Justice ANTONY DOMINIC\n\n Dated :14\/11\/2007\n\n O R D E R\n                      ANTONY DOMINIC, J.\n                     ===============\n            W.P.(C) NOs. 33546 &amp; 33581 OF 2007\n            =========================\n\n           Dated this the 14th day of November, 2007\n\n                         J U D G M E N T\n<\/pre>\n<p id=\"p_1\">       Petitioners are denied admission to LLB course for the<\/p>\n<p>reason that they have not produced the Degree Certificates.<\/p>\n<p>Petitioners submit that they have produced marklists and that on<\/p>\n<p>the strength of the marklists so produced, they should be given<\/p>\n<p>admission.\n<\/p>\n<p id=\"p_1\">      2.    In my view, this issue is squarely covered by the<\/p>\n<p>provisions contained in the prospectus for admission to the three<\/p>\n<p>year LLB course 2007-08 in the Government Law Colleges in<\/p>\n<p>Kerala, which has been produced as Ext.P11 in WP(C) No.33581<\/p>\n<p>of 2007.     The relevant clause of the prospectus is extracted<\/p>\n<p>below for reference.\n<\/p>\n<blockquote id=\"blockquote_1\"><p>      &#8220;Clause 16:     Documents to be produced at the time of<br \/>\n                      Centralised Allotment Process (CAP).\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_1\"><p>      (i)   Admit card of the Entrance Examination.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_2\"><p>      (ii)  SSLC or any relevant school records to prove date of<br \/>\n            birth.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_3\"><p>      (iii) Original Mark lists of all parts and Provisional<br \/>\n            Degree\/Degree Certificate of the Qualifying Exam with<br \/>\n            photocopies of the same.\n<\/p><\/blockquote>\n<blockquote id=\"blockquote_4\"><p>      (iv) The originals of the certificates the copies of which had<br \/>\n            been submitted with the Application.\n<\/p><\/blockquote>\n<p id=\"p_2\">WPC Nos.33546 &amp; 33581\/07<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                                 : 2 :<\/span><\/p>\n<p id=\"p_3\">      (v)   Authorization letter in the prescribed form, given in<br \/>\n            the Annexure VII, if the candidate is not attending the<br \/>\n            CAP.\n<\/p>\n<p id=\"p_4\">      (vi) Any other documents mentioned in the Notification of<br \/>\n            CAP.\n<\/p>\n<p id=\"p_5\">Note:       All certificates as above must be produced for<br \/>\nverification at the time of CAP itself. Candidates WILL NOT be<br \/>\ngiven any chance to produce the original documents\/certificates<br \/>\nasked for, after CAP.&#8221;\n<\/p>\n<p id=\"p_6\">      From the above, it is evident that in addition to the<\/p>\n<p>marklists, provisional degree\/degree certificate of the qualifying<\/p>\n<p>exam with photocopies has to be produced at the time of<\/p>\n<p>Centralised Allotment Process itself. It is also made clear that<\/p>\n<p>the candidates will not be given any chance to produce the<\/p>\n<p>original documents after Centralised Allotment Process. In this<\/p>\n<p>case, it is admitted that the petitioners have not satisfied Clause<\/p>\n<p>16 of the prospectus.
