The<\/p>\n<p>grievance of the petitioner who is the Patron of the Action Council for<\/p>\n<p>Establishment of the Central Private Bus Stand within the limits of the<\/p>\n<p>Kayamkulam   Municipality   is   that   in   spite   of   Ext.P1   series   which   will<\/p>\n<p>indicate that the proposal to establish the bus stand on the property in<\/p>\n<p>R.S.224\/5 belonging to SPMS was under serious consideration and in<\/p>\n<p>spite   of   the   fact   that   substantial   amounts   have   been   invested   for<\/p>\n<p>constructing a road to that property, there is a proposal now to go in<\/p>\n<p>for   establishing   the   private   bus   stand   at   some   other   place   after<\/p>\n<p>dropping   the   said   proposal.         In   fact,   the   Tribunal   for   Local   Self<\/p>\n<p>Government   Institution   under   Ext.P3   order   directed   the   Municipal<\/p>\n<p>Council to consider the proposal to have the bus stand established on<\/p>\n<p>the   property   belonging  to  the   SPMS  also  along  with  other   proposals.<\/p>\n<p>Ext.P3   order   was   passed   by   the   Tribunal   after   setting   aside   a<\/p>\n<p>resolution   passed   by   the   Municipality   to   the   contrary.     Ext.P5<\/p>\n<p>representation   has   been   submitted   by   the   petitioner   before   the<\/p>\n<p>Kayamkulam Municipal Council.\n<\/p>\n<p id=\"p_1\">\n<p id=\"p_2\">       The   Writ   Petition   accordingly   will   stand   disposed   of   with   the<\/p>\n<p>WP(C)N0.5877 of 2007<\/p>\n<p><span class=\"hidden_text\" id=\"span_1\">                                            -2-<\/span><\/p>\n<p>following directions:\n<\/p>\n<p id=\"p_3\">\n<p id=\"p_4\">       The Municipal Council will take  up Ext.P5, consider the same in<\/p>\n<p>the   light   of   the   various   grounds   raised   in   the   Writ   Petition   and   the<\/p>\n<p>documents produced, particularly Ext.P3, hear the petitioner and also<\/p>\n<p>the   functionaries   of   SPMS   and   anybody   else   who,   according   to   the<\/p>\n<p>Municipality,   will   be   concerned   in   the   matter   and   take   a   correct<\/p>\n<p>decision  on  Ext.P5.     Decision  as  directed  above  will be  taken  within<\/p>\n<p>one month of receiving copy of this judgment together with copies of<\/p>\n<p>all the exhibits on which the petitioner  wants  the Municipality to rely<\/p>\n<p>on.\n<\/p>\n<p id=\"p_5\">\n<p id=\"p_6\">                                     (PIUS C.
