Civil Application, the Applicant has prayed to<br \/>\n\trecall the order dated 14.10.2010 rendered in Misc. Civil<br \/>\n\tApplication No. 2484 of 2010 in Special Civil Application No. 1195<br \/>\n\tof 2007 by this Court, by which the said Misc. Civil Application has<br \/>\n\tbeen dismissed for default as Mr. Mukund M. Desai, learned Advocate,<br \/>\n\twho has entered his appearance has elected not to remain present<br \/>\n\tbefore the Court when the matter was called out.  It is therefore<br \/>\n\tprayed to restore the said Misc. Civil Application to its original<br \/>\n\tnumber on the grounds stated in the application.\n<\/p>\n<p id=\"p_1\">It<br \/>\n\tis stated in the Application that Mr. Mukund M. Desai, learned<br \/>\n\tAdvocate who has filed his appearance on behalf of the Applicant,<br \/>\n\thas filed sick note on 14.10.2010, and his colleague who is looking<br \/>\n\tafter the matter was not available on that day, and the sick note,<br \/>\n\twhich was filed by him was not mentioned before the Court, and<br \/>\n\tbecause of his sick note, he could not remain present before the<br \/>\n\tCourt.  The Applicant sincerely regrets and tenders his apology for<br \/>\n\tthe same.   Lastly, It is also pleaded that the applicant has a good<br \/>\n\tprima facie case and balance  of convenience also lies in his<br \/>\n\tfavour.  It is therefore prayed for the relief to which the<br \/>\n\treference is made in earlier paragraph of this order.\n<\/p>\n<p id=\"p_2\">Mr.\n<\/p>\n<p id=\"p_3\">\tMukund M. Desai, learned Advocate has submitted that as the Code<br \/>\n\tNumber of the Advocate was not mentioned on the sick note,<br \/>\n\ttherefore, the registry has not circulated the sick note before the<br \/>\n\tCourt and therefore the matter has been dismissed for default.  It<br \/>\n\tis therefore humbly submitted by him that through inadvertent<br \/>\n\tmistake his Clerk has not mentioned the Code Number of the Advocate<br \/>\n\ton the sick note.  He therefore urged that the bonafide mistake on<br \/>\n\tpart of the Clerk of the Advocate may be pardoned and on account of<br \/>\n\this mistake, litigant should not suffer.  He, therefore urged to<br \/>\n\trecall the order dated 14.10.2010 and restore the matter to its<br \/>\n\toriginal file.\n<\/p>\n<p id=\"p_4\">Having<br \/>\n\tconsidered the submissions advanced by Mr. Mukund M. Desai, learned<br \/>\n\tAdvocate for the Applicant and on perusal of the averments made in<br \/>\n\tthe application, according to us, bonafide mistake on part of the<br \/>\n\tAdvocate in not mentioning the Code of the Advocate on the sick<br \/>\n\tnote, litigant should not suffer, and therefore, instant Application<br \/>\n\tdeserves to be allowed by granting the prayer made therein.\n<\/p>\n<p id=\"p_5\">For<br \/>\n\tthe foregoing reasons, the Application succeeds and accordingly it<br \/>\n\tis allowed.  Resultantly, the order dated 14.10.2010 rendered in<br \/>\n\tabove numbered Misc. Civil Application is hereby recalled, and<br \/>\n\tconsequently, the above numbered Misc. Civil Application is restored<br \/>\n\tto its original file.\n<\/p>\n<p id=\"p_6\">Registry<br \/>\n\tis directed to list the above numbered Misc.
