RAVI RAI, SON OF LATE CHHATHU RAI\n         ALL RESIDENT OF VILLAGE-DAHIYAWAN, P.S.-CHAPRA TOWN, P.O.-CHAPRA,\n         DISTRICT-SARAN AT CHAPRA.\n                                                                    .....Appellants.\n                                        Versus\n         THE STATE OF BIHAR                                         .....Respondent.\n         For the Appellants           : Mr. Sumant Singh, Advocate.\n         For the Respondent           : APP.\n                                      -----------\n<\/pre>\n<p id=\"p_1\">03\/        27.06.2011                   Heard       learned       Counsel      for     the<\/p>\n<p>                          appellants         and     learned      Counsel      for     the<\/p>\n<p>                          State with regard to prayer of the above<\/p>\n<p>                          named six appellants for releasing them on<\/p>\n<p>                          bail.\n<\/p>\n<p id=\"p_1\">                                        The    case       is   based    upon    alleged<\/p>\n<p>                          oral     dying      declaration         of    the    deceased<\/p>\n<p>                          which     was    made      at    a   hospital       where    the<\/p>\n<p>                          victim        was         initially          treated.        The<\/p>\n<p>                          prosecution case is that when the victim<\/p>\n<p>                          was     being      carried      to   Patna     for    further<\/p>\n<p>                          treatment          then     he       succumbed        to     the<\/p>\n<p>                          injuries.\n<\/p>\n<p id=\"p_2\">                                        Submission is that no evidence has<\/p>\n<p>                          come that the victim was initially treated<\/p>\n<p>                          by    whom    or    in     whose     presence       the    dying<\/p>\n<p>                          declaration          was        made.    The        chain     of<br \/>\n<span class=\"hidden_text\" id=\"span_1\">                               2<\/span><\/p>\n<p>            circumstances is not completed.<\/p>\n<p id=\"p_3\">                        Considering            the    facts    and<\/p>\n<p>            circumstances, the appellants namely, Manan<\/p>\n<p>            Rai, Sanjay Rai, Shivjee Rai, Deepak Rai,<\/p>\n<p>            Dabloo    Giri        and   Ravi   Rai,   during   the<\/p>\n<p>            pendency of the appeal are directed to be<\/p>\n<p>            released on bail on furnishing bail bonds<\/p>\n<p>            of Rs. 10,000\/- (ten thousand) each with<\/p>\n<p>            two sureties of the like amount each to the<\/p>\n<p>            satisfaction of Shri Gangotri Ram Tripathi,<\/p>\n<p>            the     learned        XIth   Additional     Sessions<\/p>\n<p>            Judge\/his successor court, Saran at Chapra<\/p>\n<p>            in connection with Sessions Trial No. 66 of<\/p>\n<p>            2010.\n<\/p>\n<p id=\"p_4\">\n<p id=\"p_5\">                       (Shyam Kishore Sharma, J.)<\/p>\n<p>                       (Rajendra Kumar Mishra, J.)<\/p>\n<p>kksinha\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Manan Rai And Ors. vs The State Of Bihar on 27 June, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA CR.
