First Appeal was not heard.\n\nRelevant Facts<\/pre>\n<p id=\"p_1\"> emerging during Hearing:\n<\/p>\n<p id=\"p_1\">The following were present<br \/>\nAppellant: Mr. Vipin Kumar Saini representing Smt. Abha;<br \/>\nRespondent: Mr. K. S. Meena, Public Information Officer &amp; ADM (Central Dist.);\n<\/p>\n<p id=\"p_2\">        The Appellant states that he has filed the first Appeal on 21\/08\/2009 vide diary no. 2842.<br \/>\nThe First Appellate Authority Mr. Akash Mahopatra, Dy. Commissioner appears to be guilty of<br \/>\ndereliction of duty since he had not passed any order in the matter.\n<\/p>\n<p id=\"p_3\">The PIO is directed to provide a specific answer to query-4. The answer to query-6 &#8220;File is not<br \/>\navailable with ADM or DPO. Staff of DC Personal Branch declined to give copy of the<br \/>\nfile\/notings&#8221; is completely unacceptable. Denial under RTI can only be given under Exemptions<br \/>\nof <a href=\"\/doc\/1001313\/\" id=\"a_1\">Section 8(1)<\/a> of the RTI Act. The deemed PIO in this case is Ms. Sangeeta Gaur who has<br \/>\nsigned the letter providing the information to the Appellant. The PIO informs the Commission<br \/>\nthat Ms. Sangeeta Gaur was a contracted employee. It is not proper that contracted employees<br \/>\nstart giving information under Right to Information.\n<\/p>\n<p id=\"p_4\">Decision:\n<\/p>\n<p id=\"p_5\">The appeal is allowed.\n<\/p>\n<p id=\"p_6\">      The PIO is directed to provide the information on query-4 &amp; 6 to the Appellant before<br \/>\n20 March 2010.\n<\/p>\n<p id=\"p_7\">       The First Appellate Authority Mr. Akash Mahopatra, Dy.
