
dateof judgn1er1t;.pE?t:ii’ther, the trial Court has held that the plaintiffs<\/p>\n
‘jzare ent”it:le&’cl._for”  at the rate of ?1.000\/ — per month from the<\/p>\n
VTcg1atVe.of suit’ti1l’*-Vhanding over possession from the defendant. This is<\/p>\n
 this Appeal.\n<\/p>\n
  t\u00a3,ea1’ned Counsel for the appellant submits that though the<\/p>\n
V’-d:app4el’1a;1t \/ defendant has specifically denied the gift deed said to be<\/p>\n

executed by the original owner of the property in favour oif.-Mannaji<\/p>\n
Rao, the trial Court erred in observing; that the dei’endant.”-htiais ~1’10t<\/p>\n
denied the gift deed. It is also contended that the en deedlllisibriott. <\/p>\n
proved as required under Section 68 0f.~t:\u00bbh.e_, Inctlianvlpllfiltridelricii Acts; C<\/p>\n
Therefore, the trial Curt erred in dec1″e’eiz1\u00a7’_’lthe :lsu_:it…: <\/p>\n
contended that the appellant\/defeiidant is a Vcc;~ovlvlneii._:loi'”the suit’<\/p>\n
schedule property and his brother–Dat_tatreya._yRaolhas\ufb01\ufb01led a suit for
\npartition with reference to  ‘Sy. No.59\/ 1 and
\nanother property and the suit   he submits that
\nthe impugned   and the matter
\nmay be rernittedi    with liberty to the
\nrespondents\/ alleged gift deed as required<\/p>\n

 7. Learned Couri’seVI______l.’or the respondents submits that the<\/p>\n

  It is perti11ent. t.o mention that the atleged gift deed at EXP 1.<\/p>\n
 a,  document. Ex.P}(a) is the certified copy of the gift<\/p>\n
   submitted by the learned Counsel for the respondents that<\/p>\n

on record to prove the gift deed said to be executed by  in<\/p>\n
favour of Mannaji Ran. As per Section 88<\/a> of the Indian:–\u00abEvide’n’ce:’ikc’t;v,<\/p>\n

alive, and subject to the process of  and of giving
\nevidence. In this regard, learnc.dV:"C_ou\ufb01nsei:vlioi=_the'a,ppellant relies on a
\ndecision reported in 1959 Myst. (i\u00a7iii;z:1B\u00a7}5ii"\u00a7i\u00e9i':i&1Ai2As1MHAPPA Vs.

\nindicate the  the executant. But the
\ndenial shoulft xuthatwthe person by whom the
\ndocument purporrtstol  has not executed it. The
